  1. Thank you again, Gary and Alla. I guess after doing this research I hadn't realized really how subjective this part of the process is.

    So, to be clear the I-134 is for the embassy and the I-864 is for the Adjustment of Status in the US. For the K-1 visa the Adjustment of Status has to happen by when? If that is a stricter process, which from my reading on here it seems to be, what if I'm still in school at the time? Does the employment permission happen before or after that?

So, the way it would work is I would be given enough for whatever tuition is not covered and then an additional $20K or so for living expenses for the year. Plus, (and I'm not suggesting the embassy would take this into account, just for the record) it would be a masters program in nursing so definitely employable and earning well afterward. :)

    Also, he would be able to continue working remotely in the work he does. I don't think that is illegal since he wouldn't be working for a U.S.-based company and he wouldn't be working for an Argentine company based here. It would be as if I did free lance writing for a U.S. magazine, but I wrote it from another country. But that aside, I know that his income will not be able to be counted.

  3. I'm going back to school for my masters and will not be working during the time of the interview. I'll be funding my masters fully on grants, scholarships and loans (mainly loans). I am wondering in terms of the Affidavit for Support at the embassy interview, would that be considered income to prove support? The thing is that is not counted as income for tax purposes, so I wondered if it can be considered living expenses. Would it be a case where I would just bring my financial aid package from the university? Also, it would be just a few thousand dollars over 125% on the poverty line- do they legally have to abide by that guide or do they ever get very picky and expect the support to be more?

    I'm just trying to explore all options before I ask for co-sponsorship from my parents.

  4. Yes, I've considered that. I'm more worried about his health for traveling TO the consulate. So, for instance if I asked for an extension and he was in good enough health to travel to the consulate in May (a month into the additional extension), then he'd could come to the US immediately. I'm also worried because I've heard that many health insurance companies won't cover new immigrants. In Mexico, he has basic coverage and medical services are cheaper, so part of this is financial concerns. Since I won't be able to cover out of pocket a surgery or costs associated with any complication his surgery (in Mexico) will have.

    Also, there will definitely be no strikes against him if he decides to go on anti-anxiety medication? Is there even a question that asks about that during the medical interview?

    Any thoughts on that? Thanks for letting me be so specific.

Hello all, my fiance is having medical problems in Mexico (I just moved back to the US to get a head start on things financially and get a job before he heads up here) and will need to go into surgery. This is all traumatic enough, but added to that is having to work within time limits of the NOA2. We received our NOA2 on Dec. 11. I've read that it expires within 4 months of that date (that would be April).

    I'm hoping this won't be necessary, but what would happen if we had to wait for his recovery and couldn't get to the Juarez consulate by that date- April 11?

    How could I go about filing an extension if it comes down to that?

    Would filing an extension be something that could be counted against him in the interview?

    What about medical stuff? He has a cyst in his nasal passage and had sinus issues, and surgery, about 5 years ago.

    Also, and I hate sharing this on a forum where I don't know anyone really, but due to all of this (me leaving for the US, other issues recently occurring with his job, and now this major health concern- not to mention the idea of moving to the US) I've encouraged him to consider anti-anxiety medication (Paxil). Is that something that could come up in the medical that would lead to problems or a denial?

    I haven't been on in about a month due to all of this happening, so I appreciate any sound and accurate advice. Thanks so much.

    Hey racheljana and all- NVC received our case Dec. 10, and sent it out Dec. 12...Progress!

    Excellent! Just curious... do you continuing tracking your case online from the USCIS website when it goes to NVC? If not, since it goes to Dept. of State, how do y'all find out this information?

  7. Thank you, Allie! I finally have this answered. So, usually how far out is the expiration date? Two months, three? And then for Juarez it is 6 months once you get the K-1 visa, right?

    This is what I'm talking about. There is an expiration of the NOA2, right? Does anybody have information on that? I mean, Jeff and Sofia are talking about less than two months in order to gather everything and go! Yes, NOA2 has expiration. However in rare cases CDJ takes so long to send out fiance packet that it gets close to NOA2 expiration. However if packet is already sent out to you - and within NOA2 - go before it expires or send an email to CDJ to request a NOA2 extension. If CDJ is still working on case and it is in there hands and NOA2 expires - you are okay. You can send a friendly email to them advising you have not received fiance packet and NOA2 is set to expire and request an extension. Most likely they will email you back and say since in there hands and they are working on the case, NOA2 doesn't matter.

    Hi everyone, hope everyone is enjoying their holidays!

    I need some help with some last minute items. I received the US citizen copy of the invitation letter in the mail Nov. 19, but my fiance in Mexico has not received her invitation letter and packet. Our NOA2 expires 1/9/08!

    Need confirmation, can we use my copy of the invitation letter? Or, do you have to use the one the fiance should receive?

    Also, can someone else confirm if the consulate will be open 1/2/08 - 1/4/08? I know that the consulate is supposed to be open all days except American and Mexican holidays and last friday of the month. Just want to make sure the following days after New Year's are not considered "Gov't" holidays.

    Can anyone recommend a hotel to stay in Juarez? I'm really looking forward to seeing mi amor!!!

    Lastly, the example forms DS-157, DS-158, and DS-230 on Visa Journey are not included in the Fiance Visa Packet available online on the Juarez Consulate website. Can someone confirm what these are for? And, that they are not needed?

    I hope this thread doesn't die, or that all the people with good information leave. I am wondering how much time do I have to get to the consulate for the interview once we receive Packet 3? I am thinking about leaving Mexico and going up ahead to work for financial reasons. I'm wondering if there is an expiration, so to speak. I know there aren't appointments for the K-1, so I wonder is it a matter of 3 months or so for you to be able to get to the appointment?

    I hope that is clear b/c I asked before on a separate thread and nobody seemed to know.

  11. Ok, that makes sense. So, with that would it mean that cases that have been approved before me were perhaps less complicated or just in the hands of a faster worker? Because I am seeing several that are nearly a month behind me with NOA2, whilst I have no "last updated" touches (hence I would believe they haven't started working on my case).

    Also, I know they say country doesn't matter but I'm feeling like I'm seeing quite a few Philippines cases already approved. Just being nit-picky...

When I do the timeline function (at the top of the page) for the K-1 and organize it according to NOA1 I see that there are several cases that have already received their NOA2s that are behind mine. I do take into account service center, many folks don't update their timelines and even the possibility that people accidentally input incorrect date information for the NOA1, but I'm still curious as to what's up. Anybody have an insight on this? I've read Huskerviev's thread, so I have an idea how the inside works. Just curious.

Lo unico es que no me acordaba que a los de visa K-1 no necesitan una cita, pues pueden ir cual quier dia entre las dos primeras horas de oficina de la Embajada en Cd. Juarez

  14. Once we receive the NOA2 and our case is sent to the State Department, we wait for the package from Juarez. I was wondering what is the time limit before we need to collect all of our stuff and get there? So, between the time we get the package saying to collect all the necessary information and show up for an appointment (no interviews for the K-1 at the Juarez consulate), do we have a time limit before it expires? I'm just trying to figure out logistics with jobs and what not. Thanks!

  15. A friend of mine here in Mexico has decided to cancel her fiance visa application (they are at the NOA1 stage). The guy is a middle-class professional (so ok in the money department but not rich) and is very worried about this affecting his future travel to the US. He flies to the US about once or twice every year on his 10-year tourist visa to visit family and friends, and has never had problems entering. They are both concerned that when she cancels the visa he'll have trouble entering the US (even though he has his tourist visa). They probably won't stay in touch, much less attempt to get married, so no need to clarify that when answering. Anyone have experience with a question like this?

    Does having a record that you once were the beneficiary of a US citizen applicant make it more difficult to visit the US, even with your tourist visa?

  16. Okay, the Paulina Rubio news has me a little concerned. Does the Juarez consulate medical exam thing include a marijuana test? No, we don't do marijuana. Just wanna know. Thanks.

    in fact, I have friend that was denied for simply admitting he smoked pot in college a few times during his medical interview. And then his tourist visa was taken away and they have to go through a 3-year period of testing and distance. There was recently someone on this link that had a similar experience.

  17. Hey, asked this before but got no response. For the K-1 process I know they say that there are no appointments at CDJ, but does that refer to just the time of day or also the actual date? Is it a case that once you get the letter you just go up there (with all your documents) any weekday you like?
