  1. Hello Members:

    My wife just got her AOS approved just 1.5 months before our 2 year anniversary. The interviewer stated that we will get a temporary green card. But we got a letter from the USCIS stating the card has been sent for ordering and we should recieve it in 3wks. Also in that letter it states that the validation should be for 10 years.

    So the question is: Does the letter mean that she will not get a temporary green card or will she?

  2. What version of the form I-765 did you mail in?

    The top right corner probablty says Exp 08/31/08.

    What does the bottom right corner say? Rev 05/27/08 or Rev 04/08/08?

    I ask because recently, some people who sent in the 4/8/08 version have been rejected and they had to resubmit using the 5/27/08 version.

    My top right actually says - Expires:9/30/08 but the bottom right states Rev:07/30/07

  3. 1) I received my NOA1 for I-485 but not for the EAD. Should I worry?

    Depends on when you sent the package in and when you received the NOA1 for the I-485. The EAD NOA1 might be on its way.

    2) How do I know where my application has been transfered too?

    You can sign up for updates at the website (which they usually but don't always update). Then you can view your case status online and opt to receive email updates. You'll also be mailed a letter if your case is transferred.

    3) Who and where can I call to find out information for my EAD?

    Sorry, I don't know. First, can you tell us the dates for 1)?

    4) What is the current average time wait for a green card to come in hand from NOA1 receipt?

    Update your VJ timeline, and the system will tell you average times. My observation is that EADs have been arriving an average of about 75 days after AOS packages are sent in, although some are faster, and some can take much longer. The green card comes after a successful interview or after your case is transferred to CSC, and the time for that can vary much more.

    Thanks for the quick response. To answer your question for number3, I have submitted my AOS application with the EAD form on 8/11/2008. I guess I will wait it out this week to see if the EAD NOA1 arrives, else I will call and find out.

    It has been since March since my wife came here to the United States on a K-3 Visa and I am about to file for her I-485. Since I used a lawyer to do my K3 application, I decided to omit the lawyer this time and file it myself. So this is why I am nervous. :blush:

    Well, I need you expertise and guidance before I fill out the application.

    Just to clarify here are the following documents I have ready to be sent in my packet.

    1) Cover Letter

    2) Money Order for the amount of $1,010.00

    3) I-485 Application Completed and Signed

    4) Copy of Marriage Certificate

    5) Copy of I-130 Approved Letter and I-129F Approved Letter

    6) Copy of her Passport Front and Back

    7) Copy of her Birth Certificate

    8) Copy of her I-94 Card

    9) I-693 - Completed by Doctor and in a sealed envelope

    10) 4- Copies of G-325 of me and my wife

    11) I-765 Signed

    12) 6 Passport Size Photos

    13) I-864 Signed and Notarized

    14) My Latest Tax Returns for 2007

    15) My Latest W2 for 2007

    16) Current Employers Employment Letter

    17) Last 3 pay stubs

    Is there anything missing?

    Also, I hear that people are sending photos, letters, and other types of marriage proof. Is this required? Also can someone verify the mailing address of the Chicago Lockbox?

    It has been around 2 months since my wife entered the states and just got time around to begin the process for AOS. But before I do I need your expertise on some questions I have. The Guide on VJ states that I should have the following in my package.

    1. Payment as required by USCIS. Be sure to include the payment for both the I-485 and the biometrics fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead.

    2. Cover Letter. Should include a description of what your are petitioning for (I-485), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

    3. Form I-485: Petition for Alien Relative

    4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).

    5. Copy of the non US Citizen Spouses valid I-94 (front and back copies)

    • Question: I just took my spouse to the Bahams on a cruise but when we reentered into the states, they officer did not give my another I-94 card so she still has her initial card stating arrival on March 1 but her passport does have a new entry stamp though. Would this be a problem?
    • Question: On her I-485 form, what should I use for date of entry to the united states? The date that is on her passport or the date on her I-94 card?
    6. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)

    7. A certified copy of your marriage certificate. (If filing for your spouse)

    8. A copy of the petitioner's and/or intending immigrant's divorce documents. (If filing for a spouse, and one or both of you have been divorced before)

    9. A copy of a prior spouse's death certificate. (If filing for a spouse, and one or both have you were married before, and the prior spouse died)

    10. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    11. G-325A (all four pages) filled out,signed and dated

    • Question: Do I need to submit G-325 as well or just for my wife?
    12. I-693, Medical Examination of Aliens Seeking Adjustment of Status

    • Question: Where do I go and get this. She got her medical done from India before coming to the states since she needed it for her K3 Visa. But upon arrival she submitted the medical report to the INS officer. Do I need to get another medical done and if so where?
    13. I-864, Affidavit of Support (see poverty limits here)

    >> Include any additional required supporting documentation

    14. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

    15. I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

    16. I-485 Supplement A, and penalty fee if applicable. See 8 CFR 245.10

    17. I-601, Application for Waiver of Grounds of Excludability**, if applicable

    * Fingerprint fee not needed for applicants under 14

    ** an I-601 is NO FEE, if, and ONLY if filed WITH an I-485. Later filing DOES require a fee. Whether to file an I-601 is an important decision -- like the J-1, consulation with an attorney is recommended. [/color] [/font][/b][/color][/b]

  7. Hello Fellow Members,

    Just want to let everyone know that my wife's K3 Visa is approved!!!! :dance::D.

    Here is some information on what went on at the interview.

    1) Reached there at 7:30am

    2) First person to get inside. Got interviewed by 1st Immigration Officer around 8:30. The gentleman only asked for the K3 checklist. Did not ask for any 'Proof of relationship'

    3) Was told to pay fee and get fingerprints done.

    4) Around 10am, second interview occurred. That gentleman asked alot of question (about 10) and mostly about me and what i do here in America.

    Over all it went real smooth!

    Quick Question: Does anyone know how long does it take for the Embassy to send the documents over to VFS? My wife had her interview on Monday and she called them up today and VFS office stated that they have not recieved her passport yet. She is planning to leave on Thursday (India Time).

    My wife has her interview on 25th of Feb at 8am for her K3. The question I have is that she is planning on reaching the embassy around 7:30am. Since there are usually tons of people that have their interview at 8am that day. Will she be considered late if she does not get into the building before 8am.

    What I am trying to say is what is the procedure once you get to the embassy for the interview. It would be great if someone could give me step by step that way I can explain it to my wife.

    On the Affidavit of Support I-134. I have given my wife the following documents.

    1) I-134

    2) 2006 Tax Returns

    3) W2 of 2006

    4) Company Letter stating my title, salary and how long I have been working there.

    Do I need anything else?

  10. Hello Fellow Members,

    My wife jsut got her interview date schedule for Feb 25. Two questions.

    1) Does she have to submit her paper to the VFS office or can she just take the entire package to the interview? She went to the VFS office and paid the courier fee.

    2) I was in India about 10 days ago and we printed out the DS156 application that we filled out online. Does the delhi embassy accept the online version or does it needs to be handwritten?

    3) When I was in India, I got the I-134 Notorized by the New Delhi Consulate. It was typed and not handwritten. Would this matter when my wife goes to the embassy?

  11. Question: My I-130 and I-129F(K3) has been approved after 9 months on 1/8/08. They over nighted the application to NVC and NVC recieved it on 1/10/08 and created a case number. Here are my questions below.

    1) How long does it usualy take to go from NVC to embassy(New Delhi)?

    2) Anyone that has sent their application to New Delhi, do you know how long the embassy usually takes for I-129F K3 visa processing?

    3) I am planning on going to India too see my wife for vacation. I have gotten my NOA-2 in the mail for both I-130/129F. Is it a good idea for me to go to the embassy with my spouse to see if I can expedite the process there and if they allow me to bring my wife back with me?

    4) Has anyone done what I am talking about in question 2 and what are their experience.

  12. Hello All,

    My lawyer just called CSC and they notified him that an RFE has been sent for 4 more passport pics of me :angry: (thank god it is not major). I got this notification from my lawyer on Wed 7 Nov 2007. But I have not recieved any letter from CSC yet. I have two questions:

    1) How long does it usually take for a RFE letter to come? ( The laywer told me this is for my I-130)

    2) Once I get the letter and overnight it back to CSC, how long do they usually take for approval.

    Timeline:

    Applied for I-130 - May 18

    NOA1 (I-130) - June 20

    Applied for I-129F - June 21

    NOA1 (I-129F) - July 7

    Based on everyone's timeline, I am expecting an approval this month. Maybe now it will be december since I have an RFE coming.

    Approval please come fast!!! :crying:
