Hi there! First of all, breathe. I don't want to discourage you (quite the contrary!) but the process is just starting for you. You need to learn to manage stress, otherwise it's going to take a toll on you, and on your relationship. Take it easy, one step at a time.

So the first thing you have to do is to read the rejection letter very carefully, and see what they are asking of you.

For your process, you need to submit the following forms: I-944, I-864, I-130, I-130a, and I-485. Additionally you can submit your I-765 and I-131, which are the work and travel permit respectively. They're optional but I'd highly recommend you to do it now because they are free if you include them with the rest of the application.

Make sure that all the forms are the current edition date, and signed. Also, make sure that you DO NOT LEAVE ANY BLANK SPACES. If something doesn't apply to you, you write N/A or NONE, accordingly.

I didnt have to submit form I-944, but from what I have read, not everything is going to apply to you, so write N/A.

Each form has specific instructions, so what my husband and I did was to read them carefully almost 3x each, and write down what documentation was necessary and what was optional. If something was optional but we had it, we sent it. For example, form I-864 states that an employment verification letter might be included in order to show that the sponsor can support you, so we did include it.

My advice is, instead of having that tremendous amount of energy put into being frustrated, use that energy to read the instructions. Print them, highlight them, write notes on them! That's what we did and 7 months later here we are, with GC in hand.

Also, even if you are an international student, I am pretty sure you do need to have a SSN, especially if you have loans. Are you sure you don't have one?

Thank you for answering so in depth.

To everyone, I no longer need any answers because my wife wants a divorce and there's nothing that can change her mind, sadly. Thanks again for all of your answers. You saved me a lot of stress.

SSN isn't required. From the government: "You should advise your coverage provider that you do not have an SSN or TIN and give them the date of birth for each covered individual." https://www.irs.gov/affordable-care-act/questions-and-answers-about-reporting-social-security-numbers-to-your-health-insurance-company

I was turned away from the person i called that transfers people to health insurance companies. Well - He actually turned me to MediCal. Which is a government assisted health care. Doesn't it look horrible on my application if i'm using this country's tax money to get a cheaper insurance when I haven't gotten any acceptance from USCIS yet?

  3. So i've got a question regarding health insurance. I'm in the situation right now where i couldn't afford health insurance for this term at the time when they were enrolling and now it's too late. Is it okay to send them the application without any health insurance information? It doesn't feel right.

I'm not allowed to get a health insurance coverage at most companies because i don't have a SSN. Any suggestions for me?

Yes you can check them out, we used equifax but you can also check with experian or transunion. Their statement will just cover that you don't have a credit history and therefore no credit score but it shouldn't cover tax related questions.

For those I think there's a box to check that you have not filled taxes yet (don't quote me on that though).

You don't need to retranslate you certificate if it's a;ready in English. You might want to provided  these grades in case you don't have a higher degree and it could also help to prove your english proficiency level.

Did you send an email to Equifax and print the response for your application or how did you get their statement? I can't find anything on the websites of the companies listed. I've tried calling them but they're all asking for a SSN, which I don't have.

    Hi,

I wasn't in the case of not having a ssn nor a credit report because I was allowed to work through school for the past few years; however when this is the case I've read that you can ask one of the 3 credit bureaus to issue you a document that shows you don't have a credit history/score. I'm not exactly sure how to get them but I've seen plenty of I-944 related forum where people were in the same case than you (usually k1 filers) and they were able to get a statement stating they don't have a credit history.

It's understandable that you get by month to month while being a F1 student - and they shouldn't penalize you for not having a lot of savings in your situation. It's actually regarded as a good thing to be enrolled in school so don't worry about your debt. Just make sure you provide as much documents as you can so try to provide 12 months statements of all the bank account you have.

I will look at the form instructions to find the credit bureaus. So one statement from them will cover all of these?:

Copy of the Beneficiary U.S. Credit Report

Copy of the Beneficiary U.S. Credit Score
Copy of the Beneficiary W-2’s for the most recent year
Copy of the Beneficiary Form 1040 for the most recent year
Copy of the Beneficiary IRS transcript for the most recent year

I also wonder about my high school diploma. I've gotten it written in English by the high school. Do they need my grades for the individual classes or only the certificate? And do they need the high school certificate translated even when it is written in English already?

You can look at this list and I hope it'll help you. I am a F1 student too and this is a copy of our list for this packet. Copy of the Beneficiary W-2’s for the most recent year
Copy of the Beneficiary Form 1040 for the most recent year

I do not have access to any of these as i've never had a SSN. I read in the form instructions that they still want documents that prove i don't have those and i don't understand what to send to them.

    Also regarding:

Copy of the Beneficiary Checking and Savings Record with translation

My bank account is just embarassing, i don't have savings. Should i just send them a screenshot of my american bank account? There's not much there. I get by month to month right now on student loans.

Took me 2-3 weeks, all in all.

Do you have your transcripts from Sweden for your secondary education?  Are you an undergraduate at a U.S. university, or are you a graduate student?

I have only done a certificate in the US. I'm studying for a second certificate. And my degree from Sweden is my 'Basic education'. I do have a document from my school in Sweden saying I have basic education, which allows me to study abroad.

Yes but it depends on the provider whether they will include you or not if no SSN.

You just became aware of the form 30 mins ago and are already asking questions with anxiety as you see them. As others have pointed out, be calm and read i944 instructions and go through the form thoroughly, may be take few hours and understand everything. Sort out the ones you can have available and the ones you can’t or are confused with. Then ask questions on those rather than asking one by one as you find them. You would get better response by doing so.

Don’t plan to finish and submit in 1-2 days, it’ll take time.

How much time do you think it takes to gather everything? My school ends in one month and I would not be in legal status anymore after that.

You are going to have to go through the I-944's instructions.  There's a fair amount of extra information that the I-944 requires, such as validation of your foreign education (with transcripts), bank statements (U.S.), W2s (if you worked at university in any capacity/received a scholarship or stipend), your tax transcripts (if you filed taxes), health insurance proof (which you should have given that students here are required to have health insurance), and a U.S. credit score (if you don't have it, look for the thread here on how to prove *not* having one).

If you need guidance of the foreign education evaluation, there are some threads here on people's experience, turnaround time (if you have transcripts avaliable), etc.  If you don't have your transcripts, how about asking your university for a copy of them in the meantime?  A couple of evaluation services accept copies.  If they are in Swedish, they'll need to be translated as well.

My advice is to just treat this all as a checklist that can be knocked out.  Hopefully

Thank you. Am i legally allowed to be on my wife's health insurance plan?

    For this form I-864

that is needed of course but for everyone’s situations are different.

you stated your form was rejected but on what grounds for what reason

did you guys reach the poverty guidelines

please note that when advancing with this process it takes adequate time and you has the individual have to do a little research as it relates directly to your category you fall in. There’s a checklist on the USCIS website for the form I-864

We have included everything that is needed for Form I-864. The problem is that I did not include Form I-944. Now Form I-944 confuses me to death, It's asking for information that I don't have. I don't have any credit score or tax information about myself because I don't have a SSN

  11. 2 minutes ago, JayDGODITRUST said:

Relax as i stated just take it easy

#1. No they don’t need nothing about your roommates. This is about you and your spouse. Let’s clear that.

#2. Okay you guys are living separate for now that’s okay. They still need your spouse complete income information and any other information they ask for on the form I-944

i know this is a very difficult process but if you overthink it will place you in a deep stress state.

no need for that. Take a break and I’m serious. relax your mind and move back into it. Read over the document of the I-944 instructions form. It’s all there it’s overwhelming but it’s doable. Is that all that's needed?

We have included my wife's tax transcripts that were needed for the I-864. Is that all that is needed?

I am truly sorry you’re going through this stressful time.

however take a breather and relax.

just go back and complete the New supplementary form I-944 that talks about public charge.

just go to the instructions part of that form it will ask you questions about your household which that includes your husband and kids if any.

don’t let it confuse you too much you complete what they ask not everything is for you

They only wanna know if you will be of public charge now or in the time to come.. just breathe

My wife and I don't live together, we live in Los Angeles where rents are high and we are renting rooms and have roomates in seperate apartments. We haven't moved in together yet. Do they want my roommates information? I'm so confused and stressed out right now

  13. Just now, Paul & Mary said:

It is in the instructions on the I-485.

    9. Public Charge: Declaration of Self-Sufficiency (Form I-944) and Affidavit of Support Under Section 213A of the INA (Form I-864)

I'm an international student and I don't have a job here because that's not legal. How will this effect my application? My only sufficiency are my student loans and my school ends in one month

  14. Hi, I have followed the guide on this site fully, every single step. My application was rejected today because they say:

"The application/petition has not been fully completed. Based on the selection made under Part 2 Application Type or Filing Category, the form I-944 and/or Form I-864/I-864EZ are required."

I have choosen "Principal applicant" and "family based - immediate relative spouse of U.S citizen"

I have included the I-864 as stated in the guide, I don't know what is wrong. This is the third time I get my package back and two months of waiting in vain. I don't know what to do 😢

  15. 8 minutes ago, Villanelle said:

You should print out a new 485 if at all possible. If not can you at least print the last page and re-sign and re-date it? Im not 100% sure of USCIS policies about this but in general for banking stuff paperwork needs to be signed with in the last 30 days to be valid. If USCIS has a similar policy your package may be rejected again. So to be safe sign and date it again. The 1 day you would lose in having to reprint before you mail is nothing compared to the delay in having it sent back again.

All the pages are marked with barcodes so i'm not sure i can change one of the pages. It was signed the 13th of April. You don't think it will be okay?

  16. Hi! When I printed my I-485, some boxes were. not checked for some reason. (I did check all of them)

Anyways. I got my whole package back from USCIS and I have now checked the boxes that were not checked but I am wondering if it is okay to send them the same I-485, with no new signature or date written?

I want to mail my whole package again first thing in the morning.
    Thank you very much.

I know that after submitting AOS application, you don’t need to maintain F-1 status anymore. But it is advisable to do so - the reason is that if you AOS is denied, you need to leave the country immediately. However, if you have maintained your F-1 status (that also means not using your EAD to work and not traveling on AP), you can stay on your F-1. That’s what my international advisor told me. I never had any intentions to leave school but wanted to use the EAD card once I get it for part time work and my international advisor told me not to so I can maintain F1 status.

I only have about two months left of school, so my F1 status wouldn't be around very long anyways.. I will probably have to pay part of the tuition considering 1/3 or more of the quarter will have gone by before i have my NOA.

  18. 20 minutes ago, tamaara said:

I don't have a USCIS source but they are right. You would have to notify the school and they would likely terminate your F-1 on SEVIS (you don't wanna just stop taking classes). When you're ready to go back to school you'd probably have to go through the admission process again, but I guess that depends on the school. Ask before you decide anything! You would be ok staying here as long as you have the AOS NOA to show that your case is pending.

Thank you! Should i notify the school that I want to end my studies once I get the notice by email / text or should I wait until i get the physical mail?

USCIS should have recieved my package two weeks ago now, but I have not recieved a confirmation yet.

  19. 4 hours ago, NancyNguyen said:

You do what best for you, there is no requirement to maintain F1. But keep in mind if your AOS result is bad (rare if your relationship is genuine), you don't have F1 status anymore to stay.

Is this 100% certain? Is there a source from USCIS or something? I want to trust you, I'm just terribly worried that I will do something wrong.

  20. Hi everyone. I'm so thankful for this site.

I have a question, I'm in the process of AOS. I have sent USCIS the whole application according to the guide on this site. I am waiting for their response.
Right now i'm studying, and school is so much worse now that they have moved it online (teachers don't care as much, and my school is all about networking, which is no longer possible.)

The school is firm about wanting 7000 dollars for tuition even though i'm losing out on so much that the school would normally offer.
What i want to do right now is save my 7000 dollars so that me and my wife will be economically secure until my application is completed and I can get a job.

Am I allowed to drop out of school before i've gotten a decision for my AOS? (My F1 status will no longer be valid)

    Thank you.
