Just to update this topic. We applied with a Pardon and also applied with a letter of extreme hardship plus proof for my sister and I (I cant remember the form numbers) also listed in the comments that he was confused by the question and did not mean to lie. Therefore weeks later and thanks to GOD he was approved and we have received his Green Card.
