  1. Hi There,

     

    This is in regards to my I485 petition. I had to reschedule the biometrics appointment because I could not make it on time and date initially suggested by USCIS. I send back the I-797C with request to reschedule. The initial appointment was set up for 8/14/20 but I still haven't heard back with the new appointment time and date. Any suggestions on what I should do? I tried calling but it's impossible to get a human person on the phone. Thanks!

He said he had both types of submission for his clients in more than a decade long experience. Resuing whatever USCIS returned, or reprinting everything fresh.

     

    I chose to reprint everything, including copies of all proofs - financials, address, identitity etc. I only reused 'Third Party validation' documents, as they were original. It went well. It took me an entire day to print and assemble everything, but it was something I did to follow/copy the original submission package. Also don't forget to put that green letter on the top.

    Thanks for sharing your experience! I decided to reuse what they returned. I wrote a new cover letter, and attached a new I-485 with it. I left everything else as it came back in the mail. I will also use the old checks, because they were not processed.

     

    I checked the validity of all other forms in the package, and I noticed that I-765 will expire on 5/31/2020. I checked on the USCIS website for a newer version of that form, but it seems this is the most up-to-date version. I just hope now they will receive and process my new package before that date. I plan to resubmit today. Keep your fingers crossed!

    How long did you submit it? If it is not too long ago, you can just reprint the I-485 with corrected info. To be safe, check all form's version to make sure they are current version. You can reuse all the copies they returned and add more evidences if you have. Be careful next time, good luck.

    My I-485 submission was rejected because it was incomplete; I forgot to tick “’application type” on the form. I’m planning to resubmit but I’m a bit confused. I read other people’s post with similar experiences but I’m still unclear how to proceed. When I resubmit:

    1. Do I need to attach only new I-485 or do I need to reprint all the forms that were in the package, e.g. I-130, I-486, I-944, etc?
    2. If I need to reprint all the forms, do I also need to reprint all the supporting docs, including proof for bona fide marriage, image, passports, birth certificate, utility bills, etc.?  
    3. If I do not need to reprint everything, do I also need to rearrange the docs as I originally sent them, or leave them how USCIS’ reorganized them upon returning them to me?
    4. Do I need to attach new checks or the returned ones with USCIS stamps are ok?

    My spouse-sponsored I-485 submission was rejected because it was incomplete; I forgot to tick “’application type” on the form. I’m planning to resubmit but I’m a bit confused. I read other people’s post with similar experiences but I’m still unclear how to proceed. Some say to submit a new package, some I should only fill out what was wrong and resubmit the same package how it was returned. When I resubmit:

    So I kinda think its about your husbands debts and liabilities. Perhaps im wrong as well since I find this all very confusing.. For me, I do not have a SSN yet so I cannot get a credit report or anything, the only thing I can do is show them I paid my bills on time in my home country..

    I’m applying for a spouse-based green card, so I’m submitting I-130, I-130A, I-864, I-485, and I-944. At the same time, I’m filing I-765 and I-131. Do all these forms go to the same office? In other words, can all the forms be a part of one big package or are there better ways to do this? I noticed I could file some forms online, but not all of them, any thoughts on that? I was planning to send everything via regular mail, but now this question regarding one or multiple locations popped up.

     

    In addition, maybe a silly question, but... Can I print pictures as a proof of a bona fide marriage, e.g. 2 pics per page, with captions beneath each pics, or should these be printed as actual pictures on photo paper?

    Is the I-765 an immediate need? If you have another type of visa granting you permission to work, then you can file the form I-765. The response to the question 27 is related to the status you had before being married to the USC.

    Filing the Form I-765 is not necessary and it is not needed in case of marriage-based green card. It is important that you have your petition I-130 approved first. You will receive a conditional residence green card upon completion of the interview that comes after the NVC step.

    I have a question about the Form I-765. I will file for employment along with the marriage-based green card petition package. I’m struggling with the “Information About Your Eligibility Category” (27) section of the I-765. I am on F-1 visa, married to a U.S. citizen. Which letter and number from "Who May File Form I-765 section of the Form I-765 Instructions” do I list?

    I’ve used AP more times than I can count. My only complaint is when they make you go in to stamp your passport as arriving on AP. Most officers just let you through if you already have an AP stamp. You’re fine to use AP. Unless you commit a crime while out of the country don’t spend any time worrying about not being able to enter.

    I am applying for a spouse-based green card and I’m going to file for advance parole (permit to travel), too. However, I’m curios how safe is it to travel abroad on a valid advance parole? After doing some research, it seems that some don’t see any problems with traveling abroad , while some are more skeptical. For instance, I run across a website that says that if something goes wrong with my green card application, I might have problems because, after using my the advance parole, upon my return to the US, I will be treated as “arriving alien.” Another website says that traveling with a a valid advance permit does not decrease a risk that I may not be allowed to re-enter the United States upon my return. It also says that advance parole travel document doesn’t entitle one to parole into the United States—it simply allows one to travel to a US port of entry and request parole into the United States. Another risk is that the Department of Homeland Security may revoke or terminate my advance parole I’m abroad.  

     

    What are your thoughts about this? There is no emergency for me to travel, I’m simply planning to visit my family this upcoming summer.

     

    Also, how long is the wait time for the advance parole? Again, I came across different information. Some say its up to 90 days, some between 3-5 months.

    I’m filing for a spouse-based green card and I have some questions regarding some of the forms. Some of the questions might seem redundant, but since my husband (a U.S. citizen) and I are planning to file with no lawyer assistance, I want to make sure we’re doing this right. I currently reside in the U.S. Here it goes.

     

    I-130, “Petition for Alien Relative:”

    1) Is it ok to submit uncertified photocopies of our marriage certificate and birth certificates?

    2) As a proof of U.S. citizenship, multiple websites list examples of acceptable documents, such as the U.S. birth certificate, Valid U.S. passport, Naturalization Certificate, Certificate of Citizenship, and Consular Report of Birth Abroad. Should my husband submit all of these docs, or is one or two from the list enough? 

    3) Regarding our join joint bank account statements, statements for what period should we consider to submit? We have had two joint bank account for almost three years and submitting all the statements seems a lot.

    4) What are good proofs for our bona fide marriage, aside bank statements, photos, and proofs of traveling together?

    5) What is the best proof that we live together now? (We’ve been living together for two years)

     

    I-485, “Application to Register Permanent Residence or Adjust Status:”

    6) Can I use an uncertified photocopy of my foreign birth certificate and translate it on my own, or do I need to turn to a certified translator?

    7) As a proof of lawful U.S. entry and status, is it ok if I send an uncertified photocopy of my visa in my passport? 

    8) I do not have any previous interactions with law enforcement, do I still need police records testifying that I do not have any records?

    9) Do I duplicate documents that are asked for in multiple multiple forms, e.g. I-94 travel record, valid U.S. visa, passport, images, or is one of each good?  

     

    I-765, “Work Permit Application Form:” 

    10) I’m currently on my student visa (F-1). Based on my F-1 visa, I have been allowed to work on campus. Does this count towards previous work permit, i.e. do I need to count my F-1 status and submit proof of previous authorization to work in the United States? If so, how does this proof look like?

    11) Do I need to include an additional 2-inch-by-2-inch passport-style photo with I-765, or the one asked for the I-130 enough?

    Im going to apply for a spouse-based green card in late February 2020 and plan to travel internationally in mid-January 2020. I’m originally from Croatia, with a Croatian passport and F-1 visa that expires in June 2020. Would traveling to Mexico for vacation “jeopardize” or make the process of filing for a green card in late February more difficult? Would you recommend to travel a month before getting married and filing for a green card? Thank you!
