Can anyone please tell me if i can re-apply for my wife if she has a ten year penalty for overstaying in the U,S.

when i first applied for my wife i was an LPR and had filed the I130 for her.

She went throught the whole visa process n was denied, and had to fill out a hardship waiver because she had overstayed for 4 years.

I have just becme a citizen and want to get her back in the U.S and do not know what to do or where to start. If someone can please advise i will greatly appreciate it.

Do i need to file the I130 again or what.

Also i have three children

2 are u.s.c

1 British

all under the age of 5.

I am not sure if you need to apply the I130. Was it denied? You can re apply for the 601. I am aslo re applying.

I know they are working on august of 2007 but i just wanted to know how long it takes them to work in one month if anyone knows anything about it please let me know.... i can't wait for an answer. we filed on september of 2007

Hi there, I'm not going through Vienna for mine but certainly there have been approvals though it is not the easiest consulate. Check Immigrate2US site, they have a thread for people going through Vienna, including people filing for an Albanian citizen. From what I can see waits of 6 months or more are the usual.

We just filed I-601 waiver at Warsaw, Poland last week. They said it will be sent to Viena, Austria to review. Does anyone have any experiences with Viena office? Any one has a timeline of their I601 waiver being approved there?

my husband recieved packet 1(our I129 petition for husband got approved), he told me that i have to fill out for DS 156...... i looked at the form and some of the questions dont make sense..... does anyone one know if form DS 156 should be filled?

156k and form 156 are two different forms..... should i fill both of them?

Just make sure the i-134 is done if you haven't already, I think the rest is up to him, police records, etc.

I got my mail yesterday and i recieved the letter of I129 approval.... they say that the next step is sending a letter in NH, and they then they will send the forms to my husband. anyone knows how long that takes? do they send it streight to him or do they send all the forms in the Americ embassy?

I can't recall offhand but many people have their timelines filled in (I don't ) so checking them should give you an average wait time. Congratulations with your approval, I hope the next stages are fast and smooth.

K3 has not been approved - it hasn't been applied for yet. That was the I-129f petition that was approved.

Buzzkill or schmuzzkill. These are the facts. A petition has been approved. A couple more milestones need to be crossed before a visa is applied for and a couple more before it is granted. After 7 months of waiting our k3 got approved. i got an email today saying that they approved and i will be getting a letter soon. I have also filed for the I130 and it has been 10 months and still no answer. Anyway I am happy that the K3 got approved YeS~~!!!

My question is what is the next step? i know that they will send some sort of papers for my husband to fill out. Does anyone know what they are?

I would like to fill them out for him (as soon as possible). if anyone knows please let me know I will really appreciate it...... Also Does anyone know how long does it usually takes for the embasy to give the visa? (according that everything was fine and in time) I just cant wait for him to be here!!!!!! ))))))
