  1. I just did a standard cover letter. To my mind, the adjudicating officers probably have enough of a workload already, and I want to make their work easier, not more difficult.

    Ok, I'm going to try that. I think you are right about making it more complicated for the case worker. I'm freelancing after having lost my job in Feb but am also looking for full-time work so could say I want to be prepared. Did you have to show any evidence of employer getting nervous or they took your word for it?

  2. We have a child together and this is the evidence we are filing. Any ideas on whether it is enough?

    • Copies of the passport and green card of alien resident;

    • Copies of our daughter’s birth certificate,XX;

    • Two original letters written and notarized by U.S. citizen friends, attesting to our relationship and marriage;

    • Copy of joint tax returns that were filed for for 2005 and 2006;

    • Copy of joint bank statements from 2005, 2006 and 2007;

    • Copies of our joint car insurance policy.

    • Copy of the title of our car, showing joint ownership.

    • Copy of our American Express Card showing a joint account.

    • A copy of our itinerary for a vacation that we took in December 2006.

    Just wondering if you need more when you have a kid together?

  3. I didn't wait for my NOA to get the passport stamped. I made an appointment ASAP the day the check was cashed, explained to the officer why I needed the stamp (employer getting nervous about expiration dates), and left the office with a one-year I-551 stamp in my passport. Maybe that would work for you?

    Did you ask for expediated processing of the i751 in your cover letter or just did a standard cover letter and then did the info pass separately? Thanks

  5. If you're already approved for a green card, you should be able to get a passport stamp at the USCIS office, even with the removal of conditions application pending. On the other hand, if you're still waiting for adjustment of status, I suspect you may be out of luck. You'd need to apply for advance parole, and I think that takes longer than a few weeks.

    If they cash your cheque, doesn't that mean that they are planning to issue a receipt. I saw that they cashed your's within a couple of days of receiving it but took a while to issue the receipt.

    I agree with the sweating bullets. It is pretty stressful despite being in a legitimate marriage etc.

  7. I don't think they need to know this for I-751. For I-485, yes, they need to know. I entered "Visa Waiver Program" at the time, and I remember I was sweating bullets about the whole thing. If I had to do it again, I'd go for a K-1 or K-3 rather than sweating an AOS from a non-immigrant waived visa...

    Thanks for this. We used an immigration lawyer who said don't worry about the financee visa. My problem is that we have to go Mexico - my husband is in the wedding party - on Memorial day weekend...So I am rushing to and seeing if they'll take pity on me and give me a receipt asap. Otherwise I'm stuck here with our kid.
