    Remember your visa hasn't been issued and it's not approved until it is issued.
     

    If they issue you the visa before your medical expires, then you should travel before the medical expiry. In fact the visa expiry date could match the medical expiry date.

     

    If the AP stays beyond your medical expiry, then whenever they plan to issue you the visa or ask additional questions or do further processing, they will tell you to re do the medical. The reason they don't tell you to redo the medical before your current medical expires is because they don't when they will issue you the visa or not issue the visa. 

     

    Okay lol I think you're right, I was overthinking it. I get it now. Thank you for explaining it more clearly!

    looks like you are confused. There will never be such scenarios. If a k1 visa is already issued and the person isn't traveling to US before the medical expires, even if the person redoes the medical before the current medical expires, the visa will still be invalid. They have to redo the visa even if they do the medical before current medical expires.

     

     

    Sorry yeah I'm very confused. From what I understood, the K1 Visa usually inherits the expiration date of the medical documents. So for example, let's say the k1 visa typically has 6 months before it expires. So if I get my medical exam done 15 days before I have my k1 visa interview, assuming my visa is issued immediately after the interview, I would then only have 5 and a half months to enter the US before my visa expires.

    I'm sorry, this is a little bit confusing. You're saying that you can't help it if the visa expires? Even if you get another medical done before the visa is issued, the visa is still invalid? I don't understand why that is. Is your point that, since the visa has already been issued, that means that there is no longer any action that would be taken on it by the consulate, and therefore, since there is no longer action that is going to be taken on it, any medical exam done after the visa is issued would not effect the visa at all? You're saying that the reason getting another medical after the visa is issued will not help is because it has already been issued?

     

    Then how come they don't inform you about getting another exam done until after your medical expires? You're saying there's a point before they issue the visa, but after the medical expires that I can expect them to reach out to me about getting another medical exam?

     

    I'm sorry, I'm just trying to understand this, please bear with me.

    Okay, I plan to wait for them to reach out to me but I want to know if they're typically reliable about informing people to get another medical exam done before the first one expires. Have there been cases where they didn't inform people and the applicants lost their k1 visa and had to redo it? Do you think it's a good idea to reach out to the consulate to remind them a few weeks before the medical expires?

    So can I actually rely on the consulate to contact me about scheduling another medical exam before the initial one expires or am I going to have to be more proactive about reaching out to them to ask about getting another medical exam done? For some reason, I feel like it wouldn't be beyond the consulate (in Kenya anyway) to just totally not say anything to us before the medical/visa expires considering our case is still undergoing AP and will likely be in AP beyond the medical's expiration date.

I'm trying to find information from people who have experienced the POE process and while I have been anchored to find some info, I haven't really found nearly as much info on POE than the interview, AOS, among the other steps in the process and it's beginning to make me wonder if this means people find out the POE experience turns out to not be so bad after all? Is this the case, or is it still something to worry about?

    Is that always the case though? I'm pretty sure our background checks are clean so I can't really see why it's still taking so long. It's been a little over 3 months now. 

     

    If our background checks weren't clean, wouldn't they have already gotten back to us and told us the problem/denied us already? No point in keeping our case in limbo.

Our k1 has been in "refused" status for about 3 months now, and despite sending several emails to the consulate inquiring about the status of the case, we can't seem to get a very comprehensive answer out of them beyond "your case is still undergoing administrative processing and you will be contacted once an officer has reviewed your case." 

     

    I'm just wondering how long others have had to wait with the status of "refused". After full ING done research, out seems that refused is not the same as denied, but it just means that our case is in administrative processing. 

     

    How long have other people been on the "refused" status?

    Have you guy gotten any updates? It's been over 90 days since our case went into AP and they're still telling us that our case is processing.

    So, since the hold up is because of the consulate taking too long to process our case, does that mean that they're not going to issue our visa until my fiancee takes another medical exam?

  10. So it's my understanding that certain documents that we would need to bring to the POE such as medical documents are supposed to be no older than 6 months. So since our visa is processing still (it's "approved" but it's in administrative processing) and it looks like the medical documents are going to reach that 6 month mark soon, what should we do? Should I have my fiancee go to another medical exam when our visa is finally in hand?

    I would not get married nor have a party. Don't risk your Visa. I was in AP for 18 months for God knows why, so don't risk anything.

    I actually don't know. I mean, they said that her visa was approved at her interview, and they even gave her a letter saying it was approved as well. Then a week later we received the email saying they would hold her visas for a minimum of 90 days and possibly longer.

    What if I cancelled the Islamic wedding and just had the party? Since it's going to be difficult to cancel the venue  and some family has already purchased plane tickets, maybe it would be fine with the embassy if we simply had a party and the party would just be to celebrate the eventual marriage in the US. The Islamic ceremony is a different event and can just be cancelled altogether since there were no deposits made for that event. Do you think that would be fine?

  13. My fiancee and I are both Muslim and would be doing an Islamic marriage ceremony. It seems to me that since the religious ceremony isn't recognized officially in either the US or my fiancee's country, it would be fine and shouldn't impact the k1 visa since it's not officially on record. I've come across articles and forums where some people say it's fine, while others say bit's not. The wedding hasn't happened yet and the thing is that she has already done her visa interview and they approved her visa. However, they haven't sent her passport back yet because they're doing administrative processing, which could take 90 days or more. So we figured we'd just have a religious ceremony in her country, and then we'll get officially married once her visa is approved.

    Lol it's funny how similar you guys'stories are to ours. We also were excited and told our families, but soon after, we received that email. But I was telling my fiancee that I thought it might not have been a total denial.

     

    But I will say one thing: the fact that so many people apparently have/had this same problem is a little comforting. It let's me know that we didn't do anything wrong.

    Yeah that sounds really similar to our case. We're still waiting. Although I did notice something interesting about the status. It seems to update every few days. So even if it's still saying"refused", it shows that the embassy is at least actively updating it (I think. Not entire sure though.)

    Wow yah that's basically exactly what happened with us down to a T except the email they sent us didn't explicitly say ours was refused, just the case status checker. And yeah, we haven't heard anything back yet either but it's only been maybe 4 or 5 business days. It did say that administrative processing usually takes up to 90 days, but I'm hoping it doesn't take that long for us.

  17. About a week and a half ago, we went to our k1 visa interview after having gone through the process for over a year and a half. At the interview, they gave us approval and even gave us a letter stating our approval and what the next steps would be. I left my passport with the consulate because they needed to do further processing, and they said to expect it back in about a week. Today we checked the case status online and it said: "refused". In the subtext, it said that our case would remain refused while undergoing administrative processing.

    Does this mean that our visa has been refused, or is this more of a placeholder while they process our visa? Is this a common thing to happen with people who have had their k1 visas approved?

  18. Another question that I have and would appreciate a quick answer. How important is a tax transcript for the I 134 affidavit of support? If I already have the w2 to include with it, along with the bank statements from the past year, is it really that important to include the tax transcript? 

     

    Will our case really be denied because we didn't include a tax transcript? 

  19. I am going to be doing the K1 interview on Tuesday and I'm starting to get a little worried. I am working on he I134 form and I will need a joint sponsor. Between my fiancee sponsoring me and my joint sponsor, they have more than enough to meet the income requirements. However, I am becoming a little nervous as I do not feel confident that I can explain to the officers the financial situation even if I do provide the requested paperwork like w2 and paystubs, etc. How concerned should I be and is it highly likely I'll get a denial or is it not as bad as it seems? At this point I feel we've basically done all we can to prepare for the interview.

    No, I am the petitioner for my fiancee. I guess normally the account would be for beneficiaries, but since my faincee is not very tech savvy, I'm using the account to ask questions lol.

     

    But okay, I think I got what you're saying. So basically since the joint sponsor isn't petitioning my fiancee, they leave questions 26a-27 blank?  Do you think perhaps they should put a note clarifying that I submitted a petition for my fiancee and that's why those questions are blank?
