  1. My fiancee arrived safely and everything is great. She is still having probs with the different time zones and falls asleep at odd times. I tried to get her to try American food twice and decided to not do it again for awhile. She definately likes the super Wal-marts and well stocked shelfs. She learned quckly to yell out "yeehaw" when the mood strikes.

    It has been a hell of a journey.

  2. Trang went to the embassy to take the timeline and list of relatives they asked for today. After she give she said they did not ask any questions really except small talk and then asked her when she can go to America and then handed her the pink paper with a date of Jan 12 to come back to get her visa. I am a bit stunned and extremely happy. She is so excited that she can hardly think straight. We will get together later after she gets some sleep (I know she has slept little for weeks) and then tell me more what happen and I wll soon relay it here for all.

    Again many thanks to all the help everyone has given me. I especially want to thank all that prayed for me. It is awesome so many sent prayers.

  3. I found out they want the details of how my friend and my fiancee's brother met and how they set us up. Before my friend told me they met over 10 years ago at a birthday party in las vegas. Durning the interview when they asked Tran specifics she did not know she had to call her brother and ask. Last night I pressured my friend into telling me the trueth and he told me they were gambling buddies. I know gambling is legal but I think it would hurt our case even if they have other stuff in common.

    I was told to marry and not to cancel the denied visa even if it expires however I was also told you had to cancel it to start a new visa because if you have 2 in the system it will cause a problem so im not sure how that works.

    Even if you have to cancel that petition it still on their system, they have record and they will check it when you refile petition. IF USCIS send you notice to let you know it expires you can refile petition, but if they send notice that your case is being review you should rebut what Consulate denied your visa. The old petition will get touch each time USCIS work on new petition.

    Does your fiance know him?

    What will you do if you arrive in US?

    Where will you celebrate for wedding?

    Where will you go for honey moon?

    Why dont you and your fiance get married in VN?

    When will you want to move to US?

    Interviewer smile when he asked my fiancee this question. She thought he would give her pink paper after she answered: When you give me a visa. BUt he still keep asking ....

    How do you communicate with your fiance?

    Show me his phone bills, pics

    Then he gave my fiancee blue paper which request some more information about her relative in US and timeline.

    I'm old member on this site since 2006, at that time we got too much trouble with our case so I came here to ask everybody about case was sent back and I have got some advises from here that was really helpful. Especially someone who was on the same boat as mine here like: DAve- Thao, MArtindat .......... We finally find out the light at the end of the tunnel.

  6. Contact M.E. to have a meeting with Consulate Officer in HCMC. Will cost you a fee, but he may or may-not stop the return of your case to USCIS. It's worth a try! M.E. is a lawyer who is working in HCMC, he's been very helpful and instrumental to a lot of VJers in the past. Search for his number on this board.

    Thanks, I know all about M.E. - Mixed reviews and results. I may have a line with a congressman in NJ. Will know in a day or two.

    HI RAlphandHanh, Sorry to heard about your case, I know how much painful from case being sent back to US. I was on that trouble in 2006. You can refile K1 or can do get married and do K3 visa but you should fight for old petition too.

    Before i failed in fiance visa and my case have been sent back to uscis by vietnam embassy .

    So now My fiance have plan to get married with me in vietnam ? But he dont know what documents Indispensable . And how long will take to get paper certify our married since we register in where im living (vungtau city-vietnam) .Because my fiance only can stay here 1 month,and he dont want wast time for waiting . We want get ready everything until he visit here .

    You should get engagement party as soon as possible and then submit all of that pics with explanation on back side of each picture to US Consulate. My friend had had problem like yours and they received visa after 4 months since they submitted engagement pics.

    I would think twice about doing an FOIA. I filed an FOIA to view the consular notes and it would have taken 12-18 months to complete. CSC could not look at my case until the FOIA was finished. I ended up canceling the request. Then csc found my case and told me it was expired.

    I still not hear my case is expired by CSC, only hear that from my Senator. What can we do If paper was expired ? Will you refile K1 again, Dave?

  10. Thanks for all the advice so far. I called today, and the lady on the phone said I can't make an appointment until I'm in Viet Nam. Would it be advantageous for me to send them an e-mail still? She didn't ask me for my name or anything. I think sending them an e-mail, even though I know the answer, may be helpful since there is at least a written document showing my request for a meeting with the Chief of Information Unit. Any thoughts?

    Hi everyone,

    If someone have plan to make appointment with the Chief of Information Unit, they can learn something form my experience about that. When my fiancee' received blue paper I had plan to go to talk with Chief of Information Unit, I tried to call them many times but could not connect. SO I went to their office for asking , the VNese officer at the window told me that I should write a letter to request for meeting the Chief of Information Unit. So you know what happen later? After they received my letter they called me back by cell phone and told me that they have no time for me and they will review my case later, that's all. So even if you are in VN you also have no chance to talk to them. BUt Please try to do as what you think it will help. Good luck

    My case also was sent back to CSC while I filed my case in TSC, I also wonder why it been to CSC for futher review in stead of in TSC. And they have nothing for reviewing because all of our documents was sent back to my fiancee from US Consulate in HCM city when they decided to send my case back to US. LAst month CSC sent notice I-797 to me and told me that my case is being review but my senator told me that my case is expired. I don't know what happen and think why USCIS don't give someone a chance to rebut as what they say??? Do they tell lie??? Can I request to extend my case???

    MArtin, how long did you receive notice from USCIS ask you to submit proof for review since your case sent back to US? Did they give you another number for review? I confused from what USCIs do.

  12. Ok, I have been asked to start this topic here in this forum. Including myself (K1), there are many of us going through several consulates whose petitions have been sent back to the United States for review.

    We need a central place to discuss this issue and help each other out...posts in other forums keeping dropping off.

    I am hoping this topic will be "pinned" as it is a very serious issue that many of us are dealing with right now. I refuse to let this topic die! So, if this topic touches you personally as it does me...post here. If this topic interests you because you may face it going through Morocco or other consulates...post here.

    My Story:

    Like the story of so many others recently, I really thought we were denied when my fiance received this 221g...apparently this is a "soft" denial, not a "hard" denial. Our K1 petition was sent back to the United States for further review of the validity of relationship...basically the consular officer was not satisfied during my fiance's interview even though she refused to take ALL of our evidence into account to make a fair assessment.

    I and my Senator fought and fought to get the consulate to look at all of our evidence of a valid relationship BEFORE they sent it back to the US and it did not work...all efforts here were fruitless.

    The petition is being sent back and we have to wait for the USCIS to make a decision in our case. It will be about 6 months before I hear anything from the USCIS. This however does not mean I will sit still during this time...oh no, no, no. The USCIS office who initially processed AND approved my petition is receiving all of our proof that the consular officer refused to look at during the interview as well as proof of our ongoing relationship before they make that decision.

    Myself among others in the ME/NA forum have done extensive research in this area in attempt to help ourselves figure out WTH is going on with our petitions and how to fight this in the United States before actually being denied by the USCIS.

    You have the right attitude, NEVER GIVE UP, Sorry to say you will have a longer wait then 6 months. Our petition was sent back to the service center that approved it was on September 2005, her interview was July 19, 2005 The petition will sit at the consulate until they decide to send it back to the NVC where it will sit until they send it to USCIS service center. The petition will sit there until they, USCIS, sends you a notice where you now have the opportunity to rebut the CO findings. If all goes well, USCIS will send you a letter that they have REAFFIRRMED the petition. USCIS will send it the Consulate (I think it goes back to NVC first) then on to the consulate, where it will sit until they schedule you a new interview date. We got blue sheeted again! At the second interview, where we waited about three more months… then, we finally got the K-1 visa last week.

    Some of you may think to file a new K-1 or a new K-3 remember, "you are in the system" the results of your initial petition could haunt the new petition. Then all that time and money will have been wasted. I chose to stay the course and overturn the CO findings and get a reaffirmed petition. Remember, you can be blue sheeted again or green sheeted too or both (we were at the first interview) then blue sheeted at the second interview. Should your petition go to AR Admisistrative Review, then it can be up to one year before the CO can get to your petition. Should the CO not have the time to review your petition they can cancel your petition entirly. Then you have to start all over again… “this is very rare.”

    I hope this information gave you some insight. again, this is my experence. I hope the process goes much faster for you folks who have had your petitions sent back.

    Thankyou for your sharing. I also have problem with my paper which was returned to USCIS last year. Last month they sent letter to me and said that my paper is being reviewed, they will notify me of any action they take on my case. I don't know how to do now. I'm looking for a lawyer who can help me to solve my problem, Could you recommend me to your lawyer?

    I'm new on this site , I wish I could know this site before.

The consular ignored all the emails,phone records and other evidence of communication I had in my document package. I don't know what to do next or what to expect.
