Hey, some people are not that good at dealing with immigration stuff. That's why they pay someone to do it for them. It doesn't mean they're not engaged with their process. He trusted his lawer, that's all. If he's searching for information on this site that means something I guess! He cares about his process. And also, he came here looking for advice instead of being judged.

To answer your question: Ask your lawyer for your Notice of action 1. You can find your service center on thw lower left side. Each service center has different processing times that can be checked at USCIS website. Nebraska is pretty slow, my friend's case took a year to get approved. You can also check your case status with the receipt number on the same website. The receipt number is also found in your Notice of action 1. Good luck!

Thank you so much for that !

Because people are willing to pay others to do what they can do themselves. That's how a service industry works.

I have to agree that something is out of the norm here. You should have heard back on the petition a while ago...there is a real concern that there was either an RFE or approval issued that has now expired.

Maybe not....some cases are taking a while...but you need to be on top of this. Get the receipt number. Track it online. Call USCIS.

Thanks I will do that !  Appreciate all the advice

Lawyers are in business because immigration law can be tricky and fact dependent. There is much more to immigration law than K-1 flings.

That doesn’t mean you give up making sure the USCIS doesn’t have your correct address and that you don’t check in on your case stats yourself.

How engaged in this process are you? How sure are you that your lawyer didn’t  miss something?

Very engaged.  I just spoke to him.  We are talking again on Monday morning.  It’s very possible that he could have. He specializes in immigration.  I will find out

Exactly.  I am on it. And I’m waiting on getting a copy of the receipt from the attorney on Monday.  He’s probably trying to get more money out of me.  Smh

Even the USCIS website says that if you filed a petition prior to March 2019, there might be a problem and you should get in contact with them.

Again my attorney deals with K1 everyday all day, and he advised me of the delays I said. And it’s highly unlikely that it’s sitting over in bogota and expired.

No, that is not normal.  There is something wrong.  Recent petition approval wait times are even faster than last year, with many being approved less than 4 months.  Have you really let it get to over a year before looking into it?

Of course. I was told 6-8 months.  After the 8 I called and was told delays he’s seeing cases up to a year. I call him bi weekly.

Which means what exactly?  Why wouldn’t they contact my attorney? Makes no sense

Dude.  You need to own your process.  No attorney can be paid enough to care about it the way you should.

Thanks for that. I plan on doing just that

I don't care if you used an,attorney,   you never received a case number?

No.  He said I would have gotten a letter from UCSIS with it.  I just recently asked him for a copy

And I moved the exact time the letter was mailed

If you don't do a proper change of address how are they supposed to get in contact with you, via the attorney, or by magic? Personally, I would bet on magic first. Check out this USCIS link:

Welcome to the party. :yes:You win the prize if you think that adjudication times have become extended due to a myriad of issues at the Department of Homeland (In)Security, The prez has ordered ICE and CBP to round up folks by the score, from the undocumented coming over the southern border to illegal egg-farm workers in places like Minnesota, it is called "enhanced enforcement." Additionally, there is an over one (1) million case backlog in cases pending in the immigration court system. Oh and finally, the workload at USCIS has also exponentially increased, resulting in USCIS shifting workloads and files all over the country. So, in a word, USCIS needs :help:

That’s why I have an attorney,  so they can get in touch with him if they can’t reach me.  I’m looking for average wait times now nothing more

  10. Hello all

i filed a K-1 visa for my fiancé who lives in bogota Colombia in August of 2018.  I live in America.  Have the wait times been extended because of the immigration issues? We are still waiting and I have an attorney who sent it and filed it.  Also I moved last October and forgot to update my address, do you think that has something to do with it ?

    Thanks
