  1. Why is it people get two visas then? It make no sense to me hehe. Also other have both interviews close together, some may enter us on k3 then return to home country for CR1 interview. There are a few people here who already have both, confused why you say that?

    I think the only explanation I can think of for this is if the interview appointments are far away from one another. If you are in a hurry to be together, the best way is to pursue K3, otherwise, take the CR. I think others got 2 visas (I'm not sure about this) because the interview appointments of their K3 and CR are far from each other... Someone correct me if I'm wrong...

    Mae is correct, if one is in a hurry to be together, beneficiary can interview for K3, fly to the US (K3 expires once used at POE), wait out the CR-1 and come back for interview. Beneficiary ends up holding just one "valid" visa if CR-1 visa is granted as K3 expired upon POE. This supports the statement that she cannot be issued two visas at any one time. One has to be cancelled or expired before new visa is issued.

    It's the same thing with having a tourist visa. My B1-B2 was cancelled as soon as I appeared for my K1 interview as I cannot hold two valid visas at the same time.

    the k-3 is a multiple entry visa valid for two years. i would think if you fly back to the Philippines for CR-1 interview, the K- would be cancelled when you go to the CR-1 interview.

    Well, i was not plan on flying to US because CR1 interview is only 2 weeks after K3 interview. I really just think that the embassy will know I have 2 interviews if I dont mention it to them? I would think they would go ahead with both then. But it make me nervous because the interview is this wednesday. I still not sure what to do.

    Who do i request for cr1 instead of k3? the CO or the pre screeners?

    is it common the embassy grants the request for these or denies them? interview is wednesday so getting really nervous.

    You cannot be issued two visas. Appear for K3 interview and request if you can interview for CR-1 instead as it is the superior visa. Embassy can either grant your request or tell you to appear again for CR-1 interview.

  5. Screw the K-3, it has horrible consequences....CR-1 all the way now that you are approved for it. He/She can get a job right away and you dont have to deal with immigration for two years.

    I am doing both if the K-3 makes it first will go with it cause he can come up sooner. Then when the CR-1 gets approved we will go visit family and go for the next interview in Kingston its only a 3 1/2hour flight so we will be all good and we will not have to deal with things for 2 years also :)!

    Our K3 is only 2 weeks prior to our CR1 interview. Can we go to both and get both so close together? We dont want to decline the K3, but want to enter on CR1.

  6. We so glad to find this topic! Our K3 and CR1 interviews are only 2 week apart here in Manila. The K3 is first then CR1 two weeks later. We can attend and get BOTH visas ok and they dont mind? We just will not tell them that we have 2 interviews or should we? How does this work? We are so worried what to do at the first K3 interview because we dont want to turn down either visa, please help! Thank you!

    Anyway, my thoughts were I'd rather have the IR-1/CR-1 (like everyone else), so if we can get this processed reasonably close to the same amount of time as the K3 (within a month or so), we'd just go for the IR-1/CR-1. So the only way to really know, I figured, is to pursue them both at the same time. But here's my question...if I start going through all the process for the I-130 at the NVC and my K3 makes it to the US Embassy in Ukraine where my wife lives and we decide to just go for the K3 due to a big time difference between the K3 and IR-1/CR-1...what happens to the I-130 etc. at the NVC? Since there's a considerable amount of work and fees done there, I'd like to not abandon all that process and file Adjustment of Status once she gets to the USA. Is there any way to get the K3 visa so she can get to the USA, and then keep processing that I-130?

    I've seen plenty of info on here about pursuing the K3 or the IR-1/CR-1...but I'm really confused when it comes to pursuing both. Any input?

    If the I-130 continues through NVC with the application for a visa (DS-230) and I-1864 etc., and your spouse interviews for and enters on the K-3. She will have two options.

    1) Adjust status in the US from the K-3

    2) Return to the consulate/embassy for the immigrant visa. Once granted she will reenter the US and be granted permanent residency. If married under two years on entry the green card comes with conditions which must be applied for to be removed 90 days prior to the two year anniversary of her entry into the US on the immigrant visa, or if married more than two years on entry, she will be granted permanent residency with no conditions. (often have to draw attention to the more than two year marriage to be granted the correct status)

    Ok. That finally makes sense to me. So if I do manage to get my I-130 to the NVC, get it approved, and get it to the US Embassy before her K3 interview we can hopefully change it to an IR-1/CR-1 interview instead. If the I-130 is taking a really long time, we'll just adjust status in the US from the K-3 since we want to minimize our time apart. Now what if she gets her K3, but the I-130 arrives shortly therafter? Is it possible for us then to interview again and get an IR-1/CR-1 even though she just got her K3?

    Yes, but you will have to look at the time it takes for an interview to be scheduled at the consulate for the immigrant visa. Your spouse can either wait for the immigrant visa interview by not activating the K-3, or she can enter the US on the K-3 and then return to the consulate when the interview date comes around. Many have done this and it is an official option. You may like to look at the times it is taking to complete the adjustment of status process at the Office you would be required to go through. Some Offices are taking up to 2-3 years. In these cases, depending on your circumstances, it can be beneficial to return for the immigrant visa. Obviously financial situation figures into things as well, as a trip back to the consulate adds extra $$$$$

  7. Substitue "DS" where you read "OF" and it will all make sense.

    Just fill out the forms they've asked you to.. those are old versions, but some posts still use them.

    You may have already sent some of this to the NVC.

    ok thanks! it say status Y for them, indicates Yes\Document Complete\reviewed. I am think that we do not need them to take because they already have is this true? The OF-169 is look like only document list not a fillable form? I am think we have nothing to fill out.
