    I'm an April 2017 filer for I-751 ROC. Earlier this month, I filed my taxes as "married but filing separately"  while trying to buy a house this month. This was based on the knowledge that my wife was having some identity theft issue. Later in the month, I received an RFE that required my wife and I to provide 2016 & 2017 tax documents. Based on the advice of others on here on this forum and other knowledgeable people, I came to a conclusion that jointly filing with my wife will be the best way to go. Together with my wife, we were able to get past the "identity theft issue". Both of us have not been filing taxes for the past three years. So, I have just amended my taxes for the years 2016 and 2017. I was told by the CPA tax consultant it will take about 3 months for the amendment to be processed and take effect on the IRS system. 

     

    I have to send a response back to USCIS no later than the first week of November - less than 3 months from now.

    You can send the copy of what you sent to IRS to USCIS. For easiness, we usually prefer to send IRS tax return script from IRS system, but it is o.k. to send the copy of Federal/state tax return what you sent for IRS.  So you don't have to wait 3 months.

    The I-551 stamp extends the green card another year.

    Also, you have option to file N400, so don't have to worry about green card renewal forever. 

    I-551 stamp on passport + N400 filing. 

    Probably IO from N400 may review both I-751 and N400 at the same time.

It's a relief to know they definitely insure new immigrants.........I looked into some other "new immigrant" medical insurance for just myself but they all looked kind of dodgey, my fiance and I are much happier to go with a big reputable place like BC/BS.........thanks again! :)

    Make sure that you checked maternity condition.

    Some medical insurance policy may have the condition, which not allow the coverage for maternity situation for some period such as 6 months from joining date.

    You can double-check with your employer's medical insurance plan.

    Sometimes they have 30, or 60 days enrollment if there is big life-time event such as marriage/divorce.

    Joining from oversea as a part of immigration may be qualify for that one.

    Ask supervisor or HR supervisor if you need help.

  5. my fiance got packet 3 about 5 days after the date it was sent out and we are still working on it...i am wondering what is the time limit in which to complete and return the packet to the embassy?

    But in theory, you have 1 year, I believe.

    If US Embassy doesn't receive anything from beneficiary/petitioner for 12 months, they will close the case with administrative denial.

    But in reality, you have to follow up sooner because some of documents you sent may be expired if you delay a lot.

    Usually it won't take that long to prepare for listed items. No more than 2~3 months. :whistle:

  6. Hi VJ-ers!

    So, I'm finally ready to submit my I-864 and I had some last minute questions I wanted to get some feedback on.

    I'm submitting my I-864. I've had a job since June, and my annual salary is 27,000 (Above the poverty-limit for two people).

    I only made 1,500 for last year (2008) and I did not file taxes. In 2007, I did not work and did not file taxes. In 2006, I made under $60 and was still being claimed as a dependent on my mom's taxes (I was a student during all these years).

    My question is: What tax stuff do I need to submit. I have W2s for 2008 and 2006, and I have a copy of my mom's 1040 for 2006, but do I need to submit any of it? Should I submit letters for each of these years stating why I did not file taxes? Maybe only for 2008?

    Also, what would I check on question 25 on page 4 of the application?

    Since I've only been working for the past two months, the only things I have to include would be all my pay stubs, as well as a letter from my employer stating my salary and start date.

    What do you guys think about my chances of not getting a RFE/getting my I-864 approved? What sort of tax stuff do you guys think I should submit and for how many years back?

    If you can get joint sponsor, it will be much better.

    But if you can not get it, you can try this.

    1) Write the cover letter why you didn't file the tax returns and recently got the job, so ask them to use your current year income for I-864 purpose

    2) fill out F-4506T with selection of "7", proof of not filing tax return. You should get the letter from IRS that you didn't file the tax return for those years.

    3) Have the school record for your attendance such as the copy of your classes attended and GPA

    4) Include your mom's tax return, which has you as dependent listed

    5) Employment verification letter from your current employer

    6) Copy of Pay Stuffs

    7) Copy of your bank account books and other assets you might have.

    If it's not working with above information, then you can ask your mom or somebody for I-864A.

    But remember that the condition for becoming I-864A is strict, too.

    I'm hoping someone can help me figure this out.

    My husband and I had been waiting for an approval from USCIS for a year and a half (it finally came through this month!). During this time span my husband was accepted to a university in Perth, Australia where he is now residing. However, the original embassy we requested was Riyadh, Saudi Arabia. My question is - does anyone have experience with requesting a change of embassy for the interview or will he have to fly back to Riyadh for the interview? It would be an inconvenience for his studies and a drain on our funds for him to have to fly back to Saudi, then back to Australia, then after his semester back to the USA!

    Any suggestions? Experiences? Advice?

    Does he have the appointment scheduled from Riyadh, Saudi Arabia ?

    If I were you, I would like to keep Riyadh, Saudi Arabia because it is easy for them to keep everything in track.

    But if you really want to change, you have to contact NVC via mail or email to request the change of Embassy.

    But you should be aware that it may delay the process a lot because of paperwork/case transfer, and also cause mail-in-lost, and lack of information for interview because it is not his home country.

    Also new Embassy may require a lot more information because they could not get it from local.

    So it is up to you, but it may cause a lot of trouble.

    If you can bear some trouble for his current residing country, you can contact NVC for the change request.

  8. Has anyone had the experience with DHL of having your package delayed along the way? NVC sent our package on July 24th, and it has been in Miami with no status updates since July 25th AM. The majority of the cases sent out by NVC on the same day as ours have already been delivered to their respective embassies. I am getting concerned that our case is lost somewhere in Miami. Do I need to call someone? I have already verified that the case was sent out from NVC, and I have a DHL tracking number, but since I am not the sender, I don't think they will tell me anything. Thanks for any advice.

    If the US Embassy have contact info, you can contact them to verify whether they received it or not.

    Sometimes DHL may forgot to scan the item or the problem with tracking system error.

    You can call the airline and ask for their in-flight magazine.

    It should have most info you need to know.

    How to fill out immigration forms and customs declaration form... :whistle:

    Don't try to raise your hands during take-off/landing, and saying loudly, "Talleban!".

    It's one of jokes for answers of the question, "what should I do for my first flight experience?".

    Others including... but not limited to... :devil:

    - Stand up while taxing off...

    - Pay $10 for every meal you get during the flight

    - Give TIP for flight attendant, $1 per every requests.

    - Every blanket/pillow is the rental, so you should pay $5 for each.

    - Ask for shower room before landing

    How long does it take to receive the coveted social security cards? The social security number is the key that unlocks so many doors,

    such as a marriage license and driver license, just to name two.

    Text book answer will be up to 4 weeks.

    In reality, they should receive Social Security Card in 2 weeks if everything works o.k.

    But sometimes marking "yes" for request SSN from DS-156 or DS-230 form doesn't work.

    So they may have to visit Social Security Admin office to request it by themself.

    In that case, it will take up to 10 days for mail delivery if there is no issues.

    If there is any issue such as wrong data entered in computer system or something like that, it may take forever.

    Marking Social security issue request in DS-156 form works sometimes, but sometimes it's not.

    As long as you use same information from DS-156 form, Social Security Admin office will figure out.

    It usually takes up to 10 days for mail delivery for Social Security Card.

    For Driver License, it is up to local DMV.

    But in most case, they check immigration status and expiry date.

    If he is K1, I wouldn't recommend for Driver License since it is only valid for 90 days from entry date.

    DMV will issue the Driver License with whatever expiry date in his immigration paperwork.

    Probably it's time to learn English by studying "Driver's manual", which can be picked up from local DMV. :innocent:

    And spend some time from local public library to learn English and others.

    Putting in ESL class? :devil:

    Actually I spent 6 months from local "free" ESL class when I came in to enjoy my free time.

    *P.S. Also, please remember to take photos, and other evidences for proving bona-fide marriage since he will get 2-year green card, and you need bona-fide marriage proofs for I-751.

  12. Did you call the Airline and ask for one-way ticket for immigration ?

    Sometimes they have special discount for immigration rate if you have immigration visa in handy.

    For the question of buying round-trip ticket, and not using return ticket...

    PoE doesn't care about it.

    Normally it shouldn't be a issue except travel agent you bought it from.

    There was a couple of discussion I remembered from the past.

    It may be applied to only few airlines, but some airlines will give penalty for travel agent, who sold round-trip ticket but return ticket wasn't used.

    But it may not be your business for most people.

    If I were you, I will call the airline to check one-way discounted ticket availability for immigration visa holder.

  13. So I am super ready to go back to USA now after a 9month long vacation.

    My inquiry are: First, am I going to have problems entering the USA again after the long absense? I am a 2yr GC holder which will expire July 2010. The reason I stayed out of the USA this long is because 1. My husband was deployed in Iraq and we decided for me to just to stay at my home country because: 2. I was pregnant also by then. Unfortunately, I had miscarriage.

    Second, am I allowed to bring lots of good, ei: lotions, soaps, etc.? Like a box of them, on my lugagge?

    It depends on USCIS CBP officer at PoE.

    According to the law, it may be o.k. up to 1 years absent from U.S.

    But if USCIS CBP officer suspect that you are not living in the U.S. for residence purpose, they can kick you out.

    It is solely discretion of USCIS CBP officer.

    So if I were you, I would prepare for all documentation including your husband deployment order and letter from your husband to allow you for staying with your family.

    For customs declaration, it is subject to US Customs regulation.

    So if it is normal use for tourist, it shouldn't be a big problem.

    But the amount of luggage will also be subjective per airline.

    If you carry too much, airline may charge excess luggage fee based on the weight, and the number of luggage.

    Also, it may raise the red flag for US customs to inspect your luggage more thorough.

  14. I have a question. I know another woman who is planning on having her Nigerian SO get a visitors visa and then "marry as soon as the plane lands" and try to adjust status. There is a 20 year difference between their ages. What do you think the chances of success are . I told her I thought it was a very bad idea.

    It is what we called, "immigration fraud".

    Visitor visa is supposed to use only for visiting purpose.

    If somebody comes into U.S with visitor visa for intention of marriage/staying in the U.S., he/she lies to immigration officer at PoE.

    That's big deal in U.S. legal system.

    It will catch the red flag for every case they deal with USCIS.

    If they pass one hurdle, that doesn't mean they will be safe.

    It will bite them at any time.

  15. Why in the heck do they need to verify Birth Certificate ?

    If you show foreign government passport, and US immigration paperwork such as Green Card, don't they have enough verification ?

    Usually passport identification page have DOB, name, and nationality with nice photo.

    For native-born US citizen, they use birth certificate for verification if they don't have US passport or others.

    But it seems weird to ask for birth certificate for foreign nationality. :innocent:

  16. Am I correct that the DS-156 and DS-156K are to be filled out by my fiance in her country after the US Embassy contacts her with her list of 'to-do's'? Then My fiance will attach the required evidence to these forms?

    Yes, usually it will be hand-out to receiptionist when your fiancee goes to interview.

  17. My fiancee is going for her interview in just a couple days. In the past she indicated she would be arriving in the US at LAX. However, now I am finding a better price on airfare with a flight landing in Chicago. I am going to call the embassy, but was wondering if anyone else had this issue...

    US Embassy doesn't care about PoE.

    But you want to make sure that your fiancee arrives in close PoE for your home.

    It may take from 10 min to a couple of hours for PoE interview.

    Also if you want to reduce the risk for mail-in-lost, that's another reason to pick up closest PoE.

    If your fiancee comes to PoE different from USCIS local district office, which has jurisdiction based on your residence, it may take a while for forwarding the case for USCIS local district office for final processing, and it may be lost.

    If it may take more expensive, it's better to buy the ticket for direct flight to closest airport from your residence.

  18. If it is IR-1, it should be much better.

    But if it is CR-1/CR-2, you have to add additional cost for I-751 lifting the condition after 2 years, which will add additional cost and efforts to deal with USCIS again.

    Also if your wife needs to go through N400, add another cost/effort.

    Otherwise they needs to renew it every 10 years, which will be additional cost, too.

    I wish USCIS have life-time membership, which can work for him/her and immediate family to save the cost by paying one-time cost for any future USCIS petition, and no more fee forever.

    Not sure if anyone has tracked the costs on the CR-1/IR-1 process

    1.wait until he will be deported.

    When he is caught, it will be deportation with probably life banning to U.S. because of marriage scam/immigration fraud.

    2.try to find out his status and try to live his live like other millions of immigrants

    Best way to go!

    But it will cost some money and time. Along with patience!

    3.wait for Obama's new immigration reform

    Don't expect too much for Obama's new immigration reform.

    It may make easy for some people, but it may make more difficulty for other people.

    4.do nothing

    5.fell in love with another us citizen and marry again

    Even if he marry to another US citizen, his case will be flagged with "red" flag.

    He needs to terminate existing marriage, and also provide previous marriage information.

    Since he was petitioned for I-130/I-485, new USCIS adjucator will have questions such as, "why wasn't it completed at all?".

    and why he is not deported yet?

    Not all state have DMV system integrated to USCIS/SSA immigration status check system.

    But most state DMV implemented more thorough check when it comes to renewal time.

    So when he stop by DMV for driver license renewal, he may be asked for ID and immigration paperwork.

    DMV doesn't enforce immigration issue.

    So even if they find his case later, they can deny new driver license for renewal, but that's about it.

  20. I would like to know if their's another way of checking the status of a National Visa Center Case to know if it is complete or not, instead of calling and speaking with a opperator to know if it is complete or not. Any other way????

    Also if you are sure that your case is completed from NVC, and your paperwork was forwarded to US Embassy, you can contact US Embassy to check whether they have your interview scheduled and the paperwork was received, or not.

    I would recommend to call US Embassy to confirm this because you may get feedback from US Embassy Consular officer for what may needed additionally on the top of all info you did submit.

    but what if something happen and my case didn't come to embassy b4 my interview date ? what will be happen in that situation ? i get tired waitting

    I don't think you would get an interview date if the Embassay did not receive your case.

    Actually NVC schedule the Interview first with US Embassy, then send the package via DHL.

    In most case, NVC send out the package right after interview schedule confirmed.

    But you know how beaurocractic world it is.

    By simple mistake, some people's life may be screwed up.
