please be advised, even if people say its ok to cruise even on a closed loop i would strongly advise against it. i work for a very famous cruise line company and i can tell you its not worth the risk. i've seen people deported right from the port to the airport for breaking laws they had no idea even existed. even if its a US territory and God forbid you have to disembark on the next American port, you still face hindrances like the "jones act" and if the CBP aren't in a good mood (experienced it first hand) it's another problem. save the romantic honeymoon for later or go to places that don't involve ships at least

What do you mean? You think they will deport those who are married to US Citizens, who came here legally?
Or those here on H1B?
No No please don’t have any misconceptions... I was just asking if the ones here are gonna be put on hold as well for now since immigration is closed.

It's supposed to protect jobs, but I would like to think spousal and K1 would still go thru as that's a different thing all together.
I'd like to think that anyway. But this is immigration altogether... so I’m sure he’s suspended all of the visas .. but the question remains of what happens to the people already here

Hey,
is it just rumours or false news that US has temporarily Suspended immigration? Not the paperwork part but apparently there is a tweet that states an executive order was signed today that suspended future immigration? Just asking out of curiosity and a little bit of fear.

I received my EAD some 4 months back. According to the below link on USCIS website, the USCIS is still processing the EADs. I understand that those who have applied for EAD along with AOS but have not completed the biometrics yet, for them the USCIS will use the biometrics collected before and process the EAD application.
Check the link.
Great, thank you very much

Hi Friends,
My SSN card says "Valid for Work with only with DHS Authorization".
My EAD card is valid for next 7 months. (Received after my SSN card)
I have few questions with regards to the SSN card:
- My SSN card says "Valid for Work with only with DHS Authorization" and I have EAD card (Validity good for next 7 months). Does that mean I can start employment on the basis of these two cards? or do I need to update my SSN card?
- Do need to update or apply for a new SSN card once I get my Permanent Residency/Green Card?
- If I do not receive Green Card before the expiry of my EAD card, do I need to apply for extension of EAD card? If yes, how and when to apply for the extension?
Thank you
hi,
did you recently receive the EAD? i have been waiting for mine for a while and was just curious to know if they are still processing the EADs during this COVID crisis
-
Hey ,
to receive the EAD as well is there a personal interview? Or does that come in the mail?

It seems your main concern here is earning money as a K. All you need to know is as long as you pay taxes on whatever money you earn- you will have no issues. You can pay the taxes to the US, to India, to whoever- as long as you can show you paid and it was all reported properly- you will have no issues with the IRS or USCIS.
Also you said something like a K can not have income before EAD? That is incorrect. A K can have income- a K does not have work authorization. You can have passive income with out working. Now I have no idea if USCIS would consider stock trading to be 'employment' or some type of passive income but it does not matter. Even if they decided it was 'working'- working with out auth is NOT a bar to adjusting for a K visa holder. So there are no issues with any of this immigration side. The only thing is USCIS will want to see all your income has been reported and IRS stuff properly filed so find a CPA who is knowledgeable with both international issues and whatever it is you are doing with the stock market.
Awesome, thank you so much

I also think it sounds a bit dodgy that you pay no taxes to either country, but I don’t know India tax laws or how you were authorized to work for an American company offshore in American waters.
The company has about 3000 employees having the same bank accounts. Even if the ship is American they always sail out to international waters and come back so unless you are American you don’t have to pay tax here.. and Indians don’t pay tax if you work outside india. Guys, the account is legit and I have all the pay stubs and employment records for it.. IL check with the CPA about the tax but the person I asked doesn’t have an idea about K1 and effect of a trading account on it.. that’s why I wanted to check here.

You might have bigger problems than getting access to the stock market. This is not how that works, I suggest you talk to a CPA.
Lol what kinda problems? The bank account has no issue.. the income is legitimate and no illegal activities ..

The dividends, interest, or capital gains from investing are termed unearned income. That is not the same as having a job and getting paid wages.
You’re going to have to explain your job better.
You worked in the US. Meaning you were physically present in the US doing the work.
Then how did you live in India at the same time?
Hi,
sorry about that. I worked on ships in US waters. So they paid in dollars but it wasn’t taxable here neither was it in India.
thank you for this. So that means there is no harm in having a trading account then. Or connecting the bank account.

A bank uses your SSN to report interest that account earned to the IRS. Banks do not report salary that got put into the account. Salary that was taxable would be reported to the IRS by the employer. Since you resided in India, worked in India, and you probably paid tax to India, then that money held in the account is not taxable as income. If the account earned any income, the bank would have issued you a 1099-INT to show you how much taxable interest the account earned in 2019.
Typical “banks” don’t trade on the stock exchange. You would trade through a “broker” authorized and regulated my the SEC (Securities and Exchange Commission). Financial firms like Edward Jones, Fidelity, Charles Schwab are authorized traders. Some banks may have relationships with brokerages for your convenience but you are actually buying or selling through a company other than the bank. If the brokerage allows you as a foreigner to have a account then you can. Right now you are a non-resident alien. Ask them.
So when you purchase securities (stocks) the money you take out of the bank to use is not taxable. The shares you own are not taxable. But if it is a stock that pays dividends to shareholders, then the dividend money earned during the tax year is taxable. Also there are tax implications when you sell a stock. Any gain you made on the stock is considered income. Example— you bought $3000 worth of stock and later sold the shares for $4000. You earned $1000 profit which is taxable income.
Does that answer your question?
Hi there,
thanks for this. Just to clarify - I lived in india but worked in the US on contract. So my income wasn’t taxable anywhere.
And regarding the tradings I got the profit part but would that be termed as income in the US? Since a K1 is not supposed to get any income before the EAD will that have an issue later. -

These are very specific questions so you might want to consider talking to a local CPA. Everyones tax situation is different.
And just for clarification- are you saying you have a US bank account already? One you were able to open w/o a SSN? Anyway- usually when people come as K they elect their first year to be treated as a resident for the entire year for tax purposes. There are a few threads about it in this sub forum. Again though I think your best bet is to speak to a CPA about the specifics in your situation. Regarding stock market trading- I have no idea about potential tax implications on earnings you may get but I can tell you for immigration purposes its N/A as long as you do pay whatever taxes you may owe from doing such- (but the act of doing such is N/A for the immigration process)
Hey , thank you. Yes I have a bank account without SSN ... since it was an American company we we allowed to do it.

Hi All,
so i have a question regarding TAX & stock market trading.
i have a SSN now. i have also worked for a US based company before i arrived on a K1. so i have a bank account too but i didn't have an SSN then and i haven't connected it to the account so far since its still a "salary account" although i am not getting salary anymore. i am still waiting for my EAD and GC and considering the pandemic i am guessing it might take a little while longer.
My question is, will connecting the SSN to the account have a problem with tax and IRS later since i didn't have to pay tax before the K1 on the income earned?
Also, since i have an SSN now, can i use the account to trade in the stock market if i connect the SSN? or does that count as income if i gain something from it?
i am just trying to figure out what i can do with the time i have before i can work again. Appreciate your advise.
Anyone???

As to college courses, you are free to take them but make sure to follow the guidelines for whom is considered a state resident or not - fees for non residents are usually much higher.
Last year, as I waited for my EAD I spent most of my time at home working on interior design projects, learning languages, taking care of my dogs. I do wish, though, that I had attended more networking events and connected more with people from my industry because when I finally got my EAD, I didn't get called for any of the jobs I wanted, largely due to the fact I could not provide any references within the United States other than my family. So you might want to consider using some of your time to attend events and make connections to maximize your employability when the time comes.
great, thank you so much

Hi All,
I'm sure many people here are waiting for their EADs and i hope it comes soon enough for everyone. In the meanwhile i wanted to ask you guys, what exactly can you do during this time?
Are we allowed to take up college courses or any sort of studies? Anything else that you guys do to pass the time, please do let me know.
Appreciate your responses

It makes no sense that your photos would cause a problem for AOS. Not an issue. Feel free to show your celebration photos......
Hey, thank you for that. So if the interviewer asks if we had a religious wedding ceremony after the court marriage we can just say yes? Sorry for the questions I’m just a bit worried.

Hi Everyone,
I hope this is the right forum to ask this question.
I was hoping you guys could clear something for me. Durning the K1 process we were asked to provide our social media accounts on the form, didn't know what that was for exactly but after coming to the US we had a court wedding immediately and a couple of months later had a religious ceremony and reception as well. Someone told me recently that the photos taken during the religious ceremony shouldn't be shown on social media since the interviewer will think its a sham as our court wedding date is the one put on the marriage certificate. but its hard to tell everyone not to tag us in any pictures, also even if we hide our profiles, if you search for our names on FB it still pulls up pictures taken by other people if they have it as *public. can someone please shed some light on this. would the pictures create a problem during the GC interview since the dates are different? has anyone else faced something like this?
appreciate your advise

Hi Everyone,
so I finally made it to the US and got married. Now the 2 part of the story begins. Can You guys please let me know what is the process of applying for an SSN?
i have the form and on it it’s asking for citizenship details on question no5. Do I put -legal alien not allowed to work? Or put as others? Because the reason for alien not allowed to work does not specify K1 visa holder. If anyone has filled out this form please do let me know what you filled in it.
appreciate your response.

Hi Guys,
so I’m leaving for the US in a weeks time and I wanted to know. Does the CBP officer take an interview for K1 visa entries during immigration? If so what kind of questions do they usually ask?
Appreciate your responses.

We got married in Fort Worth you do not need a SSN only the sponsor must know his or hers. You can not request a wavier unless you take a marriage class otherwise you have to wait 72 hours after the license is issued. The good news is you can get the certificate on the spot. Our judge walked over our license and handed it over to the clerk who proceeded to register it. We ordered our extra copies at that time (it's cheaper if you get them the first visit). Within 15 minutes we had our certificate and the certified copies!!!! Marriage license is the same as the certificate only after you are officially married.
Ok thank you. Since you are from Texas.. can I ask you? Is it true you have to wait for the Work permit before applying for a drivers license? And do international drivers licenses from India work in the US?

I got my marriage license in Houston, Harris County.
You do not need a US ID or SSN, your International Passport is sufficient identification no other document or letter is required.....of course your US Fiance will have a valid ID and SSN.
If you do not want to wait for 72hrs to get married after getting the license, you can get a waiver from a judge immediately you get your marriage license and get married same day.
Process was easy, fast and straight forward. No issues at all.
Thank you.
Address Change question
in Working & Traveling During US Immigration
Posted
Hi All,
Hope you guys are staying safe. I had a question about address change and would like some inputs if possible.
I received my EAD and am moving to another city for work. i faced some nerve wrecking issues with my EAD coming to the apartment address we currently live in so i am a bit worried about changing my address to another apartment address in another city.
would there by an issue if i changed my address to my wife's parents house address in the current city? while my wife and i are in an apartment in another city (about 3 hours away) so we do not have to worry about any letters not reaching?
The apartment is on both our names and it is not a permanent location for us. We will eventually come back closer to where her parents live. I would like to mention that everything else like my drivers license, car insurance, bank information etc have her parents address listed.
Hope to get some feedback. Thank you.
