Thank you guy's .though I think I need to explain to you something important which I see that you directly jumped to your negative conclusions as I tried to fraud The IRS and tried to obtain more money !!

When came to this country I didn't know that much about such issues like the tax return or something else ... all helped by my wife and I did all what she told me and I remember that when I was about to apply for the first time I talked her and I asked her for SSN# and she said no and that I might apply as single and that is no a big deal . As soon as I pay my tax they don't care !!! .

After a while I started to find out that she applied for her benefit to gain more money ! moreover we had a big fight to the point I had to leave to TN and I applied my second year Tax there !! I tried one more time to make it up ....no use !!

After this I went back to NYC and I got rehired again .

What I want to say either way I had to apply !! and its what I did . I offered the divorce and every time she escape away when it comes to a critical and serious issue .

Guys I'm seeking help because every single day I find out A new trouble in my path which I never seek and didn't work for . i'm legal in this country and I want to keep it up .No matter what it gonna cost me .

I thought I had to put this explanation for more information .

Any other opinions please ???I have to make a decision either to go forward or to fix it all .

hereby by a short brief of my whole story , I thought it might be helpful for who thinks to help me .my story started June 2005 ,I met my current US wife via internet.we went through a very horrible and lengthy trip until we reached to be together .I will explain shortly as below ...

* June 2005 met via internet

*August 2006 got married in my back home country Jordan

Sep 1 we applied ....)NOA Dec 12 case approved ! ---case file received in Amman Jordan at Jan 17 2007 .Interview scheduled April 10 -2007

* the decision made was to return the case file to USA for more administrative reviewing .

* April 2001 we become given up and advised by An attorney to re-apply .

May 2011 we started a new journey of CR1 process .

20 Jan 2012 NOA case approved , Feb 18 case received in US embassy Amman-Jordan .

Interview scheduled at March 18 2012 . Case suspended one more time for mandatory procedures .

May 20 Goot a phone call by the embassy asking for another interview and that the consular asked to see me again . Was really easy and brief .

Mar 24 file with immigrant visa received .

June 15 2012 Arrived to JFK .

* received the green card 10 years few weeks after ,Lawful Permanent Residence since June 15 2012 .

Now these are all information needed to understand the whole situation .I heard that I may apply for citizenship 3 months before I complete the 3 years as a Permanent Resident based on Alien petition (Married to An American citizen .which it suppose to be next week or March 15 2015 if I'm not mistaken ....Therefore I been told to prepare myself and to prepare all documents needed with N 400 .

the problem started when a friend told me there is a problem gonna show up during the process which I applied for Tax return as single based on a request of my wife ,,, she preferred to apply alone because this way she gains more money Esp she has got 2 minor kids.

My friend thinks I need to wait 2 more years to be eligible to apply for citizenship .Since the early morning I don't know what to do then I remembered this great site and I decided to ask for help here . Hopefully I will find an answer before I must make a decision very soon .

Even if your I-130 makes it to the consulate and you have a sucessful interview, they will not be able to issue a visa until there has been a decision on the I-129F (K3.) You need to call USCIS and put a service request on your case. You haven't heard anything in 6 months, so they can do this. My case was misplaced after they sent it back and I was having a difficult time trying to get them to trace it. I finally called the DOS in Washington DC. They told me what to do and I did it. They finally traced and found my file. It is now in AR. The consulate and the lady at DOS both told me that the K3 has to be resolved before the visa can be issued. Call and have them put in a service request. Service request have worked better for me than my representatives. I could go on for days with those stories.

You have disappointed me really , when i asked for help i don't need to listen to your lecture as im talking with an officer !! i needed your help if you don't feel to help don't make it even harder for someone waited more than 29 months for just reviwing ... i even didn't receive any answer from them until now ... not even a document to tell me what is going on ... all letters i get were fake none helpfull letters .

put yourself in my position and use your heart not your snob senses .

They returned it over 2 years ago? I suspect this is what the hold up is on your I-130. Have you been in contact with the USCIS on the returned petition? Have they ever sent you out the Notice of Intent to Revoke for that petition? If that first petition hasn't been taken care of, either expired or reaffirmed, it can hold up any other petitions until it has been resolved.

yes i got 221G because the CO thinks i failed to convince her of my relattionship with my wife and decided to return the file back for more review no admin review ...I hope this helps

my wife and I got approved for both cases I129 & I130 in 12 Dec 2006 .. my interview for I129 was in 10 April 2007 , The CO decided to return my file back to USCIS for more review and in July they recieved my file and the journey just started .. While all that time my wife asking and calling to know what is going on .. we got many Ref , just in 31 March 2009 our I129 got updated with no new information in 1 April 2008 we applied I824 for I130 and in July 2008 i received a letter tells they received my application and within 6 months i should receive a decision or a new notice of action . then time passed with out any new information in 11 March 2009 i received a ref tells within 60 days i should receive a new decision or a new notice of action for I130 and again time passed and nothing happened ... my wife called again and they told her they are sending a new letter to her because time was out .. they also told her clearly because me her husband is arabic and muslim they need more time to investigate and review more even its more than 25 months since i been reviewed !!!! in 20 May they send the letter tells ... the progress in your case has been delayed , A check of our record establishes that your case in not ready yet for decision as the reqiured security check remains pending , untill the security checks have been completed we cannot move forward in your case , these security checks required to be completed on all aplicants who apply for immigration benefit you are seeking .we will make every effort to to make a decision on this case as soon as this security checks are complete if you don't receive any decision or other notice of action from us within 6 months please call customer service ... elc... .

My wife have filled I824 form to get another action of approved case in 1 april 2008 and we got a notice of action in 23 july 2008 as they received our form , The timeline for this form is 6 month's and today is 23 jan 2009 and nothing appeared yet !!!

my wife went to infopass interview last week and they told her that we will receive a notice through Feb till march .

Now they are out of timeline !!!

then she asked me to write a paper all what i know about my wife

she didn't bother to look in all what i gave her , what she said give me everything you have .

she was in hard mood and she fought with the applican before me

she was asking and when i start to answer she starts a new question

she asked me to rise up my right hand and to swear that i wrote everything in that paper she asked for

i asked her to give me a chance to bring the real pictures but she refused

So the original interview was for the K3 but did you inform Jordan that you had an approved CR-1/IR-1 as well? If you did they would of noted the other visa on your file and told you how to get this interview turned into the CR-1/IR-1.

This is a big issue and should of been addressed immediately. Did they ask for more evidence? Did they give you a time frame for the submittal or did they send the file back to the local approving service center for them to check the relationship more closely? Your wife should of gotten something from them within one year or even been asked to attend an interview at her local office.

Yes, originally it was not for security checks. But anyone wanting to come to the USA has to have security checks run on them and all must come back cleared and clean.

The original visa interview is up for NOIR OR NOID it sounds like. NOIR is Notice of Intent to Revoke and NOID is Notice of Intent to Deny. Your wife needs to really find out the status of the original petition.

I do not understand why the attorney did this since your file was being sent back because the CO does not believe your marriage is legit. This has to be addressed before anything is put into security checks.

If you interview and get approved on the K3 you would need to adjust here in the states. But all of this is based on a decision that you do get approved for the K3.

or i need to finish both together?

When you file the two visa's you are hoping that the K3 is faster and you would interview for it and then come and adjust status in the US. If they both complete at the same time usually you forward the CR-1/IR-1 to the embassy and ask to interview that way. Then you would not need to have any AOS (adjustment of status).

Background check can take as long as they need. It can be weeks, months, and in some cases years just like emt103c stated earlier.

When you file a petition and is approved here in the states it is not a done deal. The paperwork in the states is looked at for accuracy only. The interview with the CO is to check the validty of your relationshiip and to run the security checks on your name and fingerprints. Once that person is satisfied and you meet all the requirements then a visa is issued.

Security checks are run on all applicants that want to come to the USA. Being male and from a Muslim country makes your checks more important and stringent than for someone like in a country like Greenland. Afghanistan, Algeria, Bahrain, Bangladesh, Djibouti, Egypt, Eritrea, Indonesia, Iran, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Morocco, Oman, Pakistan, Qatar, Saudi Arabia, Somalia, Sudan, Syria, Tunisia, Turkey, the United Arab Emirates, and Yemen.

This is a list of countries that the men are scrutinzed more closely with before a visa is issued.

Hope this helps and you really need to talk to your wife and have her check on the status of the K3 and study up on Administrative Processing as well as NOIR and NOID applications.

Was your original interview for the same I-130 or for the K3 (129F)?

What was marked off on the 221(g)? Was it security checks that time too or something different?

What was the date of your last interview?

If your last interview was April, 2007 you need to go ahead and have your wife start doing inquiries through elected officials. She can find her U.S. Reps at www.house.gov or www.senate.gov

You will want to start looking at the term "administrative processing" on this site and Family Based Immigration. There is a wealth of information about it, mostly depressing, but informative that will help you understand what is going on. There is no time limit on AP but there are things you can do to make sure that they are aware you are watching and are concerned about your case. Your attorney can do nothing to speed it up. . .until it has been more than two years in which case it is lawsuits or Writs of Mandamus, etc. . . usually the cases are cleared up much before that time period hits. It is just a horrible feeling of uncertainty.

Right now they are doing security checks which is referred to as Administrative Processing (AP.) These can take ANY amount of time and they don't have a time limit.

I am curious though because you were given 221g, which usually refers to AP and now they are re-stating it?

What was the original 221g for?

If both applications were approved in Dec 2006, why did you do the I-824?

Are you doing Adjustment of status from within the U.S. or consular processing?

Do you have an attorney handling your case?

Have you had contact with your elected representatives?

the original 221g was for the interview i had in 10 april 2007 in USA embassy in my country .

i did the I824 because i need to take a new action for my approved case I130 to sent the file to Jordan for another interview . This is what my attorney did by himself .

i didn't get the visa to enter USA yet so im not doing Adjustment of status yet therefore i applied for I824 to get action and then to complete the steps (i don't know if im doing the true step !!)

Yes i do have an attorney but im not sure if he is doing well with the case
