  1. Hi, good news!!! I received the email that a welcome notice was sent .... I am still trying to believe it!! It seems it was just as the IO said on the interview - they needed an extra few weeks to complete the background check. I think since I was a student here they wanted to check if I were in status all the time I was in school.

    But still WOW I really did not expected to have it go through so quickly! I was worried I was going to be big time stuck in name check just for the sake of it.

  2. We are going to San Antonio for the AOS interview in less than a week. I am a bit worried because we have only a few pictures. But, lol, most of all I worry about getting there and back - we will ride the buss and spend a night in a motel. I am sure it will be an adventure, but it would be worthed if all goes well.

  3. Wow! I did receive my EAD today!

    It was postmarked June 14th, and was valid from June 7th.

    I did apply for a job as soon as I received the 'card production ordered' e-mail. One employer's hiring manager ended the interview as soon as she realized I do not have the actual card yet :whistle: . For the next interview I had that 'card production ordered' e-mail printed and they told me I am alright to start as long as I can give them my alien # and then show them the card as soon as I get it ;) .

    Anyhow, it's awesome to work even though it's exhausting - I really wasn't too picky about the job :lol: At least checking the mail is not the peak of my day :huh:

  4. Still no EAD card. This is getting to be ridiculous.

    I know this is nuts, I received another "ead card production ordered" email from CRIS today, which doesnt make sense coz i received the same email on 6/7, 5 days back.

    Same here - I received 'card production ordered' for EAD on the 7th, and then another e-mail yesterday 12th.

    I also saw the EAD was touched again today too.

  5. How many times I check my case status online - about 10

    How many average hours I spend in VJ in day - about 2 1/2

    How many times in day I check my mail box - 6-7, mailman is unpredictable

    and how many times in day I check my e-mail for a msg from CHRIS - about 20

    My interview's on July 11, just received the letter

    Here is a question:

    :innocent: did you all receive an extra sheet of paper with the letter reminding to bring any police/court records if ''you have ever been arrested or detained by any law enforcement officers for any reason" :whistle: I would hate to think I was singled out for such a reminder (not that there is any reason for that, of course :no: )

  7. Should this plan work, and will there be fees for changing my name of a pending AOS/EAD/AP?

    I was trying to figure this out too!!!

    My AOS/EAD are pending, and I applied with my maiden name, but I would love to change it before USCIS issues any of the cards. :help:

    All I could find is that if everything goes smoothly and I receive a GC, I could submit form I-90 (the fee is $260 and I will need another set of biometrics taken) to have the GC replaced with my new name.

  8. ... that the A# is found in the fiancee petition approval letter, the thing is that in my AOS paperwork, I put n/a in the space provided for the A# since I don't have any idea that I already have it. Beore filing the form though, I called the uscis call center and they said just put n/a in the A# if you don't have it...

    Hi, if you had sent copies of your 'fiancee petition approval letter' with your AOS paperwork, then USCIS would find the A# easily. :thumbs:

  9. Hi everyone. My wife and I are in the midst of preparing our AOS, and we shall put our timeline down soon.

    My query is as follows:

    I have an old EAD from the time of my F1 (OPT) visa which expired in 2000. On it, is written:

    INS A# The numbers show as follows:
    999-999-999

    Is this number the same as the "A" number asked for in the I-485? Are there extra numbers on my INS number compared with a regular A number?

    Hi,

    I noticed that I had the same A# on my OPT and previous F1 financial hardship EADs.

    When I prepared my AOS and EAD paperwork I used that same A#, but then when I received the biometrics appointment letter, I noticed that USCIS had assigned a different A#.

    I guess they consider the AOS a different case (I did send them a copy of my OPT EAD though).

    Well, on the brighter side - they did not seem upset I used the old A# ...and also I remember on some places they ask for the number on the I-94 arrival slip if I didn't have an A#

  10. Why would you be going through TSC? AOS would be sent to the local office and EAD or AP would be handled by the MSC. Do you have a case number with TCS on it?

    I wasn't very sure about who handles what... I do have MSC in my case numbers and I had to send the RFE to Missouri. So... AOS gets sent to local office or CSC, EAD still handled by MSC. ;)

    AOS was touched a few times between them receiving the RFE on May 4th and my AOS standstill at May 9 :whistle: assuming it was transfered to the local office

    It makes sense though that the EAD wasn't touched at the time.

    I just really hope USCIS are happy with the financial papers and I don't get hit with another RFE :unsure:

    It's nice to hear I'll probably have the interview in Houston. :D:)

    Wow, I am one of the few March filers without interview date or transfer... I am guarding my mail box expecting the interview appt, I had an RFE though and they just 'resumed' working on my case May 4th - maybe that's delaying it.

    Also, I've heard (read in a post) the Texas Service Center is slow? And I am curious if I will have the interview in Houston or San Antonio. I am closer to Houston and that's where I had the biometrics, but the USCIS web site says Houston does not conduct interviews, only biometrics.... there's not even an InfoPass there. Oh well, probably will be San Antonio.

    Title 8, CFR 103.2 (b ) (2 ) (i) and (ii) says:

    " (2) Submitting secondary evidence and affidavits .

    (i) General . The non-existence or other unavailability of required evidence creates a presumption of ineligibility. If a required document, such as a birth or marriage certificate, does not exist or cannot be obtained, an applicant or petitioner must demonstrate this and submit secondary evidence, such as church or school records, pertinent to the facts at issue. If secondary evidence also does not exist or cannot be obtained, the applicant or petitioner must demonstrate the unavailability of both the required document and relevant secondary evidence, and submit two or more affidavits, sworn to or affirmed by persons who are not parties to the petition who have direct personal knowledge of the event and circumstances. Secondary evidence must overcome the unavailability of primary evidence, and affidavits must overcome the unavailability of both primary and secondary evidence.

    (ii) Demonstrating that a record is not available . Where a record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whether similar records for the time and place are available. However, a certification from an appropriate foreign government that a document does not exist is not required where the Department of State's Foreign Affairs Manual indicates this type of document generally does not exist. An applicant or petitioner who has not been able to acquire the necessary document or statement from the relevant foreign authority may submit evidence that repeated good faith attempts were made to obtain the required document or statement. However, where the Service finds that such documents or statements are generally available, it may require that the applicant or petitioner submit the required document or statement. "

    And to be certain that you have the correct papers - InfoPass would allow you to schedule an appointment with an immigration official. Could be a long drive depending on where you live, but if you send the paperwork and they are not happy with any initial evidence you'll receive a note asking for more papers.

    It's not that we don't care, we probably don't know what to advise you :huh:

    I read your post last night and I wanted to reply but I didn't wanted to give you wrong information :oops:

    Anyway - I didn't have my birth certificate with me when I was preparing the AOS application, so I called the 1-800 USCIS number to ask what they mean by secondary evidence. The rep. who I talked to tried to be helpful and read what they mean by secondary evidence. You could find the info. on the USCIS web site - the instruction on the AOS application refer to Title 8, CFR 103.2 (b )(2)

    I overlooked that I need a b-certificate for the AOS and I end up asking my relatives to have it translated for me. Then I had it scanned and e-mailed as an attachment (both the b-certificate and the translation). I just printed it off my e-mail after that. Another thing your brother could do is fax you the document.

    You file with a copy of the b-certificate anyway. And then you will have enough time to receive the originals via snail mail and have them ready in case you need them (you'll probably need them if you have to go to an interview)

    By the way - Since I don't have a fax machine available ... :idea: I found that the local grocery store has a public fax and they charge 1$ a page.

    I received an RFE and I was really confused about what they meant by that line about interim EAD. I went on the USCIS web site to read the specific Federal Code Regulation they were referring to. It says a few things among which:

    "Employment authorization previously accorded based on the same status and employment as that requested in the current application or petition may continue uninterrupted as provided in 8 CFR 274a.12(b )(20) during the suspense period." 8 CFR 103.2(10)(ii)

    Since your husband already has an EAD it makes sense that he is authorized to work until the expiration date on the card.

    " You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regualtions, Section 103.2((10)(ii) until ninety (90) days after missing intitial evidence is received. "

    That statement is for a person who has not received an EAD. If a person does not receive EAD in 90 days he/she is eligible for interim EAD. But if there is an RFE, as it says on the paper, a person is not eligible for that interim EAD until...
