I'm an F-1 student, this is the timeline of my AOS, please note the whole time throughout all these process I always maintain my F-1 status and it is still valid until now, Bio major, 3.95 GPA, graduating in May 2020
9/2017 I submitted an AOS package with my ex, right after the submission we started to have problem, our relationship fell apart, and we were separated
3/2018 I filed a divorce, Texas has a 60 days cooling period thing, the divorces didn't get finalized until 6/2018
10/2018 I sent a letter with the withdrawal request of all the AOS paper with my ex along with the divorce paper
11/2018 They denied my case due to the divorce but since i have always maintained my F-1 status, the letter they sent me also say I'm here legally as long as I keep going to school, etc
So that's my first AOS that i withdrew
The complicated thing in my case is me and my ex stopped being together since the end of September 2017, on December 2017 (which is 3 months after the separation) I met my husband now, we started dating ever since, so "paper-wise" I was still my ex's wife while i was dating my husband, he knows about it and we were very clear that me and my ex had nothing anymore, it just took me awhile to filed the divorce paper since I had to filed it myself and he was out of state and it's just harder to get his signature and everything.
Me and my husband has been together since December 2017, we lived together since April 2018
My question is, does it look bad on my application that I have the overlapping period between my marriage status and my dating? And that after a year and a half of withdrawing my AOS paperwork I submitted a new one?
I'm not afraid since my relationship with my husband is real, I filed the divorce myself, withdrew the paperwork myself, but I'm still a bit worried because that 1st AOS case can be a red flag
Has anyone survived a second marriage interview before?
Withdrew 1st AOS, submitted 2nd AOS with second marriage
