     I hope you are all well! 

    I filled I-751 with my wife in May last year 2019. Since then the relationship has broken down and we are getting a divorce. Which is about to be filed.

     I have been reading around the forums here and have spoken to two lawyers about next steps. But I am a bit confused, I’m hoping someone can shed some light and offer some opinions.

     

     Do I need to submit a whole new I-751 package? Or write a basic letter outlining the facts, submit the divorce decree and ask that my case be amended to a divorce waiver?

     

     After reading some topics on this forum, I was thinking I could just write a letter letting them know of the divorce and provide the final decree with perhaps a statement from myself describing the marriage breakdown.

     When I spoke to the lawyers they both recommend preparing an entire new I-751 evidence package, one said I should get a statement from my spouse and one suggested not to get a statement from my spouse.

     I am concerned that I won’t have enough evidence for a new package as I have lost some old bills ect. Our original package was pretty good I believe, with statements from my wife's family members that wouldn’t be willing to do that again now that we have separated.

     If I do/ do not submit a new i-751 will the case manager/ reviewing officer still consider the evidence from the “old” I-751?

    any help is greatly appreciated

     I hope you are all well.

    I am the applicant in marriage based visa.

     I just tried to speak with a customer service representative at USCIS. I was told they can’t provide any information without speaking to the petitioner. i.e my wife.

     I am going through a divorce and wanted to inquire about how to inform them and ask a few questions.

    I have not experienced this when calling before, does anyone know if this is a new policy and what I can do if I am separated from my wife atm regarding speaking with USCIS?

  3. Hey guys and girls,

     I am confused and need to ask some questions.

    when I log in to my USCIS, on the check status page it says , 1-551 green card mailed with the date apprx 2 years ago when it was mailed, but also a blue box that says ”case closed” 

     I was presuming this was about the  i 551, being ”closed”. After I recieved it 2 years ago.

     But after being unable to update my mailing address on myUSCIS. I started to panic and think that this might mean my entire case is closed, presumably due to missed biometrics. Could someone please clarify. Any help is much apprieciated. Thanks in advance.

     So I should just get back there asap, with my extension letter in hand, walk-in or re schedual my biometrics appointment in Portland, then IF I recieve a denial letter re file a form i-751. Then wait? Is that correct?

     

     What if I do not have the support of my wife’s family anymore? Is that where the divorce waiver comes in?

     

     I will try to read up on these forms, my apologies if I am being vague, my wife handled much of the paperwork regarding my visa.

     

     

  5. So, I will be allowed to re-enter, what about time frames? It might be a little while till I can do it...?

     

     Also, if cbp are asking me to sign a i-407 wouldn’t that be because they were not letting me re enter?

     

     Also, Should I contact UCSIS now and explain what is going on? If so, what details are pertinent to convey?

    Also: when going through CBP they might ask you to sign Form I-407. Don't sign it! You have the right to refuse to sign it. If you don't sign it, only an Immigration Judge can revoke your status.

     Thank you all for your help, this (my situation and status) rather confusing, and a little scary, I must admit.

     Card expired 05/01/19

    and yes I had received a letter of extension  for 18 months dated 4/25/19

  7. Hi everyone, hope you all are well.

     I lurked here a lot in late 2016 , early 2017 while waiting for my greencard to be approved.

     I am an Australian and my wife is from the USA, we had living in Australia for some years before deciding to move to be closer to her family ect. 

     I arrived in the US on May 1st 2017.  In 2019 we applied to have my conditions lifted and I had a biometrics appointment scheduled in Portland almost four hours drive away. Shortly before my biometrics appointment, my wife just came home and stated that she could not go on and and that I had to leave. We had our tensions related to me having trouble finding work and I was in a bout of depression an anxiety at the time. She gave me a short period to be gone. I was in shock and utter despair and not thinking clearly. I agreed to fly back to Australia and abandon our relationship home and the kittens we were raising, all of which was utterly heartbreaking for me. I did not attend the biometrics appointment on 5/20/2019

     Some time has passed, and things are not great in Australia, Once I was over my initial shock I realized that I should have stayed in the USA and tried to make it on my own there. I have had extreme anxiety and depression since then and have literally scared and overwhelmed and at a loss as to what to do regrading my green card status. I have only just received some paperwork in the mail from my wife related to the visa and have been able to login to ucsis and verify my identity. But I am not sure what I can do to keep my greencard or if it considered abandoned.

     I would like to reschedual my biometrics appointment and return to the US. Money has been tight and I have only just gotten acess to a phone account I can call them from.

    any help or advice would be very much appreciated . Thank you all in advance.
