    I'm new to this site, just got it while searching, hope you can be of help for me.

    I have CR1 interview in US Embassy Lagos in May 14th 2008 and after answering the questions, the CO said that I'm ineligible for the visa because I have applied for B2/B4 visa in 2001 which indicated I'm married. I have never married before it was a mistake on my side, I filled married in the B2/B4 to show strong ties that I will return to my home country and now they are using it as a red flag. The CO said the case will be returned to homeland security where it was approved and also stated in the blue slip given to me that you have provided evidence that you and the petitioner are in a relationship solely for immigration purposes.

    Can anybody tell me what I can do to stop them from sending it back to US.

    I need your advice urgently.

    From the statement I highlighted I am thinking the OP lied on their B2 application saying they were married. The fact that there was no documentation of this in the CR1 (either that there was a divorce or that the marriage is to his current wife) lead the CO to discover the discrepancy and deny the visa based on misrepresentation.

    I don't think this has anything to do with bonafides of relationship. I think this has to do with the misrepresentation on the B2 application.

    Someone correct me if I am wrong.

    How can someone that overstay on F visa in China get police report or letter that states that no criminal conviction found.?

    It says what it says.... Provide this information to NVC informing them that on there own department's information website police records are not available.

    Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

    Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

    According to a 1957 state council ruling that is still in force, the imposition of a re-education through labor (Lao Dong Jiao Yu) term does not result from a criminal conviction. Administrative organs, rather than courts, impose re-education through labor. It is important to distinguish re-education through labor from labor reform (Lao Dong Gai Zao), which is a sentence meted out for criminal offenses.

Did you work in any company or any university ? if so, it wouldn't be difficult for you to get police record . first, you need to go to your company or univeristy to get the proof that you have never had any criminal during the time. then, you take that paper to police station to get the police record.

    I'm a Nigerian, I lived in China for 16months on F-visa, later returned to Nigeria and NVC asked me to get police reports from there.

    Can anyone tell me how to go about it? I email Guangzhou public security bureau but my email message is coming bouncing back.

    Hello May filers, I just could not handle the torture any longer so this morning I decided to call USCIS using the RFE trick. A nice Hispanic lady took my call and she immediately requested for my receipt # and asked what type of application I had submitted. Then she confirmed my name and home address. To my surprise, she said the magic word...... “approval notice was sent on September 4th 2007”. I quickly asked her what date the petition was approved and she replied August 31st. So my 08/31st touch resulted in NOA-2. USCIS website still says our case is still in “received and pending” status. We did not receive any email notification too. Thank God this part of the journey is behind us. What an angonishing painful wait! I would advice other filers that have been waiting (at least 120 days) and did experience a touch to call USCIS to check perhaps their petition has already been approved. For those that are still waiting, hold tight your good news is on the way. Oh yes....This is going to be a good weekend. Cheers!!! :dance::dance::dance:

    BTW, VJ projected NOA-2 date was 09/22/07

    It usually takes about a month for NVC to get your approved petition and upload it in their system.

    I would wait till I got my hardcopy of the approval in the mail which you should be getting any day now before you call.

    They have an automated system that will ask for your USCIS receipt number and let you know that they have recieved your case. You just have to keep trying to call and check, the phone number is 603-334-0700.

    I got approved on Aug.1st and they still don't have my information yet but it's only been two weeks I know I should be patient but it is hard I know.

    He received his visa today. It took about 3 hrs for him to get it, but he's ready to go. He will be arriving in the US via JFK next Thursday. For those of you whose fiance's (especially Nigerian) are already in the US, do you have any recommendations for items that I should have ready for him?
