    If you have an image of the cleared check, you'll see that they put the receipt number on the front of it. You can try to use it to check your case status online if you don't have your NOA1.

  4. It may be a good idea to send emails instead of calling, that way you have evidence that you've contacted the embassy regarding the visa issuance. In our case, we actually got responses from our emails and nothing from phone calls. At the very least, you will get an automated email that states your query is being processed.

    Depending on the embassy, it does take anywhere from a couple of days to a few weeks until they actually send your passport with the visa. I wouldn't be surprised that, given the holidays, they are a bit backed up. I'd recommend patience, for now. If you still don't have your visa at the end of Jan, you may want to contact your congressman.

  5. I wonder why you didn't file for removal of conditions on your CR-1 visa before it expired? One can apply to remove conditions in cases of divorce, as long as you can show you and your spouse had good faith entering into the marriage. As it is, your CR-1 visa seems to be expired and now it may be too late to remove conditions. However! It never hurts to call the USCIS and formally ask. Maybe your GF can go down to the nearest office and talk to someone in person.

    As to the VWP, Singers is technically correct. However, I have seen many spouses on VJ from VWP countries (and Canada) that still visit the USA while their paperwork was processed. So it is possible to visit. However, it is never a "given" because your entry is at the discretion of the border guard. If you do decide to visit, you'll need to show extensive ties to your home country (ie. property deeds or rental agreement, bank statements, return ticket home, letter from employer stating when they are expecting you back etc) and my husband also brought copies of all of the papers we submitted to USCIS and NVC.

  6. Thank you so much for all the information. I hasn't been over a month yet since the paperwork was sent in. From your responses, I gather that the AP in this case may either mean additional background checks or it may just due to theml just waiting to review the domicile paperwork.

    I will post when I have any updates on the case.

    Our case did go into an extended AP at the DOS after the interview because they requested additional information. The embassy, we found, underestimated the timeline by 4-6 weeks. We were told it would take "a few weeks", but after we provided the requested paperwork, the AP took ~2.5 months. To me, your case appears to be straightforward and should be done very quickly relatively speaking. They may do additional background checks, but they will mostly process your paperwork. (There are some couples who had a very long AP (6-14 months) but their situation was different from yours.)

    Just be patient, it will be processed. And if they need additional paperwork, they will contact you.

  7. I am happy to report that my husband is here! :dance::dance::dance::dance::dance::dance::dance::dance::dance::dance::dance:

    We recieved the visa on Nov 2 and proceeded to finish the re-medical, the passport printing and buying plane tickets.

    I am RELIEVED this horrible thing called AP and visa journey is OVER. They told my husband at POE that he would get his greencard and ss in 3 weeks. Everything went well in the end, no problems at POE.

    I am thankful to have a good November update.

    I am praying for all of you who are still in AP that it is over soon. 13 months have been hard on us but we are able to put that behind us, learn from it, and start a life which we wish to make successful.

    Keep your believes and do not let negative thoughts enter your mind, there IS an end to AP and we are livn proof that even after 13 months the visa can be issued and with the corrected IR-1 catagory.

  8. I'm so sorry to hear that your situation is deteriorating. You've written in this forum several times, and I believe that the advice you've been given is to seek out a divorce attorney. In the topics you've posted previously, there have been links, phone numbers, safe houses and information given to you.

    We help you and give you advice because we care about you. By doing so, we are encouraging you to help yourself and have your rights protected. It is difficult for us who have spent time to help you to see that you haven't taken our advice or contacted an attorney and that the situation has gotten worse. I don't know how many times we can tell you the same things.

    Have you gotten an attorney? If you haven't, do so!

    You've been given very good advice, and contact phone numbers of agencies that can help you. Please use them!

  9. I'm not sure how the 2 year residency requirement works when applying for another J visa. I do know that it does apply if someone wanted to return to the US on another work visa (ie H1B).

    You may want to try:

    1. Contacting the international office at the university where your wife is attending. They should know alot about J visas, especially if it is a research university and they have lots of post-doctoral research fellows from outside the US.

    2. Google "national interest waiver" and see if it applies to you. If applicable, it means you can request that the 2 year residency requirement be waived.

    I wonder why you always post the same thing, and always in bold, like it's in some way important? I guess we will never know; interesting though :whistle:

    For that matter, zqt, wanting the USC's side of the story is off-topic and doesn't help the OP.

    It seems there are two issues here.

    1. You are afraid your husband will "use" USCIS against you.

    2. You are curious as to the ramifications on the divorce proceedings if you do not sign the initial divorce paperwork.

    The first issue is, I think, a non-issue because you have a 10-year green card.

    The second issue: Please please please see a lawyer. You do need to address the complaint, and start drawing up terms for your separation agreement. You are from Michigan right? If so, then there's a two-month waiting period, not a two-year period. If you and your husband are on amiable terms (sounds unlikely) you two can draw up a draft of the agreement together, without lawyers. But it is absolutely critical that you have a lawyer review anything, and you do not sign anything without having your lawyer see it. Protect your rights.

  11. zqt had a good point in that each state has their own unique set of laws associated with separation and divorce. Please sit down for a consultation with a lawyer in your state, as most lawyers offer a free initial consultation.

    zqt does make another good point (did I really just say that?) in that joint therapy may help you to at least figure out what your husband wants. this will be helpful regardless of whether you stay with him or not.

    But, taking care of a young child and keeping house IS a job and it IS work. Any words to the contrary is a mark of ignorance and disrespect. :angry:

  12. The language from the NVC is a bit misleading, here is the full text:

    All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

    The translation must include a statement signed by the translator that states that the:

    • Translation is accurate, and

    • Translator is competent to translate.

    I've bolded the text to highlight to note that they are saying if you are applying for a visa directly at a foreign embassy and the documents are in the language of that country, then no translation is necessary. The key words there being "country in which": meaning DCF.

    If you are sending your documents to the NVC then translations are needed because...well it's not the country in which the application for a visa is being made.

  13. Your GF can file to remove conditions on her CR1 visa on her own, she needs to show that she entered into the marriage with good intentions and they did have a bonafide marriage.

    I do not think he has clarified what visa the gf has enetered on, also see his statement below.

  14. It is my understanding that if you are sending documents to the NVC, then they will need to be translated to English. Please go to the state.gov website for more detailed information. Find your embassy and if your embassy is an appointment post, there is a set of instructions for you to follow.

    If you are fluent (conversant) in both languages, then you can perform the translation yourself and save yourself the money. You'll need:

    1. The original document (or certified copy)

    2. A translation of the document to English

    3. A notarized statement from the translator that says you are fluent in both languages and that the translations is accurate.

    I believe that the only time when it is not necessary to translate documents that are not in English is if you are doing DCF, and the language of that document is in the same language as the embassy.

  15. The answer to your question is, no. And, just to be aware, if you have a job that falls into a technical or scientific field, then you may need to undergo additional security checks after your interview. My husband, who is a chemist, had two months of additional checks.

The Social Security Administration can provide information on how to count qualifying quarters (credits) of work.The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful permanent resident and departs the United States. Divorce does not end the sponsorship obligation.
