Direct flight from Bangkok to LAX, only 15 hrs. Last night was the first night that they were able to sleep so I'm hoping their internal clocks are not calibrated!
Our son has his 1st Dr. appt in a couple hours, he's getting a complete checkup!!

Wife and son finally made it home Thursday evening. Flight landed at 8:30 PM but she did not clear Immigration until midnight. The first two agent she dealt with in immigration were a$holes, she was pi$ed at them. Both were Filipino and they were talking ####### about her in Tagalog, they had no idea that she understands Tagalog, she learned quite a bit when she stayed with me in the Philippines when I worked there.
Long story short, she approached another Immigration Officer and he was very accommodating. When she was leaving the immigration office at LAX, she made a comment to the two Filipino Immigration Officers in Tagalog, they were horrified she could speak Tagalog. Wished I could have seen their faces!! My wife don't take sh!t from anyone, makes me proud!!

We should receive her 10 year Green card soon as well as her Social Security card.

No help for you but we just got ours approved in Thailand, got the call 20 minutes ago. It was expedited and approved in 32 days.

She does not need a waiver- those are for visas, and she is already in the USA.
Why was the AOS sent back?

I have a friend shes been here almost 3 years now and her k3 visa is already expired. They were about to file an adjustment statues but she got pregnant and the immigration said they cant take her medical since shes pregnant they need to wait until the baby will be born.. thats the reason why her visa expired.. she doesnt have any green card or any social security number.. when the baby was born they try to get her medical done to file her adjustment statues but she was breast feeding and they said they cant take her medical because of that.. few months after they try to send the papers for the adjustment statues but they send it back.
Is she consider illegal? will they send her back home? do they need to get an attorney to make it easier?
Please help..
She's an Overstay, will require an I-601 waiver.

Someone posted a comment on the recent news article about our CSC > TSC > CSC ####### we have had to deal with. Rosemary Melville was appointed the director of CSC last summer and I guess she had a "checkered past" with retaliation while at Miami. Here is the comment:
The California Processing Center underwent a change in leadership last year to bring in a corrupt, lazy, manager who was pushed out of Miami after she was caught retaliating against whistleblowers. You can read about Rosemary Melville by doing a google search. She's incompetent and hopefully retires or gets fired soon.
Under her leadership, many US citizens are struggling and all we can do is write our congressmen and hope for the best. My case was moved along after I contacted former managers of the California Processing Center and asked for assistance.
I did some "Googling" of Rosemary Melville pretty much confirming that accusation. This is the person responsible for the nightmare we all had to endure.

Yes, I think London is about a months wait currently, so that's not too bad. It seems the NVC are sending out ridiculous RFE's (see ours), but there is no way to overcome it it seems, other than to abide by their requests. It all seems so very petty after what we have all been through. Being on expedite has not helped us in the least, not at any stage have we been "sped through the system". It's frustrating to say the least.
Maybe those of us who spoke the loudest are now suffering from USCIS payback.................not a conspiracy theorist but wouldn't put it past them. Maybe they will prove me wrong, at least I hope so.
The "system" does not have the same sense of urgency that we do, now if they were in our shoes, what do you think the response would be???

No, I feel like I am being stonewalled after the "tactful" ####### chewing the District Director of my Congressman's office gave me earlier this week.
They have everything they need to either Approve or disapprove the wifes I-601, they have had everything for 12 days now.

We are sooo excited and happy, it was a beautiful day in Bogota (meaning no rain haha) and the woman who interviewed us was one of the nicest people ever. We are so thankful for everything, for all the help my fellow visa journey friends have given us. This was the best anniversary gift ever! It wasn't crowded at all, so we got out of there in less than 3 hours, that is almost record time for the Bogota consulate

Sorry, I'm afraid my answer wasn't clear. This thread is about a petition already approved and sent back to USCIS from a Consulate, so it was a NOIR. Your NOID was for a petition not yet approved, so the decision to approve or deny the petition WAS still entirely up to USCIS. There was nothing to "revoke" yet.
Thanks for clearing that up pushbrk, after all these years reading your post I should know better than to question them.

In a visa case, it's a NOIR, "Notice of Intent to Revoke" Notices of intent to deny are for adjusting status or other decisions where USCIS can approve or deny. USCIS doesn't approve or deny visas.
Has that changed the past few years?
We received a NOID in 2008 for a K-1 due to a missing divorce decree, I'm looking at it right now.

Use the FPO, they'll figure it out. Your active duty military, they should be able to put 1 + 1 together............

some answers you may or may not like:
1) the director at CSC was replaced in August.
2) they made budget cuts at the end of the government fiscal year (or right at the start of the 4th quarter fiscal year (August).
3) CSC DOES work 2 shifts.
4) CSC has 700 employees plus 400 contractors.
5) k-1 is only 1% of ALL applications received in a month for ALL Service centers. 5,000 per month out of 500,000.
6) CSC focus is to process i-129 (h-1,H-2) visas in 2 months.
7) CSC recently added more workers to the family line backlog during and after the annual Febraury meeting with the Director over the service centers.
8) Based on november projections, without adding more staff, they would have been behind by a year in approvals.
9) CSC attempted to transfer 35,000 i-130 applications to TSC for work. This transfer failed miserably. These applications are now being processed back at CSC.
10) there are 3 units at the CSC. I-129F goes to the family unit. (with I-130)
This is all research from the internet. Most of the facts are from the Jan 26, 2011 meeting at CSC in which I-129 lawyers were taken on a tour of CSC.

Additional general information from the CSC tour: CSC is the only USCIS service center housed completely within one facility ("under one roof"). Approximately 700 federal employees and 400 contractor ("Stanley SCOSS") employees comprise the CSC workforce, and the center operates two shifts. CSC receives approximately $32 million in fees each month and processes about 60,000 to 80,000 applications and petitions per month. All denials are reviewed by a supervisor.
Amazing that they can approve an H-1B in two months and typically this includes a spouse/family. But for a USC to file to get their spouse here, it can take over a year?? Why does a USC get crapped on??

Just a rant and a warning folks...most of us are sending documents overseas for our visa interviews.After 6 months I had finally cleared my Noa 2 and NVC...our interview is scheduled for April 5....I ship 24 ounces of papers to Ukraine and pay United Parcel Service $170 to get it there in 4 days. I have a week but wanted to be safe. They of course promptly "lose" the package and amazingly refuse to search for it until 1 day after the package was to have arrived. I finally drive to the regional hub and demand a search..and after 15 minutes out it comes..It was 5 days and never left the city!!!...UPS offered no help to expedite the documents inspite of my pleas for help and were in fact quite rude. So a week later I sit with my papers...and have emailed Rita to cancel out interview and we start again. Federal Express or the United States Postal service which uses Federal Express...This is too important to give your life to people who do not care...Now we will probably miss spending Easter together.
USPS via FedEx is MUCH cheaper.......................
