    My wife's extension letter expires in June 22nd. We've taken an info pass appointment for today to get her passport stamped. According to my wife, the officer first stamps her passport but then he gets up to ask something to his supervisor... He comes back and he says he cannot stamp her passport. Then he crosses the stamp with a pen and says "you still got time till 22nd, come back on 22nd or after..." 

    We were told by a lawyer that we can do this a month prior ext. letter expires... We are kind of confused now. Not that she desperately needs to travel overseas but we thought it would be nice to have it incase...

     
    Just wondering if anyone else has experienced something similar...

  3. Hello,

    I just need some opinion on this. I filed I130 for my wife back in September along with I485, AP and stuff. I'm a PR and this was an F2A application during that time when the Visas were current. The receipt date was September 26 2013; however the Priority Date was set to SEP0813 and has not changed till now (Visa Bulletin for April 2014) We were still scheduled for an interview and it went well, we were told by the IO that our application is approved as soon as visas are available, my wife would receive her conditional GC. Because we missed the Priority Date for F2A by 18 days.

    Today I received a letter from USCIS that my petition for alien relative (I130) is approved.

    What does that mean?? Does this mean my wife is getting her conditional GC even though Priority Date hasn't been moved on??

    Does anyone have an opinion?

  4. Hi. We took advantage of F2A filing during the current period of September 26, 2013 for my wife, she was on F1. Now we have an interview this Thursday, 27th. Now we learned that PD has been set on SEP8, 2013. Any idea when PD could move forward?? Any predictions?

    She also has AP, can she travel after the interview even though it's for emergency purposes? We just want to go to our country to have a wedding??

  5. Hello. I got married with my girlfriend who was an F1 student, in September 10, 2013. We applied for her AOS on 24th of September while she is still in school. She got her work permit and AP in mid December, 2013. We haven't been scheduled for GC interview but on USCIS site we have;

    Your I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS is now ready for interview scheduling. When scheduling is complete, you will receive a notice with a time and place for your interview. as status, assuming we'll be getting the interview date very soon. My question is; would she jeopardize her F1 if she didn't take any classes this semester (spring)? We just don't want to pay International student tuition and wait till she receives her GC to go back to school...

    Any ideas??

  6. At the time you are filling your status will still be F1 right? If so put down "F1 visa holder".

    If you write this down after your F1 expires then I would put: F1 out of status.

    Just do it while you're still under F1 though, and you can always tell them at the interview that you went out of status during the AOS process.

  7. When I went to the local USCIS office several weeks ago, I was told that the application package must be postmarked on the 31st of July in order to get the old fee rate. But I got an email from visajourney.com today that 30th was the last day to send the applications in order to get the old rate. I haven't sent my applications yet, was hoping to do it 31st. Does anybody have an idea? Thanks...

  8. Hi. We got married almost 2 months ago here in US. My wife and I are trying to fill up the forms but we need some help. My is wife US Citizen, here income was $25,540 in 2006. However she has 2 cute daughters (not from me) and she has their custody. Finally, we have a total of 4 in our household. The poverty line for 2007 for 4 people is $25,812. There is less than $300 between her income last year and this year's poverty line for 4 people.

    -Should we find a joint sponsor for the remaining amount since she does not have any assets? or

    -Should we fill it as is? Is USCIS so picky about the amounts?

    My second question is, in form I-130 - section D/22 says;

    22. Complete the information below if your relative is in the United States and will apply for adjustment of status.

    Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at USCIS office in: _________________________________ .

    Obviously, we'll apply AOS in US and we live in San Antonio. There is an USCIS office here. Is it where we are supposed to apply for my AOS?

    I'd appreciate if anyone could answer these...

  9. Thanks a lot. I asked somebody that has gone through the same process like me and chose the first choice. He said the application was fine, never sent back for re-adjustment. Well, tanks for your help again.

    I'm copying something else that I found, below. I read a few more articles, and from what I have gathered, it does not appear as though an F-1 OPT EAD, can be renewed. It is only valid for 12 months, and that's it. It can not be extended or renewed beyond that period.

    It definately looks like you will have to choose the first choice, and for the I-765, it will be a new EAD, and not a renewal,.................based on your I-485 application.

    Chat User : How many times can I renew my EAD cards? Is there any restriction?

    Attorney Murthy : There is no limit on how many times one may renew the EAD based on having filed an I-485 application. If the EAD is based on the F-1 OPT, then the CIS cannot approve it beyond the maximum one-year timeframe allowed under law with each degree program.

    Research the issue more, if you'd like. There seems to be quite a bit of info, if you do a "Google" search.

  10. Hi. I hope somebody can help me. I got married in February, 2007 and my OPT (optional practical training) expired in February, too. I'm in grace period now, till 16th of April. I would like to send the forms ASAP but I'm a little confused. Since I applied for EAD before, I already have Employment Authorization Card and A#. So, when filing I-765 which one shoud I choose?

    -Permission to accept employment, or

    -Renewal of my permission to accept employment (attach a copy of your previous Employment

    Authorization Document).

    Finally, what whould be proper answer under Eligibility Categories? Is my case a special one since I got married in US? Is there anybody else like me? HELP!!
