    My wife is a similar situation to yours.

    She was here on a tourist visa, we got married, filed the  i-130 and i-485 simultaneously. She had to go back to her home country and her advance parole expired. The case was moved to a local office and then back to National Benefits center after we asked for an interview reschedule while we figure out if there was any way for her to get back into the country.

    Anyway. We will have to go through consular processing. I wanted to ask you how did you get NBC to approve your i-130? Because from what I've seen when you file the i-130 and i-485 together they send both files to the local office and the i-130 is approved in the local office with the i-485 after the interview.  I was wondering if you know how I can ask NBC to approve my i-30 and not send it to a local office so I can then have it transferred to NVC for consular processing.

    I also see you had an interview for i-130 ? I have  never heard of this happening before were there special cirsumstances?

    I would really appreciate your help since i don't know any people in a similar situation.

      Hello there,

       

      Due to a family emergency along with Hurricane Maria destruction, we left Puerto Rico. Since there was no way of communicating (no power, no water either) we decided to head to Mexico while things got better in the island. 

      We were misinformed and left without requesting advance parole. We were in Mexico for about 2 weeks. When we came back she was detained in Ft Lauderdale and her tourist visa got cancelled. She had to fly back to Mexico and wait for her process to conclude. I called USCIS and explained what happened and told them we had filed an adjustment of status. They told me that since she was no longer in the US the i485 would be deemed abandoned. However, the i130 would continue. It went from a 1 step process to a 2 step process. I didn't have to ask them to transfer it to another office. National Benefits Center handled it. 

      Interviews for i130s are done sometimes. In my case I think it was because of what happened. I went alone as the petitioner. My wife was in Mexico and had no way of leaving the country because she no longer had her tourist visa. They explained that since she had intent of staying she was no longer considered a tourist. I prepared really well and got approved at the local office in Puerto Rico. They sent the approved case to the National visa center (NVC) and the consular process began. 

      They didn't forward it as soon as they had to, so I requested my case to be expedited and got approved. I then travelled to Ciudad Juarez in Mexico with my wife and she went to the interview and got her residency approved. 

      It took about 2 years from start to finish. Without the expedited processing it would've taken us longer.
