I am sponsoring my wife for a CR1 - our I-130 was approved late March and we started NVC processing in early May.
June 10 - NVC says I am not qualified to use the I-864EZ. THe I-864EZ instructions clearly states:
“You may use Form I-864EZ if ALL of the following conditions apply:
1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on Form I-130; and
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more IRS Form W-2s provided by your employers or former employers.”
In response to these conditions:
1. I am the petitioner and sponsor, who filed Form I-130 for my wife, the sponsored immigrant;
2. My wife, the sponsored immigrant, is the only person listed on the approved Form I-130;
3. I am using my own earned income, based entirely on my salary which is documented on a 2018 IRS Form W-2 issued by my current employer.
Nevertheless, I completed a Form I-864 and submit it the same day.
Today, NVC reviews my case again: NVC says I do not meet the minimum income requirements to sponsor my wife and request that I submit proof of employment
Under the I-864P, 2019 HHS Poverty Guidelines for Affidavit of Support for a household size of 2, the requirement income is $21,137. I made 85k in 2018, and about 60k in 2017 and 2016.
I just download copies of my paystubs for the past 2 months to submit to NVC.
I cannot complete how ridiculous NVC is. Calling the NVC is a waste of time, because the representative can't do anything. I have requested to speak with a supervisor several time but each time; they are busy.
Sorry for ranting, but I have to get this off my chest.
