Hi Lancelot, I just got our ASC appt notice today (but dated 8/3/07) just over 2 weeks after sending in our AOS stack...and still no NOA1...or is this notice considered the NOA1 and the appt date (8/31) the date used for the Biometrics column? also cant access my case status either based on the app recpt #'s on the ASC notice... Does anyone know how to find the received date other than calling USCIS?

    Icarus, very interesting. You're the second person this has happened to recently. Just a week ago or so, there was another filer in this thread who received their biometrics appointment notice firs. Not sure if they've since received their NOA1.

    Your ASC notice is NOT your NOA1. You should receive a separate NOA1 for your I-485 filing.

    Your biometric date is 8/31/07 and I've updated your info in our timeline below.

    We sent out the package on 07/16/07. The biometric appointment is scheduled for 08/17/07.We got it in mail yesterday. Where is NOA1?

    RECEIVED $275 FOR FORM 1-751 AND BIOMETRICS

    Your conditional resident status is extended for a period of one year from date of expiration on your Form 1-55 1. conditional resident card. During the one-year extension you are authorized employment and travel.

    In order to further process your petition, you will be receiving a biometric appointment notice with a specific time, date, and location to capture your fingerprints, photo and signature. You MUST wait for your appointment notice before going to the Application Support Center (ASC) for biometric processing.

    Please Note: Conditional residents who are residing overseas pursuant to military or official government orders will not receive an ASC appointment notice. However, you must send two passport-style photographs.

    If you have not already done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence. Please include a copy of this receipt notice with any supporting documents you submit. Such evidence may include, but is not limited to, the following items:

    • Lease of joint tenancy

    • Joint mortgage agreement and/or property deed

    • Joint ownership of assets

    • Tax returns

    • Birth certificate(s) of any child(ren) born from the marriage

    • Joint policies of life, medical, and/or car insurance

    the above letter...Is that what you call a Required For Evidence Letter ???.....

    here are what we submit in our I-751 package:

    - Photocopies of the Passport and Green Card of Immigrant Spouse.

    - Photocopies of our Identification Cards.

    - Transcripts of our Joint U.S. Income Tax for the year 2004, 2005 and 2006.

    - Partial copy of our 2006 State Income Tax.

    - Letter from our Bank of America confirming about our joint accounts.

    - Letter from our Dental Insurance and Dental Statements.

    - Letter form our Medical Insurance showing joint coverage.

    - Cable utility bills from Comcast showing joint accounts.

    - Cell phone bill from T-Mobile showing joint accounts.

    - Three letters written by U.S. citizen friends, attesting to our relationship and marriage.

    - Photocopies of our debit cards Bank of America

    - Photocopies of our joint American Express, MBNA credit cards.

    - Photocopies of our Costco Membership Cards.

    - Photocopies of our Health and Fitness Gym Membership cards.

    - Photo of us happily together.

    ....we dont have any Joint Mortgages or property deeds because we are staying in my mothers condo..helping us out to save some money to buy our own house..we dont have any children yet...we are planning that for next year...

    May 22, 2007 - Mail I-751 Package

    May 30, 2007 - Check for $275.00 cleared

    June 2, 2007 - Blue Receipt Notification

    June 11, 2007 - Notice of Action letter (see above letter)

    No it's not. It's your receipt and 12 months extention letter.

  3. No, I don't carry the card on me always. And no, I am not breaking any laws. The way my attorney had this interpreted to me was that if the card is not physically on me, then I must know where it is at all times (which I do). And where did you get the info that being caught without your GC on you is punishable with jailtime? I have NEVER heard that before. Quote the source of your information (if you have it) and then I will believe you and your friend. Even in the very unlikely scenario that I'm arrested for not having my card on me, what's the worst that can happen? I get charged with unlawful presence -> I go home same day on bail (or get my family to bring my GC) -> I face the judge -> I produce proof of lawful residence -> case dismissed -> officers look stupid.

    So, what if I don't have an ID on me at your hypothetical road block? Does that make me the criminal they're searching for? I stand by my earlier statement: Not having an ID on you is NOT a criminal offense. At least not yet. Ask a lawyer if you want. The situation at or near the border, however, is totally different. Don't mix them together. At the border, even USCs have to their passport or birthcert with a picture ID. EVERYONE (not just LPRs) hanging around the border has to prove s/he's got a legitimate right or permission to enter the country before the BP will let him/her in.

Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both. "

    Sure, you can ignore this and get arrested and maybe a spend a night in jail only to be released right afterward and that experience will look great on your resume when it's time apply for citizenship. Maybe it's time to find a new attorney?

    Thank you all for replying. I just received my card in a mail. The only thing I would like to say that I could be overwhelmed at the time I called Customer Service but I didn’t loose my common cense and was extremely polite. If you’re in customer service you should be ready that even you don’t like something about the customer or you having a bad hair day you can’t show it off. Can you imagine going to your bank with some questions about something you don’t understand and your banker raising the voice just because you don’t get his explanations the first time? I bet you will never come back to that bank. The difference with USCIS Customer Service is that we don’t have any other place to call with our questions. Even if the customer asking stupid questions your job as a customer service representative is to give the customer the correct answers and educate the person without showing any expression of anger. Why in the grocery store any associate is required to walk you to the alley with the product you asked for not making comments that the customer can’t read or raising the voice even that every alley has signs with what’s in it. Why sometimes the USCIS Customer Service is what any American would find unacceptable?

    Everybody has his own opinion and I respect it. But just think of what I wrote above. Would you come back to that Bank or Grocery store?

    For those of you who have been through the process and required an interview to remove the conditions of permanent residence, when did you get the interview notice. We are now at the point where we have received out biometrics notice, and my wife is going to day in fact to get her biometrics. I'm just wondering if we may still get an interview notice, or if we would have gotten that before the biometrics?

    We submitted our I-751 in April, 2006. Some time in November of 2006 as soon my case happened to be outside of the processing dates I call Customer Service and made a request. About a month later we received a letter stating that our case had been randomly chosen for an interview and they were awaiting for scheduling from our local office. During the next 4 months I called a few times and made 2 or 3 requests. In the beginning of March, 2007 we received RFE. That was a big surprise! All the evidences we sent in April of 2006 didn’t fit in a regular envelop and we had to do a special sipping package (2 binders). It took about a month to put everything together and we sent a new package. My 12 months extension expired on April 21 of 2007. So, I made an INFO PASS appointment and drove to our local office (which is 4 hours away) to get my passport stamped on April 23 of this year. While being there I made a request on my case status but the lady who stamped my passport didn’t have any further information. So many people suggest scheduling an INFO PASS appointment to get an update on a case status. I just have to say that I would be very mad if I drove 8 hours to hear what I was told (nothing!!!!!!!) It wasn’t so bad for me because it wasn’t my main reason to go there. Two weeks late we received an interview invitation, which was conducted on May 23.

After waiting 13 months for I-751 approval, receiving RFE after 11 months of waiting and going through the second interview even after we sent a huge binder with all kind of proofs both times I probably panicking for no reason. We had our interview on May 23. The officer told us that I was supposed to get my welcome notice and a 10-year green card in a few days. I was told that if I don’t get it in 1 month I have to call customer service. I couldn’t wait another two weeks and called yesterday. The person I spoke to wasn’t nice to me at all. She was furious when I tolled her the reason I called. According to her some people don’t ever get their card in a mail. She asked me for a numbers from my passport’s stamp and of course I didn’t have it since I keep my passport in a bank lockbox. Her reaction was kind of abnormal again. She was speaking with me in a higher voice tone and told me that I have to have my passport on me all the time!!!!!!!!!!!!!!!!!!!!!!!!!! As of today I haven’t received anything. Do you think it’s normal?

    Am I just paranoid?

    Our I-751 was approved yesterday during the interview we were called for. We had to wait 13 months for this to happen.

    The interview itself wasn’t a big deal. We got sworn and had to answer some questions what our names, birthdays, residence were. Some questions about how we met, where do we work and why we still don’t have children.

    Basically it was exact copy of the first interview besides we weren’t asked for any evidences. We brought TWO HUGE binders of different proofs with us. The officer didn’t look at any of them.

    I just want to share my happiness with you all-after months' waiting, VSC approved my I-751!

    Here is my timeline:

    11/24/06: sent in I-751 to VSC

    11/27/06: VSC received my package

    12/3/06: check cashed (I cannot remember the exact date, but it is roughly around 12/3)

    12/21/06: NOA1 received

    1/5/07: Biometrics notice recieved

    1/22/07: Biometrics taken

    5/24/07: I-751 approved, 10-year green card production ordered by VSC

    It's been a real nice experience here with you all. Thanks for all the info!

For those of you who got RFE'd and sent back the info they requested, did you get any kind of receipt or NOA from them or did you just sit back and wait for either your greencard or letter to make an appointment or whatever? I sent them the RFE'd info they requested about a month ago and have had no letter or email from them. As a matter of fact I have had no emails from Case Status at all since my application to remove conditions, I got the Receipt and NOA in the mail and did my biometrics and then got the RFE but nothing on my case status has changed since they recieved the application. I didn't even get an email telling me I'd been RFE'd. Any helpful info would be appreciated. Thanks, Lindy

    I think they don’t send you any kind of receipt. In our case we received a letter less then in two weeks after we sent RFE to TSC saying that our case was moved to the local office.

  9. My wife (USC) and I filed our I-751 in October last year (at the Texas Service Center, we are in Houston) As I posted a few weeks ago, about a month ago we rec'd an RFE. We are in the process of putting all the ####### together AGAIN, but I am feeling that no matter what I send them, we are going to get called for an interview regardless. 2 things: does anyone/everyone agree with that assumption and 2) Does anybody know of anyone who has actually been denied and/or deported at this final hurdle?

    I saw one experience posted on skyweb. The couple received the letter that their case was chosen for an interview but a few months later they received an approval letter without any interview. But that’s only one time I saw people not being called for an interview after such a letter. All the cases that I know were denied were based on some kind of waiver. One experience I saw posted somewhere was telling a story of a denial after the interview. The couple was separated for questioning and they had some discrepancies in some answers.

  10. When my husband and I did our AOS in 2003 we did consider my income even though I was a beneficiary on our petition. It did work fine. Our combined income still was below poverty line but we were able to show that we had the difference amount* 5 times in some assets. That’s what I was about to say to my friend but I wanted to hear it from somebody else before I do it. I don’t want him to blame me in giving him wrong information if something doesn’t work for him.

Now is a time to do his AOS. Their joint income with his wife meets the poverty line criteria but just his wife's doesn't. Can he include his income into household income to meet minimum criteria?

    Yes, he works. He has a full time job.

    I don't think that he has gotten his work authorization yet…………

  14. Hi, everybody!

    My friend recently got married and now this is a time to do AOS. They live with his wife’s mother and don’t have a lease agreement or mortgage in their names. To prove that they’re living together they need at least a letter from the mother. I saw somebody mentioning that they had to do the same thing. Can anybody to help with the style of this letter? Please, if somebody has the same situation, share your experience how it worked at the interview. Was there any problem that they didn’t have a place in their names?
