    Obviously Lawyer territory.

My understanding is that normally the asylum claim would need to be resolved first.

Since the asylum is "Administratively Closed", I thought that would allow me to proceed with the I-485 process. And also, wouldn't they have sent me a letter saying that I would need to resolve the asylum case first instead of giving me a notice saying "Interview Ready to be Scheduled"?

  2. Hi all, I hope someone very knowledgeable can help me on this. My status for I-485 through marriage is currently just waiting for an Interview to be scheduled but it's been over a year now since they declared "Interview Ready to be Scheduled" and I'm still waiting. My brother just got his US citizenship recently and he is trying to sponsor my parents but according to a lawyer they talked to, they might need to reopen our family's asylum case which has been "Closed Administratively" since Obama's administration. My name is on that case and I am wondering if by reopening the case, my I-485 through marriage will be effected or is it because of the asylum case that I'm stalled for an interview. I have not gotten any letters explaining if there's any thing that's really blocking my interview from the USCIS. Please help me if anyone know anything regarding this, thank you!

You don't, but if you leave the US you abandon your asylum claim, so you cannot work when you come back. If you apply for a combo card, you switch from working on your asylum EAD to working on your AOS EAD. These cards are in different categories, and are not interchangeable.

The application for both I-131 and I-765 is free for you assuming you have your NOA1 from I-485.

So do you advise for me to first apply for I-486 and reapply for I-765, then wait for NOA1 before applying for I-131?

  4. Hello,

I'm in the process of submitting my AOS through spouse, we just got married recently. I already have EAD card through pending asylum case that my parents submitted a while back and it doesn't have validation to reenter the US. If I want to apply for I-131 advance parole so I can travel outside the US and come back, do I need to reapply for I-765?

    Thank you!
