    Well, I would like to know ahead of time what my wife would have to do to prove that she will be covered by health insurance within 30 days of entering the US... and if me having a health insurance plan through the marketplace would be acceptable for her, for immigration purposes. I know I’m thinking ahead here, but I have plenty of evidence to give if I’m asked for more evidence of a bona fide marriage. I went to Ghana six times in the last two years, and we have plenty of photos together and with members of her family, plus I have plenty of receipts from money I’ve wired her... and not a day goes by where we don’t talk...

    I thought it still might be good to know these things, especially if it does come into law anytime soon.   3. Hi. First let me start off by saying that my wife got denied for her CR1 Visa on September 30th (from the US Embassy in Ghana), and our case is undergoing a consular return. Anyway, my question is, when my wife finally does get approved for her visa, what does she need to do in order to prove that she will be covered by Health Insurance within 30 days of entering the US??? If I have to cover her under my plan, I have my plan through the marketplace (the healthcare site). Is that an acceptable form of health insurance for immigration purposes? If not, then what is??? Thank you...

  4. Hello. Does anyone have an example of an affidavit or letter, that would be written by a family member or a friend, in support of a bona fide marriage? Maybe a screenshot, a picture, or a description of the format that such a letter should be written? My case is undergoing a consular return (CR1 Spouse Visa was denied September 30th), and I was told that they may request more evidence of a bona fide marriage later on. Thanks...

    The validity of the police certificates depends on how long the reaffirmation takes.  Police certificates expire just like the medical, so all you can do at this point is wait and see how the process of reaffirmation goes.  If it's fast, you may not need new police certificates.  If it is long, you will need new ones.  Wait and hope for the best, the process is long and takes a lot of patience.  Good luck!

    Hi. I know the Police Certificates from my wife’s home country, Ghana, will expire... but my question was, “Will her International Police Certificates expire?” My wife lived in China for one year, seven years ago, so they asked her for a China Police Certificate and they kept it without giving it back. My wife hasn’t been back to China since she lived there seven years ago, so I would hope that the China Police Certificate would never expire, unless she went back to China (which she hasn’t). It took a very long time and cost a lot to get this China Police Certificate...

    Hi. If our case gets reaffirmed, will they also want the International Police Clearance from my wife (again), at her interview?!? My wife is from Ghana, but she lived in China for one year (about seven years ago), so they asked her for a China Police Clearance and they kept it without giving it back. Will the China Police Clearance still be on file, or will they ask for a new one? I mean, my wife never returned to China since she left seven years ago. It was also extremely difficult and costly to get this China Police Clearance. Thanks!

    The case after being returned takes about 6 months before the USC will here what the issues were

    Then she is given a time period to respond to those issues to prove them wrong

    If she can't or doesn't , the application is revoked (guess that is the right word)

    If she does and it is sent back to the embassy,   she will have to do a new affidavit of support (as that will happen late next year) 

    so her 2019 IRS tax returns will be due and needed for the new interview

    and you will do a new medical exam

     

    meanwhile do a timeline on this site so we can know what stage of the process you are in at present to help the VJ community help u

    you have a long wait and probably many questions

    there are experienced people here to answer them 

    but the one we all can not tell anyone is "how long will this take?"

    Hello. I am the petitioner, and this is my wife I am talking about. My wife got denied on September 30th (just last month), and our case is being sent back to the States. You said that I may have to do a new Affidavit of Support, if our case gets reaffirmed. Will the Petition and the Immigrant Visa Application need to be done again, too, or ‘only’ the Affidavit of Support? Thank you.

    The answer is YES. They will send you a piece of mail, also called a letter, through the post office, that is going to be delivered to you, the petitioner. In that letter, they will list the reasons why they think this petition should be revoked. You, then have around 30 days (or whatever date they specifies in that letter) to respond to the letter, providing your evidence that will counter their reasons to revoke, point by point. Yes, you need to send your response and evidence also by post office mail, back to USCIS. If your response satisfies USCIS, they will send the petition back to the Consulate/Embassy for another interview. If not, your petition will be revoked.

    Wasn’t trying to test your patient, but I get it now. I knew that I will receive a letter, but didn’t know if I would have to respond by sending them back a letter. Now I know. Thanks.

    How will they ask you to submit new evidence once that happens? Online?

    We met in one country, got married in a second, lived in a third and now live in the US.  Overall it was a pretty easy process to follow and we had zero issues despite having some red flags.

     

    Zero issues despite having some red flags? You must have gotten very lucky then. It is amazing how you met in one country, got married in a second, lived in a third, and now live in the US. How long ago did you do the whole US Spouse Visa process?!?

    And..... when it comes to immigration don’t rely on others always check with the source material yourself - in this case the tax codes - reading the filing instructions would have told you this. 

    Yes, well reading the filing instructions can sometimes be very complicated. How do they expect the average person to be able to understand all the instructions (or even have time to read them all)?

    You might want to investigate the options you have with moving to Ghana. 

    I don’t know why she got denied, we weren’t given a reason. The 221(g) just said our case will be sent back to NVC & USCIS. I feel like I was done a huge injustice here, I only want to have my wife here with me. I don’t see why she’d be inadmissible, she’s not a criminal, and never even been convicted of the most minor offense. I wrote the US Embassy in Ghana, without response yet, and wrote my local Congress man... but I guess that’s the best I can do for now.

    I agree to disagree on that one, because I do think childhood pictures and medical records can make good add-ons to evidence that you say does prove a bona fide Marriage (such as airline tickets, chats, etc.)... no harm in also bringing a couple childhood pictures of your spouse and medical records (if you can explain about them and what they mean, etc.), on top of other bona fide evidence!

I fail to see how that would add anything to proving the validity of your marriage. Your medical records are also never required in the process nor do they prove any marriage validity either

    Chats aren’t required either, but people bring them... same thing with copies of airline tickets, etc.

Once it is sent back to the NVC, you have to wait for the full NVc -> USCIS -> reaffirmed (with our without a NOIR -> response step) -> sent to NVC -> sent to consulate -> new interview, medical, etc. process.

    If I send an email to the Embassy when it says not to, don’t you think I Can risk making them mad and getting a permanent denial (and have to start the process again from scratch)?!?
