  1. Nate:

I've gone through the same thing as you, not wanting to let go. I've come a loooooong way.

I have filed for an annulment based on fraud and am currently waiting for him to respond. Keeping my fingers crossed he doesn't. I did need to get an attorney because regardless if he responds or doesn't I still have to go infront of a judge and prove my case of fraud. As my attorney put it, "as long as you have witnesses that he personally talked to and told them he was using you for his papers, that is all the proof you need." They just need to be willing to come into court and testify on your behalf. If he doesn't respond or show up, I still have to take someone to testify. If he does respond and show up in court I have to take many witnesses to prove my case.

Of note, when I filed my papers, I marked annulment of marriage based on fraud and also marked that in the case of annulment not being granted, requesting dissolution of marriage. This way I don't have to go back through the whole process if for some reason the judge has a soft spot for the ex and doesn't grant me annulment based on fraud.

Good luck to you and act quickly.

  2. Thanks dvddvd!

I hope someone can help me. My fiancee, at the time, got his Visa approved and came to the U.S. in October 2007. We got married since and now that he has been working, we would like to bring his two children (boys) over. I emailed the embassy in Honduras and got an appointment for them, since the case is still open. My question is, Do I need to resubmit my taxes, evidence of relationship, I-134 Affividavit of support again, letter from employer?

Anyone who knows, I'd really appreciate the help. Thank you in advance!

    Michelle.

i don't know specifics about honduras, but for my wife's child following from thailand - we started at the packet 3 stage. we resubmitted everything packet 3 requires (I-134, evidence, letter from employer, medical, etc.) and waited for the interview date.

    hope this helps some

  4. If you go on the SS website www.ssa.gov , it clearly states that with the I-94 you can get a SS#. You can print it and go again to show them. See below:

    Immigration status

To prove your U.S. immigration status, you must show us the current U.S. immigration document, I-94, Arrival/Departure Record, issued to you when you arrived in the United States. If you are an F-1 or M-1 student, you also must show us your I-20, Certificate of Eligibility for Nonimmigrant Student Status. If you are a J-1 or J-2 exchange visitor, you must show us your DS-2019, Certificate of Eligibility for Exchange Visitor Status.

Also, because there is a change of residence, you can automatically get a driver's license in your state. If you were to be pulled over by the police you could get a ticket for not having a valid driver's license.

    Good Luck.

  5. sent ours in yesterday and was guaranteed to arrive today by noon! but now i realized i made a mistake.... only sent two photos instead of six. will we get an RFE or more disaster?! :(:( :(

I sent 4 photos. I was confused about the whole photo thing. I'll guess we'll soon find out! Can anyone shed light on how many photos you are suppose to send?

From my understanding you need 2 for the AOS, 2 for the EAD, and 2 for the AP. We only filed AOS and EAD so we only sent a total of 4.

Ok, I'm good then. I only did EAD & AOS.

  6. hello everyone...well just got some news form my senators office....i guess my husband has been in FBI clearance this WHOLE time...something about that just is not right..so then it is going to be transferd to another office to continue the process....but for the other office to retrieve the file it can take up to 2 weeks??? does this make sense??? are we soon done???

    Nannygirl:

I'm so sorry to hear that it's going under an FBI clearance. I had that with my fiance at the time and it took 9 weeks! to finally get the clearance and they kept stringing us along to call in 2 days, 2 weeks, 1 week, and so on. Hang in there. When you least expect it, you'll get the clearance. The problem is that there is someone else with the same name and possibly date of birth and they have to investigate it.

Good Luck and hang in there!

  7. hi guys! we successfully get thru talking to a customer representative on csc. we were approved june 22nd. but if we check online, our case is still received and pending. we already have 4 touches so were really suspecting that we were approved. and we are right, we were approved right after the first touch.

so for those who got many touches and haven't received the approval yet, i suggest that you call the csc and talk to a representative.

    we are very happy

now, we're in the next step...at least we are getting closer :)

may I ask what is the CSC telephone number? is that the seam 1-800-375-5283 or something different?

Yes that is the number. The same thing happened to me where the computer is not updated, but had been approved, apparently, June 13th!. Good Luck!

Another way to find out, if after being approved by CSC, if your file has been received by NVC is call NVC at 603-334-0700. Prompts 1-1-1-4-1 and enter your CSC receipt number.

  8. I called CSC today and I found out that I have been approved since June 13th!!!!! and my file was sent to NVC on 6/27/07. I have the same problem as you guys.... on the website it is not updated, nor have I received a letter or email. I asked why and they guy that answered me said that they are having computer problems and the letters are not going out. He said he reset it so that a letter is sent to me telling me it is approved.

Sooooo.... if you were in the same boat at me, I suggest you call and go through the prompts as though you had received and RFE and ask what the status is. When I called I said I hadn't heard anything as was worried if they had sent me an RFE and I just didn't receive it and luckily it worked.

Good luck to you all and I hope you all are approved and don't even know it, just like me.

Congratulations to those that have gotten NOA2s and have gone furthermore.. I am happy for you guys.. but I am so sad right now..and for each day that I don't see any changes..

You still didn't recieve anything from CSC??? Did you call them?

  9. I thought I would start a fresh thread for the March filers. I'm a March 1 NOA1!!!! Good luck all!!!

Well I sent my info in on March 27, 2007. I got my receipt notice, but how long is this going to take I hope my finace' is over her by Christmas.....and also how does the processing steps work for the I-129f....I think that has me confused the most.

    Thanks....and Good luck everyone!!!

After you get your first receipt notice (NOA1), you get to wait for around 3 months until you get your first approval (NOA2) or RFE (Request for more evidence). Even with an RFE, you will submit the required missing evidence and then get your NOA2 from CSC. After you get your NOA2, which should be soon for you, the case is sent to the NVC (National Visa Center) for additional screening. After this process the application is then forwarded off to the embassy in the beneficiaries country. The time from NOA2 to the consulate receiving the package, is usually 3-4 weeks. One they receive it, you can make an appointment for your interview. In this time, the beneficiary will need to get a medical exam and procure all the paperwork the embassy requires, a list of which which I am sure can be found on their website. This final process take anywhere from a few weeks to a few months, and it looks like the Bahamas is very fast. In all likelihood, your fiance will be here for Christmas, probably long before Thanksgiving. Good luck and I would suggest filling in your timeline, it helps all of us here to be able to follow it.

How long on average does NVC take?

The NVC is taking a while for some right now, but in general it takes about a week to get from the service center, after the NOA2, to the NVC. They process it for a couple of days typically, and then they send it to the appropriate embassy which can take from a few days to a few weeks. It's best to look at the NVC time as from the day you get the NOA2 until the embassy actually receives the package so you can set an interview appointment. This total time is usually 3-4 weeks or so. The final stage, the interview, depends on how quick you can get the paperwork (police cert, translated docs, financials, 156 forms, and medical exam) done, and how fast your embassy is. You can check here: http://travel.state.gov/visa/temp/wait/tempvisitors_wait.php You can usually get everything together, except the medical, while you are waiting for your paperwork to get to the embassy, thereby cutting down the total time to visa.

Deron: Thanks for that website. It was very helpful. I always wanted to know how long it was going to take for my fiance to get an appointment, once he gets his appointment in Honduras. Thanks for the info! Now, I need to wait to get approved, darn it!
