My brother & Sister in Law brought got a visa for her (mexican) son to come to the US but before they could get the visa teh Blood father had to go to atlanta and sign a form (I assume signing over parental rights to the mom so that the mom could bring him here leagally in her name) does anyone know if that is correct if the father has to go sign over rights to the mother and the petitioner before the child can be brought in under the mom's name? Now that the child is in the states the blood father wants child support and visitation rights but he has never met the child and is a horrible father and the boy is scared of him. Please help!

  2. my brother filled out a I130 on his step son (a minor) my brother is a US Citizen by birth, the step son is living in Mexico. My brother had to go to the Dept of Homeland Security in Atlanta on behlaf of this petition and answer some questions and such. He received a letter later from the Dept of Homeland saying it was a "Notice of Approval of Relative Immigrant Visa Petition" with an approval date and file # on the form but the only box check on the form was the last one that said: "Remarks: Your petition will be retained in the permanent file". Then they received a letter from USCIS saying the I130 was approved and sent to the NVC...........NVC said they never received so they sent out a search for the forms and contacted us that "The petition is located at the USCIS office in National Records Center. The petition was consolidated into A File (gave file #) and to please contact USCIS for more info. I contacted USCIS they just say the petition is still pending but they have been saying that since the beginning even when the petition was lost. What in the heck is the procedure and has anyone else had anything else like this happen?

  3. My brother (a US Citizen by birth) and his wife (Green card holder from Mexico) are petitioning for her son to come live in the US with them...the son is 10 years old. The father of the son has signed away his rights for the boy b/c the father also lives in the US illegally. They have the proof that he signed away his rights. They have hired a lawyer to do all the paperwork and all and now have an apt in CDJ Mexico on July 12th. Does anyone know if they should go a few days early, do they have to have a medical inspection done at the consulate like you do with a K3 visa? Thanks!

I'm not really sure this question goes here, but I have a friend who was born in Mexico but her father is a US Citizen by birth, her mother is a Mexican citizen by birth....her father has since passed away. She has his birth certificates and all and her birth certificates with his name on there proving he was her father but she has never done anything about getting her citizenship......what forms does she fill out to be able to come to the US and to have her citizenship? Any help is appreciated, thanks!!

  5. ok so we are going to Mexico to travel around and visit my husband's family for 2 weeks. Entering at McAllen area of Texas. I have our passports but what else do I need to take with us. I know at the border I will have to do the Tourist Card thing and then get Mexican insurance on our car. But any other paperwork I should have with us or something I should do at the border?

  6. My husband received his K3 visa 3 years ago from CDJ. At that time we filed the K3 it got denied, we went the next week and filed the waiver and it was accepted and we reentered the US legally.

    I was looking online for a friend that is about to go to her K3 apt in CDJ has the waiver process changed? Are you allowed to file the waiver soon after the K3 is denied? Once you file it do they process it then or do you have to wait for them to process it for a 6 month minum?

  8. my husband received his k3 visa but I someone asked me what papers were filed and I did not know what to tell the, I had filed the I130 on my own, but the lawyer filed the I129F, me and my hubby were already married in the US when both were filed, do you have to file both or could someone just file the I129F alone and they would still receive an apt letter to go to the mexican consulate? Basically what do you file to get a K3 visa on a already married couple when the spouse is EWI and the other is a US Citizen? Thanks for your help!

    My husband recently re-entered the US under a K3 visa and we are wanting to ajdust his status now. Before we got a lawyer involved I filed the following (all within the past year)

    I485 (Application to register Permant Resident)- it was denied

    I864 (Affidavit of Support)

    I765 (Application for Employment) - it was denied

    G325A (two of these Biographic Info) - had to go to Jacksonville FL per a letter from INS to get fingerprints done

    I130 (Petition for Alien Relative) - it was accepted

    ---Lawyer filed I129F - it was accepted and the K3 visa was obtained thru it

    I693 (Medical Exam)

    we also sent in all the fees and picts and all that stuff. My question is I know I will have to refile the ones that were denied, but the others are they still good if it has been less than a year. Also the medical exam that they have on file it is still good if it was within a year too?

    Any help on this is appreciated, I'm so confused.

Ok my hubby has a K3 visa and his letter from Social Security office, he went to try and get a GA driver's license, he passed the test and all but they said they need a MVR report or a letter of clearance from Mexico on my husband's driver's license in Mexico. How would he go about getting one of those? Please help asap he is waiting on me at the DMV office.

  11. Hi all,

    I recently went to CDJ with my husband for his K3 visa, while there I went into a lunch place across the street from the consulate and got 2 cokes but the guy did not have change and he told me to come back later, well as the day went on I forgot and that night we left CDJ for the US and I did not remember till the next day. I know it is not a lot but I wanted to send the guy the $ but I don't know the name of the place. Can anyone help me it is the place across the street from the consulate building and right next to the place that rents out the red chairs. Please if anyone can help it would be really appreciated!
