  1. I am in the process of filing for citizenship for myself (K1) now married and having lived with my husband for 5 years. We have our 10 year green cards. My children are 19 and 21. In the N-400 application I will list all of my children. I have two that live with me in the US and came over with me in the fiance visa process. I also have one daughter who is married with children still living in Colombia. I know that I will list all three of my children on the N-400.

    The N-400 instructions are a little confusing regarding years as a perminent resident in my situation. I meet the three year requirement as my husband is a us citizen and I have had my perminent residency since 2010.

    My questions...

    Will my children be covered under my N-400?

    Fees?

    If my children are not covered under my N-400 will they have to wait to meet the 5 year residency?

  2. I am a little confused on a few parts of the I-864. I am filling out this affidavit of support document to adjust status of my K-1 wife and her two K-2 children. I have listed my wife in part 2, "Information on principal immigrant"

    Part 3 Information on the immigrants you are sponsoring.

    I only checked box 9... "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in part 2. (My K-1 wife) then I entered information on our two K-2 children.

    What do I put for the answer to question 10? "Total number of immigrants you are sponsoring on this form from part 3 items 8 & 9"? I know that i will include the 2 K-2 children but do I also include 1 for my K-1 wife listed in part 2 for a total of 3? or do I just list the two children?

    Part 5. Sponsors household size.

    a. enter the number you entered in line 10 above.

    b. yourself. (I got this one... ;) 1 for me...

    c. If you are currently married, enter "1" for your spouse.

    My spouse is my K-1 wife listed in part 2 and could be also entered in part three depending on how i am to answer part three above.

    d. If you have dependant children, enter the number here. I also have a son so I entered 1 for him.

    Somehow the end result should reflect 1 for me the sponsor, 1 for my son, 1 for my K-1 wife and 2 for my K-2 children. My total should be for 5 by the time all is answered correctly.

    Any assistance would be greatly appreciated.

Hola a todos,necesito ayuda desesperadamente;estamos tratando de hacer el ajuste,no sabemos que documentos dbemos llenar para mis hijos de 16 y 18 a~nos,ademas los examenes son del a~no pasado cuando llegamos aqui,(USA),ya voy a completar dos a~nos aca y realmente me angustia estar sin el ajuste,alguien que haya ajustado con hijos en esas edades o similares que por favor me ayude?mil gracias.

    I just had my aos interview with my son (K2). I did not find anything really on K2. I just posted my questions too. Anyways, if your son/daughter is 12 years and below, everything on the list of K1 aos requirements are needed 'EXCEPT' for the G-325 a. And then, for his I-864, just make an exact same copy as yours. When you mail them, put your K1 and K2 in separate folders and then put both in 1 folder and mail the whole thing.

    Are there circumstances where a K-2 child would need to fill out a G-325a? For example you state that if the children are under the age of 12, they would not need one. Both of our children are 16 and 18.

  5. Do we put her social security number on the g325a if it is still in her maiden name, or should we leave it blank?

    In the "This form is submitted in connection with an application for?" What do we put here?

    Do we both submit a form g325a or only my K-1 wife?

    Do we fill out a g325a for each of her children also?

    If she wants to use her new married name for everything, then you will use her married name on all immigration paperwork from now on.

    If she chooses to keep her maiden name, then that's the name she will use.

    Your marriage certificate will show why her name changed if she chooses to use her new married name.

  6. We are filling out the G325a form (and others) and my question is..

    Which last name do we use?

    K-1 Visa and we married within 90 days.

    Her passport has her maiden name.

    Her social security card has her maiden name. We went to the social security office after getting married with a copy of marrige license and they told us they could not make the change to her new last name because by the time the papers came back her visa would be expired. She is currently considered out of status which I understand is ok as long as she does not leave the country. We will have to go back to social security office after we get a green card.

    I called USCIS and asked them this question and they said we could list her new last name on the application. ?????

    We have a joint bank account with her new last name for reference documents.

    The marrige license shows her maiden name as the one i am marrying but there is nothing that states she has taken a new last name.

    Obviously i want her green card to be in her new name... and i also don't want paperwork getting kicked back to us from uscis.

    Anyone with similar experience?

    RE: The question "Applying with you"???

    With me being a US citizen and her spouse, I am guessing I should answer "NO" for myself.

    Now for the children (14&16) I would prefer to put this off for a few months for financial reasons. If i am reading things correctly, there would be an additional $900.00 fee for each.

    If I check the "NO" box for the children, what happens?

    The first thing you need to do is change your address with the USCIS ASAP. Every time a non US citizen changes addresses he/she needs to file for AR-11 with the USCIS. Your wife can file this online and print a copy for her records. Also, her sponsor/co-sponsor needs to file form I-865 if he/she changes addresses as well. Make sure you read the mailing instructions so you can have mailing proof.

    Once you do this feel free to file for AOS, including AD and EAD. Don't worry about the fact that it took you a while to file, you're fine since you got married within the first 90 days.

    One last thing, if your wife changed her name to yours, make sure you fill out every form you send the USCIS with her new married name. Once she gets her EAD or green card, she can go back to the SSA office and have her name changed on her SS card.

    One more question... On the documents do i list the date of the move or the date I am filing as the "Effective Date of Change of Address'?

Your wife can file this online and print a copy for her records. Also, her sponsor/co-sponsor needs to file form I-865 if he/she changes addresses as well.     Once you do this feel free to file for AOS, including AD and EAD. Don't worry about the fact that it took you a while to file, you're fine since you got married within the first 90 days.

    Her SS card and her mariage license both have her maiden (2 Colombian last names) on them. Do i use her maiden name or her married name (not documented anywhere) when filing the AR-11/I-865?

    I am asuming that as her k-1 husband that i am to fill out the I-865?

When we went back to the social security office they denied changing her name because they said her I-94 was about to expire. Soon after i had to move to another state because of my job. We did not notify anyone that we were moving. I called and talked with info pass and they told me that my wife was out of Status and could not be deported because we had legally gotten married within the 90 days. Moving expences along with unforseen medical bills caused us to have to put off the process further. I am now finally in a financial position to complete the process of the AOS.

    Now that i have had time to do some more research i am in fear that I have made some mistakes and need to correct them. What steps do i need to take to get this headed down the right path?
