    You will also see many cases where children of those ages have aged out and cannot go.

    see section “CSPA for Family and Employment Preference and Diversity Visa Immigrants” - it clearly says “The length of time a petition was pending (pending time) is the number of days between the date that it is properly filed (filing date) and the approval date.”

     

     

    ok fine..but tell me i seen many cases where childern ages are 27 28 even 29...they migarate us wid therr parents in f4 visa..  if aged out then how they gone ?

    in uscis website they wrote you need to subtract the duration from your age the duration which your application is pending at nvc so in your case your application is pending at nvc since 2010, that is their official wordings leave any other website as the one you have posted its not the official website of uscis 

    its mean i am 25 now if my priority dates comes next year so i will have a chance hopefully ?

You can google “CSPA calculator” (it’s not an official website so I can’t provide the link here) and put the dates in yourself to check. CSPA effectively subtracts the period of time an application is pending (between priority date and approval date) and subtracts that from the actual age to get a “CSPA age”. The CSPA age must be under 21 at the date a visa becomes available (this is when the priority date becomes current) to receive a visa as a derivative. Unfortunately your son’s CSPA age is already well over 21, before your priority date is current. Your only real option, assuming he remains unmarried, is to sponsor him as adult son of LPR once you have your own green card. That process currently takes about 7 years. I am sorry not to have better news for you.

    however - if it is the approval letter then unfortunately your son has already aged out. We could confirm properly with exact birthdate and approval letter date.

    Incorrect.  If the OP was petitioned by a sibling (and is, therefore, an F4), the derivative son is also F4.  If he ages out before the Priority Date (PD) is current, he has no category until/unless the parent then petitions for him after they enter the US on their own F4s.

     

    OP -- you need to find out when the petition was approved to see how likey it is that he will still be eligible when the PD is current.

    More info needed to see if your son has aged out - need approval date. 21 not 25 is the key age but there is an adjustment made which we need approval date to calculate.

    My priority date is June 2007. My case status is currently case is at NVC.

    How much more time will it take for our visas?

    My son was 14 in June 2007. He is now 25 years old. What will happen when the file will open if my son is 26 or more? Will he be eligible or not? How much time is left?
