    I filed my ROC while on government orders in Germany.  I went on post to do a fingerprint card which I submitted with the paperwork instead of attending a biometrics appointment.    Paperwork still had to be submitted to the US.    My new green card was sent to my APO address in Germany,    As for an actual ROC interview I was not called for one and the application was approved with no RFE.

    Welp. I can't explain all of it because it would be long. My only question was if I can do all of it here in Spain. And since it was already answered, It's a No. Then I will have to send all of my paperworks in the states and have my ROC done first and just file my citizenship when we come back to states. 😅

     

    I will explain briefly the situation so it will be fair.

    As I stated on my post. We are in the military. We also tried out our very best on our situation to get everything done before we left California. 

    I just got to the states last 2019 and when we file the green card covid hits and everything was close and backlog in the USCIS. 

    They barely sent me my greencard last December!!

     

    We have our military orders and we only have a month to do all of that stuff. (Aside of stuff we need to do in the military process before leaving. We call it PCS or Permanent Change of Station) Idk if anyone of you here is in the military or a milspouse. But we cannot just push the orders or say no on the orders just because I have to file my citizenship. And staying behind was not an option (We both doesn't have a family where we was) 

    We know about the expedite for citizenship for military spouses. We did all the researched already for that. The only thing was, The time they expedited my green card we never had a chance to do it because like what I said we are leaving. We asked for 2 weeks extension from his command because my GC arrived super late also.

     

    Now we are here in Spain, We thought MAYBE, maybe... We can do it here? That is why I have to asked if it's possible. Or someone have a similar situation and actually gone through this.

     

    Do you think we want it like this way in a hard way? Lol Or We want it to be complicated?😄

     

    Yes, I know about the expedite citizenship, We

    already filed for it this year but I have to fly back in the US. We filed for it 6 months ago and we withdraw the application. Main Reason? I can't just fly just like that. 

     

    We was hoping we could get it done where we at since flying back in the US is gonna be hard for me because we have a toddler and my husbands goes to work. Inshort no one will watch my kid for us.

     

    I just thought of maybe doing it here in Spain would be easier if it's possible.

    It's not a big deal if I can't have my citizenship right now, I can always file it when we come back to the mainland. 🤷🏻‍♀️

    We do not have time to expedite my citizenship because they expedited my greencard (For military orders) Last 2020 it was backlog in the USCIS i believed. And when they sent me my gc we are leaving the states in a month. That is the reason I am asking right now on if I can file all my paperworks here in Spain or somewhere in Europe and do the interview. 😄

    Why didn't you filed for citizenship before y'all left? That's exactly one of the reasons why the fast path to citizenship is offered to military spouses.

    I cannot do that because I just had my green card when we got our military orders. They just expedited it and then I still have to wait atleast 3 years before I applied for citizenship. And being in the military is not like we can choose where they will send us. Lol 

  5. This is a long shot, But I couldn't get ahold of any information about this matter. Maybe someone here have a same experience could help me out. 
     

    Can I file my removal of conditions of my Green card  in Madrid? My husband is in the navy and I have to file my ROC next year and file after a year of my citizenship. Not just sure if I can do it here in Spain than sending all my paperworks back to states. I hope someone knows about this. This will make my life easier because we are stationed here for 4 years. Thanks in advance!! ❤️

    I’m a military spouse overseas (Japan) and everyone advised me to skip the process to Remove Conditions on my 2 year GC and apply for Citizenship under INA 319 (b). But with Covid-19 and information from several military spouses always changing, I instead went ahead, waited, and applied for my I-751 last year in June. 

     

    I received a RFIE in March asking me to provide a location and date for me to fly back to the States or a U.S. territory to attend an interview.

    I mailed my response to USCIS in May 8th, telling USCIS that my preferred location was Guam, but however, because I will be eligible to apply for my N-400 under Section INA 319(e) that I respectfully request to have my I-751 and N-400 interview combo together in Yokosuka, Japan. 
     

    I just woke up from an email that said I have received a waiver and my 10 year Green Card has been approved! I checked my status on the USCIS website and indeed it says New Card is Being Produced!

     

    So the next step will be to apply for Citizenship but the beauty of it is that there won’t be need of us to fly back to the states for this last process just because I waited. 

    I know a couple of civilian spouses and military spouses, with N-400 under INA 319(b) applications still pending from summer last year; and I also know a spouse that applied for her N-400 under Section Ina 319(e) and she got it all done in under 2 months in the country she is residing, Germany.

  7. Hi! Can I ask how did you withdraw your N-400 application? I applied last month but I found out that I am not eligible yet to apply overseas (But I filed my N-400 under 319(b) right. To make the story short, I am not possible to go back to the US and I just wanna process it overseas which is I am eligible to do that on 2023. So now I do not know how we will withdraw my application or where to even send it! Or can I just leave it that way? My problem is I have to file ROC next year then 2023 for overseas naturalization so I do not know or not sure if It is ok for me not to file a withdrawal first. 

     

    Can I ask if do you know which address I could send that to?

    Oh yes snap! That's what I meant, I will apply for my ROC on September-2022. Lol!

     

    Then when I received my extension letter I will apply for overseas naturalization which will be just 9 months afteR I applied for ROC. It doesn't make that much sense to me how and why we have to pay again and again for this process but I guess that is the process and It is what it is. 😅

     

    I just wanna do the naturalization overseas because It will be very hard for me to fly back to the US if they will schedule my interview back in the US. Like what is happening right now, I applied for the 319 (b) But they want me to fly back to the mainland and I can't really do that, Plane tickets are expensive and who knows when and how long will be the interview and oath will be, Plus I do not have a family back in the US. 

     

    So I came in K1 visa. I had my interview for my 2 years greencard but I don't really count on it that they might waived my interview for ROC. So now I am just thinking it is really better to apply for overseas naturalization here, Atleast we could just drive up to Madrid. It is better than flying back to the US. Hehehe

    yes i think you could do it in Spain. But because of covid I don’t know how they’re doing interviews if they are doing them overseas. So the steps are file for ROC when it’s time for you to do so, wait until you have been a LPR for three years and have been living with your spouse for three years, and file for naturalization under 319(e) 

     

    This is what I have read while doing my research about the options I had, specially the 319(b) which is the application I ended up filling for. 

    Ok thank you for your input! I am actually gonna be 3 years LPR on December 2023. So I think I could apply 90 days before that so I could apply on September 2023. 

     

    And we will have like 1 year and 2 months left before we leave Spain. 

     

    When I do my ROC will they automatically send me an extension letter for 18 months? And do I have to pay for ROC? Because if that is the case then, After I applied for ROC, 9 months later I still have to apply for overseas naturalization, So I have to pay again?😅

    Basically, to apply for 319(e) you have to meet all 319(b) requirements PLUS meet the general naturalization requirements, 319(a) (be a resident for five years, or in the basis of marriage, be a resident for 3 years and live in marital union with your US citizen spouse for 3 years, etc) Requirements herehttps://www.uscis.gov/citizenship/learn-about-citizenship/citizenship-and-naturalization/i-am-married-to-a-us-citizen

     

    So you would have to wait a while it seems, remember you need to have at least one year left on orders at the time of application for naturalization.

    I see. so before my conditional expires I have to file for ROC then once I got the extension letter, I have to wait until my 3 years LPR status or I can file for INA 319 (e) before my 3 years LPR status expires (This is with the extension letter + the expired 2 years GC) right?

     

    We will be here in Spain until 2025. 

    My GC expires on 12/22. 

    So I think I could do it here?

    Okay, So this is confusing to me now. 

     

    We will be 3 years married on Sept/22. 
    But, I only have a conditional greencard (2 years) Can I refile my application overseas when we reach the 3 years of our marriage regardless of me only having a condional greencard? Am I gonna be eligible to file it overseas?

     

    Because there is no way I could be a 3 years permanent resident if I only have a 2 years greencard right? Not unless I will file an ROC and file for 10 years GC. 

     

    And the thing is, We wanna do it in any US Consulate here in Spain. I am just really confused right now how some people expidited theirs without even going back to the states and only have a conditional greencard.

  15. Hi everyone! So I have some questions about my naturalization process.

     

    I applied for my citizenship under INA 319(b) since my husband is an active duty and we are currently residing in Spain. I have a conditional green card (2 years) I am confused right now that they want me to fly back in the USA for the interview and oath taking, Is there any way that we could fix it? Like to process everything here in Spain (Madrid) including the interview and oath taking since it is really hard to fly back in the US right now because of the restrictions of borders accross Europe. 

     

    As far as I could understand, Some people who did the process did not went back to the US for interview and get it done where they actually residing at. But what I do not understand is, How they did that? Did I filed my paperworks wrong? Should we withdraw it and file a new ones?

     

    We are married for 2 years and will be 3 years next year around Sept. If that is the case and it is regarding of the time frame of your marriage, Should we wait for the 3 years marriage anniversary? Since I only have a 2 years green card and we are in Spain due to Military orders. 

     

    Please anyone who could put an input for me, I am highly appreciate it! Thanks in advance! 

  16. Hi everyone! I would like to ask here if there is someone who got their expedited naturalization done while living overseas? Military and families are allowed to do it so as long as you have a proof that you will live on that country more than 6 months and on my case, We will be here in Spain for 4 years. I filed my expedited naturalization last month and I checked the USPS status that the Chicago lockbox received it April 12. I used our APO mail so I am pretty sure they knew it comes from the military base. 

     

    Now my questions are:

     

    1st, Why I haven't receive my receipt yet? Since it's been more than a month. I am worried my application is lost.

     

    2nd, How long does it takes for the naturalization for military dependents overseas?

    I hope so too. I kept on thinking about it. my worries are if he could even get inside the embassy just to ask a supervisor to review my case file again. we tried to sent a letter to them lots of times, explaining and pouring our heart out. but it seems like the CO that has my paper doesnt even reading our letters. every after I comply on the 221g they will sent me another one. it goes on like that for almost 4 months now. she seems like robot.

    and I don't know why this is happening to us. a filipina from the embassy called me, the last time we talked I cried a lot because I could not help it anymore. and even asked her, where is their heart keep asking for the same papers over and over again? she could not even answer me why they want me to recognized my divorce by philippine law. and I composed myself and told her "OKAY. I'LL JUST LET MY PETITIONER DEAL WITH THIS AND HE WILL FLY BACK HERE" 

     

    she told me no, and before I ask my petitioner to fly back in PI I should make my move first and go to the PSA like as if I never complied on my 221g. 4 times. LOL

    I don't know what to do anymore. like the embassy really called me just to tell me to go to the PSA. as in LOL. I did and they never believed in me, I kept on telling them that the process they are talking about is not right. they just making me look like a fool with this 5 221g's. the only hope we have right now is when my petitioner fly back here soon. he wants to talk to any supervisor inside the embassy. he wants an answer. My medical will gonna expired as well on June. so Idk really. I am getting depressed.
