  1. Hey everyone, hope you are all doing well. I am in a bit of a situation and am trying to figure out what my options are. 

     

    I am active duty military, met my wife in Italy and did a CR1 visa to the states back in 2019. We got her 2 yr green card and are now filing for petition for removal which was accepted, and we received our extension green card until Aug of 2022. We've been here in the states for 2 years now, and I just found out from my command, I am getting military orders back to Italy (her birth country). 

     

    My concern is that the i-751 wont process in time. We filed may 15th, and received the NOA by MSC may 27th, but are due to leave in February of 2022. Does anyone have any guidance on if there will be issues with her coming to Italy while the green card is still pending? She will be on my military orders. Would we be risking "abandonment," of her status? Any help would be much appreciated! Thank you!

    I finally received the letter of  when the the I-130 was approved. Rome approved it in on June 11th and Naples consulate (NVC) sent me an e-mail on June 21st with the case number. Count more or less 10 days from the date they said it was approved. 

    That gives me hope!! Thank you much! 

  3. I received notice that my petition was approved by the Rome consulate on the 24th of June , and that is has been mailed over to Naples embassy for visa processing. Does anyone know how long this process takes before I hear back from Naples with information regarding what to bring to the interview , case number, and how to schedule to appointment?

    Definitely call Rome now saying you want to expedite. They might ask you for your new orders. Just explain (as my husband did) that you do not get your new order until a few weeks before you pcs, but your Italy orders state that you can be stationed in Italy for x months and you need to leave soon. Also, where you guys going? I have no clue where we are going. They are not going to tell us until August and I am having issues with the DS 260 form  which requires me to specify a permanent address in the States where I will be staying.

     

    Also, I just had WONDERFUL news informing me it was approved!! I emailed Rome Asking for a very kind expedition since I wasn’t able to get ahold of anyone today. They told me it was now being sent over to Naples !

    For permanent address , that can be a tricky one.. I just put down the general address of the future base. I was lucky to have gotten my orders 4 months in adavance

    You won't be able to speak to Naples over the phone - at least I could not make it. However,  you can send them an e-mail and they reply withing 3 working days.

     

    Thank you so much for your help!! I’m still waiting on the notification of approval. I hope there is no issues because I need to leave in August . The NOA1 was 5th June by Rome. If I get the approval, then I will be going to Naples late July/early August and will let you know how the interview was!!

    Okay great! One last question. When you got notification of approval, it was through Naples? Did Rome ever notify you of approval via email?

    E4. Also, per your last post, what time did you call the Rome consulate? And what was the number? Because every time I call I have to press a bunch of numbers that directs me back to their website.

    Me and my wife are currently going through the same thing. Can I ask , what date did Rome email you the receipt acknowledgement as well as the approval?? I am still waiting, and am feeling very anxious. We submitted ours 24may and was officially notified of the receipt acknowledgment on the 5th of June

    We filed in Juarez Mexico.    For DCF the receipt is the NOA1.  The approval is the NOA2 and could also be considered "case complete" as the petition never goes to the NVC.  There is no NOA3.

     

    Once the consulate has the petition they send out a letter to the Beneficiary. Fortunately they sent a copy to my US address because we rarely get mail correctly or timely in Mexico.  The consulate doesn't send any notices by email.

    Thank you so much for your help. I was confused because I didn’t realize the g1145 for just to tell me via email the i-130 was accepted. So now, I should just be waiting on getting the notification of approval in the mail from the consulate ? What also throws me off is that the email says “you will be notified once a decision has been taken.”

    The receipt is the NOA1.   There is no way to track it.   I filed a G-1145 with ours and I did get an email the next business day saying it was approved and being sent to the consulate.  The next item we received was a mail piece 6 weeks later from the consulate.  Essentially a packet 3.

    Okay so i received the NOA1. and since you filed the g-1145, how come you didn’t get notified for NOA3 via email? Also, if you don’t mind me asking, which consulate did you file through?

    i was recently emailed this by the embassy in Rome after filing an I-130 petition for my wife,

     

    “This is to acknowledge the receipt of your I-130 Petition for Immediate Relative.

     

    You will be notified if anything else is needed or once a decision is taken.

     

    Processing time for such application may take 60-90 days.”

     

    what does this information mean? That this is the “receipt” of my petition? I thought the receipt would be formally mailed with a receipt number or case number. This was the only thing emailed to me and am unsure of what I am supposed to expect.

     

    also as a side note, the embassy received my form on the 24th of May.

    Through dcf. And I’ve called that number and was given the response of, “there’s no open case for you so... we can’t do anything.”

  14. So I’m living in Italy with my wife currently as I am in the military. I am due to PCS in August . Right now I’m still waiting on approval for the i30 and i131 application from the embassy. At this rate, my hopes are not very high, and yes, I should have filed sooner, but we recently just got married. My question is, if we do not get the visa in time from the consulate, would it be possible to take my wife with me using a tourist visa?  I know there is regulations she can stay for 90 days, then we would come back to Italy to finish everything . She is also on my official travel orders. Would it be possible to get the ESTA to enter, then return back to her country to receive the visa? 

  15. So I’m trying to prep ahead of time to get the ball rolling and was having difficulty finding the necessary information. I submitted an i30 and i30a petition to consulate in Rome and am awaiting approval. Once I get approval, where can I find the checklist of the documents that I need for the interview? What are some of the things I can knock out now to speed up the process, since I’ve been hearing stories about others taking a few more months to collect required items. Thank you!!

  16. So I filed an i130 visa in April via DCF to Rome, Italy. It was shown that they received it the 24th of April . Today I got a letter in the mail stating I need to pick up something from the consulate tomorrow. In the back of my mind, I feel as if it might be a need for more evidence since I only submitted one picture of our wedding. However , I’m unsure if it would be a letter of approval, since I put the paper to receive emails on my application. Or do you think that this is possibly just the receipt number?

    If not - then you can try to expedite the current I-130. But also be prepare that your wife might NOT travel with you in August. But that's perfectly fine, separation is usually part of immigration. ;)

    Okay, I filed through them, followed all of the steps when I was submitting my form. Mailed it to this address and everything. Asked and they accept DCF, so from my understanding I have in fact submitted DCF. I am just waiting to hear back for a receipt number since it was delivered to them last week. Then once I get that I can try and expedite it on top of it being DCF?
