The K-1 has a unique path that it follows. While the K-1 is adjudicated, it is treated as a "immigrant" visa. The K-1 has immigrant tendencies but it is afforded the opportunity to have a visa that allows them to enter the US for 90 days to get married which is much different then the CR-1/IR-1 visa. So the K-1 it's treated as a non-immigrant visa with immigration intent. The quote you addressed in your post is a pat answer and should not be followed by a K-1 because NVC doesn't issue,  process visas or schedule interviews for a K-1 visa type, only the embassy has this responsibility. The K-1 applicant will schedule their own interview per the instructions from their interviewing embassy.

    Greetings,

I just wanted to thank everyone for their guidance and support. We ended up receiving an e-mail from the NVC that our case was sent to the embassy. The email also recommended that we fill out the DS-160 and pay our fee (which we already did). The following day, I checked my status on CEAC (just for the heck of it) and it still said "no status." I checked on the ustraveldocs site (just for the heck of it) and was able to schedule our VAC and consulate appointments. Had I not looked at the ustraveldocs site I might not have known that I actually could schedule the appointment.

I guess the moral of the story is that you have to be both patient and vigilant at the same time. Thank you to all who commented and helped to keep us calm in the process.

CEAC should state "Ready for interview" as that is when the embassy has received the petition from NVC. Just because they gave you a case number doesn't mean they have sent the petition off. Obviously can't make or have an appointment if embassy doesn't have the paperwork.

That makes complete sense. I guess what tripped me up was the email saying they received the fee and we could book our interview and I was also confused when I checked the CEAC status and it directs me to contact the consulate if I have questions, not the NVC. This made me believe it had been forwarded.

Nonetheless. We will wait for a change in our CEAC status. Thanks.

  3. Greetings,

I am completely confused and could use some guidance here in the Dominican Republic.

My fiancé and I never received anything from the NVC, so after reading the advice on this site I called and got our case number and ID. We were then able to complete the DS 160 which in turn led me to the ustraveldocs site. We completed ustraveldocs application (immigrant visa, because k1 was listed there), paid the k1 visa fee, and when I returned the following day to schedule interview there were several dates and times listed for VAC appointment. Every one that I selected stated that the appointment was not available. When I called the only advice they gave me was to check my status on CEAC website. I did that. First it said NVC, two hours later it said “no status.”

When am I supposed to arrange the interview? Am I to wait for my status on CEAC to change? We haven’t gotten any emails or snail mail about it. We only received one email that said they received our fee money and we could select our appointment on the ustraveldocs. Should I be waiting for someone to contact me? Or just keep trying to book an appointment on ustraveldocs?

I am totally lost. Thanks for the help.

You don't need a tourist visa to enter DR if you're a US citizen so I'm a bit baffled. You said you still have residency in the US, but you can only apply for a K1 if the petitioner is a citizen not a legal permanent resident.

    Unless there's something I'm missing

I am a US citizen, my fiancé is Dominican. A tourist visa is required to enter the DR, it is included in airline purchase and has a limit of 30 days. You used to have to pay $10 for it on arrival, but now it’s included. I spoke with an immigration attorney here (DR) about extending the visa. He laughed and said, “just pay the fees at the airport when you leave.” It sounds like that’s pretty standard practice for expats and tourists who need more than just a 30 day sunburn. 😄

    thank you for the responses.

  5. Greetings. I am American and my fiancé is Dominican. I have been visiting him for the past 6 months. I say visit because I still have residency in the USA and I am here on a Dominican tourist visa that I have overstayed. I overstayed my Dominican visa once before to spend as much time with him as possible. This has allowed us to grow closer and led to us filing for k1 visa. We are in love! My question is, does me overstating my Dominican visa have any consequence on our approval. I don’t work here and will pay all fees and penalties upon leaving. From my research, there is no extended tourist visa here, you just pay the fee when you leave. I feel like me being here with him actually provides even more evidence of a bona fide relationship. We are at the NVC process now, just hoping I am not missing anything. Thoughts would be appreciated.
