  1. My income, $28,000 (if low why) I dont know why, I work as account management for a company, thats what I make.

    I live in MI.

    I live alone, but I'm taking care of my dying father atm.

    I have 3 children, all under 18

    I own a pizza shop, that is my assets, but it is currently being sold in conjunction with my divorce. The income from the pizza place will not reflect on my income by the time we can file for a visa.

    My mom and stepdad are both retired, bringing in an annual income of about $50K combined.

    I am willing to work a second job, but from what I read they would probably not consider a part time job sustainable?

  2. I've never felt so devastated in my life. I planned on having my mom and or step father co-sponsor for us if needed. I guess from the beginning I missed where the income needed to be 125% the poverty level and all this time we thought as long as I made over the $17k everything was going to be fine.

    No I find I am short the poverty line for a family of 5 and my mom and step dad are both retired and would only meet the financial requirement with their combined income.

    Are we out of options? Is there another way to bring her here without having to meet that financial requirement? What if we were married in Romania, how can anyone keep a married couple apart? Can she live here illegally for a long period of time and apply for a different formof citizenship?

    Crying tears on MSN, this is a sad day.

  3. I have spoken with 2 different attorneys, the first told me my financial requirements were fine because I made over $17K a year. Well the 2nd attorney said that there is an additional requirement if I have children, which I have 3.

    I made $28K last year and the lawyer said I would have to show $29,250. Is this correct?

    If I have to have an additional sponsor what kind of liabilty are they signing up for?

  4. BTW, using a "K1 visa attorney" won't change anything in terms of how long your approval takes. In fact, it could take longer since attorneys make mistakes.

    7. What Documents Do You Need toProve That You Can Legally Marry?

    C. If either you or your fiancé(e) were married before,give copies of documents showing that each priormarriage was legally terminated.

    Therefore, your marriage must be legally terminated, according to the laws in your state, before you file.

    Hate to break it to you, but Kit Kat is right (including the bit about an attorney).

    Even if the Lawyer doesn't make mistakes which they seem to do often it will take longer. You are adding a link to the chain. A chain with an extra link can not be shorter than it was. Instead of sending things in, you send them to the attorney, he has questions you answer, it sits on his desk till he gets to it and eventually sends it in. Plus you are out of the loop. Communication goes to him. I had a friend apply using an attorney when I did my first K-1. Through NOA-2 I picked up 4 weeks on him and he had and RFE and I did not. (His attorney forgot to include his birth certificate)

    But do they take you more seriously if you have an attorney backing you? Better chance for success?

    Well Ill be legally divorced in 2 months, but michigan law says I cannot remarry for 6 months after. If I went to vegas and was married would it be legal?

  6. We are trying to get an idea on how soon we will be together. My divorce will be final in 2 months, but the law here is I can't marry again for 6 months after.

    Do we have to wait that whole 6 months before filing or can we file as long as I am legally divorced?

    The plan was that we would file and she would come here 60 days before my 6 months was up that way we could get married within 30 days after.

    Maybe thats not real great either if we have to worry about the time it takes to get approved for marriage licenses?

    We just want to be together really bad, this wait sure sucks.

    You must be legally free to marry when you file. If the law where you are states you cannot legally marry for 6 months after your divorce is final, then you must wait until then to file. Sorry for the bad news...

    You must be legally free to marry when you file but you are not required to marry where you live. If you're divorce is final, you can get married in Las Vegas or any other place in the US where you are free to marry. Neither the USCIS or Embassies and Consulates abroad are generally well versed in local legal requirements. They will only be concerned with whether you are both of age and either single or divorced.

    Ohhh now thats music to my ears! So that 6 month wait period for me to remarry isnt a nationwide law?

  8. Im am going through a divorce, but plan on re-marrying as soon as my divorce is final. My girlfried is living in Romania and she was going to come here for 3 months but we decided its easier for me to get there.

    The question is do I have to be legally divorced before we can use our meeting in person as a proof of meeting within the last 2 years or does it matter, as long as we've met before and can prove an ongoing relationship?
