hi . i have a question about naturalization. one of my friend got her permanent card since 14 august, 2006. and she wants to know when she can apply for n400? thanx

You friend can apply on 16 May 2011 under the five-year rule (i.e., five years from the date of her green card minus 90 days). However, if she has been married continuously to the same U.S. citizen at least since 27 January 2008, she can apply today under the three-year rule (i.e., three years of continuous marriage minus 90 days).

Since May 16 is just around the corner, she should wait until that date and apply under the five-year rule. Things will be easier then because the state of her marriage will not come under scrutiny.

My wife had her Oath Ceremony this morning and is now a U.S. Citizen.

Just a quick question on the back of the Form N-445. One question 1. My wife and I are not 100% sure how to answer this question.

Have you married, or been widowed, separated or divorced? Should we select "yes" since we are married? Or select "no" since my wife who is taking the Oath didn't remarry after her interview? I was thinking of "yes". What did you guys put?

Lace, on the form it says "These questions refer to actions since the date you were first interviewed on your Application for Naturalization. The questions do not refer to anything that happened before the interview." And then again, right before the questions, it says "AFTER the date you were first interviewed on your Application for Naturalization, Form N-400:" and then follows the list of questions.

How much clearer do you want it stated that only changes since the interview are relevant?

Update: My wife passed her interview today -- sort of. She passed the civics test and everything else, but she received a "decision cannot be made" verdict because there are some documents missing from her file. They need to be retrieved from some government storage facility and then she will be sent a letter for the oath ceremony. This will take another four to six weeks. This is a bit annoying, mostly because we had expected everything to be over today because Fairfax does same-day oaths.

My wife had her Interview this morning at 8:20AM. I got a nice call from her at 8:39AM she passed her interview. I will get the details from here later on. Weird thing is she said they will send out a letter for her Oath ceremony later on. Our office is in Fairfax, VA. and they usually do same day Oath Ceremony. We did made an info pass appointment a few weeks ago stressing our travel plans next week and why we couldn't do the same day Oath ceremony. Again, I will get the full details from her and will write about it here. Thanks for all your support everyone. Our journey is coming to an end finally.

My wife's interview is next week, also at the Fairfax offices. Just to clarify: Your wife's interview was postponed because you asked for it, right? Or has Fairfax done away with same-day oath ceremonies?

Ah, but you don't need a lawyer. The name-change petition is a simple two-page form, you pay the court clerk the fee, and you are set.

Are you willing to spend a few thousand dollars now...

Here in Fairfax County, VA the filing fee for a name change is $41. I would expect it to be similar in most if not all jurisdictions.

Got our interview date finally!!!!!!!!!!! Anyone know how long for the Oath ceremony after the Interview? My wife opt to change her middle name only. Glad to see the interview date at last but it may conflict with our planned travel overseas on March 3rd. Will be out of the country until April 20th.

Lace, assuming you live in NoVa, the name change takes 3-6 weeks to go through the courts. Add four weeks notice for the oath ceremony, you are looking at 7-10 weeks delay. If you expect a conflict with your travel dates, your wife can cancel the name-change request at the interview and she would then have a same-day oath (or within a day or two if her interview is late in the day). You can then request a name change at a later day of your convenience at the courthouse. The fee for that is only $30 or $40. (Of course, this is going to cost you an extra passport fee if you change your passport after the name change, but this may be worth it for you.)

Update: Received email that case is now in "Testing and Interview" stage and that the case was transferred to the local office for scheduling of the interview. Online status has changed accordingly as well.

Guess I am in the same category as you, I filed using 319b as a DOD employee. I called Tier 2 and the officer stated that Fairfax, VA is very busy and that my case is currently awaiting a interview date, I will have something within the next 30-60 days. =(

My wife's case is also going to be adjudicated by the Washington, DC office (which is located at Fairfax, VA). As shown at the USCIS website, the average processing time for that office has now jumped to 6.5 months. This is way above the national average of 5 months and makes it one of the slowest in the country.

Well, in my wife's case, there's simply nothing to update. But we're not really surprised; the Washington Office is known to be notoriously slow. We don't expect to hear anything until mid-January, or even later. (And we're not complaining because we had timed it that way so the interview wouldn't interfere with my wife's travel plans. So far, it seems to work out the way we expected it.)

Our interview will be at 9:00 AM next Wednesday at Fairfax, VA. Am I able to do the Oath Ceremony on the same day at that location?

If you are a resident of DC, the answer is no. You'll have to wait for an oath ceremony in front of a DC judge. This may take a month or two.

If you are a resident of Virginia and have no name change pending, you will have your oath the same day if your interview is early enough, i.e., if you are finished by about noon. If you are finished later, your oath will be scheduled for the next day or two. If you have requested a name change, the oath will be scheduled as soon as the name change is approved by the court.

Depends... with me it took 4.5 weeks... drove me crazy but eventually the interview letter came in the mail.

Ah, OK, that's good to hear. We are worried that things go too quickly. An interview date in December would seriously interfere with my wife's travel plans which she can ill afford to change.

My wife received her Yellow Letter today informing her what she needs to bring to the interview.

What's the normal timeframe from Yellow Letter to Interview Letter? Two weeks?

Wow. I would have thought that being stripped of one's citizenship would be accompanied by a lot more due process, especially in Western Europe. I stand corrected.

But you are not being stripped of your citizenship. The law says that you gave it up voluntarily the moment you accepted another citizenship. That does not require due process. In other words, the authorities are not going to come and ask you whether you really wanted to do that; the assumption is that you really did want to do that if you are of sound mind. Due process still applies if the authorities try to establish the fact that you hold a foreign citizenship. You may appeal their decision and fight it in the courts. But in the end it hinges on a simple fact: Did you or did you not accept being naturalized in another country. And if you did, then you have been a foreign citizen from the moment you accepted the other citizenship and all consequences flow from that.

It seems that China indeed does not allow dual citizenship and that the loss of citizenship will be automatic if you get naturalized in another country. If you google "does China allow dual citizenship", you'll find plenty of information online.

(I should point out that you cannot automatically lose your old citizenship. Even in cases where they summarily [and retroactively to the date of your US naturalization] revoke it upon learning of your US citizenship, you will be formally notified, and if you have not been notified, you are almost certainly still a citizen of that country.)

That's not necessarily true. In the case of Germany, for example, you automatically lose your German citizenship the minute you accept the naturalization certificate of another country unless you have obtained advance permission (Beibehaltungsgenehmigung) bei the German authorities to do so. Now, of course, whether the German authorities will ever become aware that you have obtained another citizenship is another matter, but legally the situation is quite clear. If you still pretend to be a German citizen and/or use your German passport without being in possession of your Beibehaltungsgenehmigung, you are committing fraud (or whatever they call this particular case of misrepresenting the truth). And they will find out the next time you want your passport renewed at the embassy because they require proof of your legal presence in the country. -- I know this for a fact because my wife wants to retain her German citizenship and she had to obtain the Beibehaltungsgenehmigung to be able to do so legally.

So, fedupme, if you're thinking of retaining your old citizenship, you should find out if, and if yes, under what circumstances, your country allows you to do so.

I wonder why is taking so long for our group to receive the interview letters..........

Holiday season is approaching and many adjudicators will take a break. Interview letters usually are sent out about five to six weeks before the interview which, if sent now, would put the interviews right around Christmas. I expect things will pick up in about two, three weeks' time.

So is it based on date of marriage or date of green card date?

I got my green card 3/12/2008

The eligibility clock starts ticking with the validity date of your green card, whether you are married or not.

If you stay married to the same USC, you are eligible for marriage-based citizenship on 3/12/2011. You may apply for citizenship (i.e. sent in form N400 and all supporting materials) 90 days before that date.

You are eligible for resident-based citizenship on 3/12/2013 whether you are married or not. You may apply for citizenship 90 days before that date.

My wife had to retake her fingerprints because the FBI said the first set (taken on 10/15) was not usable. The second appointment was for 11/19 but my wife did a walk-in yesterday. She called the FBI this morning and it seems everything is okay this time round and her results were forwarded to USCIS yesterday.

So I left say 04/19/10 and returned 04/20/10..an overnight trip.

Is that 1 day or 0? Someone told ne that since part of both days was in the USA it was O for Total Days Outside USA???Doesn't seem right more like 1..

That would be zero days. Travel days do not count; only full days --- from midnight to midnight --- that were spent outside the USA. I wouldn't even put such overnight trips on the form, but it doesn't hurt if you do.
