You need 3x your household size ($80k) to qualify on assets alone (zero income)

They apply 3x the difference between actual and required income.

CO’s going to want to see current bank statements etc but you should be fine.

Thank you. Yes, I’d done the calculations and thought that I should be fine as well. That’s why the message caught me off guard.

The message you got is a standard message NVC includes anytime income ALONE is not sufficient.  The Consular Officer ALWAYS makes the final decision on the "Public Charge" issue.  If your liquid assets are clearly sufficient, there's nothing to worry about.  You would get the same notice if you had a million bucks in your savings account, but insufficient current income.

Thank you! I can’t tell you how relieved I am to hear that. You sir are a gem in this community!

Cash is converted into income by a ratio 3:1 so it only counts as less than $40,000 of income. Not sure what’s size of your household. The $60,000 in equity, is that in the house that you guys will live in? If yes, it doesn’t hold much water because what’s you’re gonna do, sell the house? Then where’re you gonna live? In essence, I think they will only look at the cash. And yes, the interviewing officer will make the final decision about the financials. Meeting the threshold does NOT mean an automatic “pass”. The CO looks at the totality of circumstances to make a decision (where you will live for example New York City or San Francisco is much much expensive than rural Wyoming, your health, do you have any medical conditions, .... all of that together).

The $60,000 is held in stocks which can be easily converted to cash. Assets don’t include real estate. Household of 3. We will live with my folks when we move back until we get established and then we’ll find our own place.

  4. Hello, my wife and I recently submitted her D-260 and the required civil and financial documents to NVC. They responded and said that all the paperwork has been approved and that they will now schedule an interview date at the embassy. However, they left a message saying that my (the petitioner’s) current income doesn’t meet the minimum income requirement and that the consular officer will make the final decision at the interview (I’m currently working part-time with low income). My wife and I have about $115,000 cash and about $60,000 in equities, totally around $175,000 together. This is well above the Federal Poverty Guidelines for our household size. They mentioned that to avoid delays, an additional Affidavit of Support may be submitted. It’s difficult for me to find a joint sponsor and I don’t want to get other people involved, especially since we’re financially better off. I attached a screenshot of the message. Any advice? Appreciate it.

  5. My wife completed and uploaded her D-260 and we had a question about the police report.

We live in Japan and the police department said that we cannot open the police report after receiving it. Is this standard practice? Has anyone been rejected for uploading only the front?

    Thanks

Any type of media that can capture the full and legible copy of the original document, be within the file type and size should be accepted by NVC.

We scanned some of our docs with a normal scanner (when at home) and some others we used scanning app downloaded on playstore and NVC accepted all our documents.

You can download CamScanner and try it.

Thanks everyone for the reply. As DJC mentioned, the Notes app on the iPad has a scanner built in already. The job just got much easier ;)

    Much appreciated!

  7. We’re beginning the process of submitting documents electronically to NVC. We don’t have a scanner at home, nor a computer. My computer crashed earlier this year and we’re just using an iPad (which doesn’t have a usb drive). Trying to figure out the best way to scan documents and combine pdf files.

Was wondering if anyone has used Adobe Scan to scan your documents. If so, have you ever had any issues? Has NVC accepted them?

    Appreciate it.

Use the figures from the I-864p for your household size, using the 125% figure.  Multiply that number by 3, and that would be the minimum in liquid assets you would need.  Your number doesn't fit any of the numbers there.  For a household of 2, the number is 21,137  X 3  = 63,411.

Bear in mind that just meeting the minimum is no assurance of approval.  It's a judgment call.  Probably would be wise to come home and get a job or find a qualified joint sponsor.  I see you have not yet become an A student of the I-864 instructions. Doing so, is going to be critical to your ultimate success.

Thank you for the advice. Today’s work is learning the instructions and reading all the FAQ regarding this part of the process. Much appreciated.

That's correct but for a spouse you only need 3 X the income shortfall.  When you say your "income here" do you mean in the US, or in another country.  If not in the US, or will not continue from the same source in the US, you enter $0 as your "current income you are using to qualify...." and your shortfall is the entire income requirement.

Become an A student of those I-864 instructions, NOW!

I meant to say my income here in Japan is very low. My income in the US is zero at the moment.

3x the Federal poverty guidelines @ 125% is $79,989, which is about what my assets total these days.

Now does it matter that my spouse who i’m trying to get this immigrant visa for has more than 100k?

  10. Hello,

I’m trying to get my Japanese spouse a green card. I’m currently living in Japan and my income here is very low but my total assets are around $80k (held in a US brokerage account, assets mainly stocks).

My question is regarding the Affidavit of Support form I-864. Can someone confirm that this is correct?

I have to fill out the form i-864 and select 1.a. ‘I Am The Petitioner’.

Because my income is under 125% of the poverty line, do I need another sponsor or do my assets count and put me over the threshold?

    Thank you community.
