    If you are applying for an IR5 (parent of a U.S. citizen) or F4 (brother or sister of a U.S. citizen) visa you must obtain an original (or certified copy) of your petitioner’s birth certificate.

    • You must send a photocopy of your petitioner's birth certificate to the NVC.
    • You must submit the original (or certified copy) and a photocopy of your petitioner's birth certificate to the U.S. Embassy or Consulate at the time of your interview.
  2. Hello everyone, last week i received an email ( STD P4 APP ) for my mom which means we are done with NVC finally after 10ish months due to a couple of checklists (my mistakes ). Now she has her interview at Bucharest on oct 14, we're trying to gather all her documents which is fine except for my birth certificate. the good ol question, original or certified copy? Travelstate in their guides says original/certified on the documents list but on the letter we've got it says code J which stands for: J -The NVC only received a photocopy of the document. You must present the original document at
    the time of your interview.

    So my question is will a certified copy stamped and notorized and all NOT DO at all?? i mean really, 100$ to mail a piece of paper just to make sure it gets to her. Thanks in advance and GL to everyone, hang in there its almost over.

Hello everyone, i've sent my I-751 back in june since then i've done my biometrics and received the letter saying that my stay in the US has been extended for 1 year with work and travel, you know, the usual, but when i try to check my case status online, it says case not found. Am i doing something wrong or wrong website or what? i havent received any letters or anything since biometrics..

    I believe it states you will be eligible for citizenship after 3 years of being a permanent resident. http://www.uscis.gov/USCIS/Resources/B3en.pdf

    So i have to apply for removal and then wait 3 years for citizenship is that correct? also if i remove the conditions do i get a new green card or is that another bill?

Ok so, i have a 2 year green card close to expiring ( end of june ) came here on a K1 visa, got married and all, when do i apply for citizenship? me and my wife already did and they sent the package back, now if i remember correctly the lady when i got my green card said to apply 90 days before it expires, my question is....could it be 3 years of marriage OR 3 years of green card based on a marriage(resident)? if anyone could answer it would be great, do i need to renew my green card if its not the 3 years of marriage option? and if green card renewel is needed what for do i need and how much does it cost etc.

  6. Two last questions, was the I-134 filled by the USC or the LPR, i presume that the USC with both persons income in it, and last one, was the interview in english or romanian? i want my dad to be prepared as best as possible. Once more thank you for the help,I appreciate it :)

  7. Ok that i understand so far, but your mother inlaw came to visit did she mention staying with you guys or something like that? As far as i know if he does apply for visitors doesnt he need to have enough funds in an account to prove that he can support himself while vising here? Thats the one part i am confused about, if he does apply will he mention me and my wife? staying with us? us having enough money to support a 3rd person ( which we do by alot )i know he needs to prove that he will return to Romania and that he has ties there which would make him come back.

  8. Hello everyone, my question is are there any permanent residents out there that have had their parent/s visit them? and how did they do it? I will be ( or hope to be ) a USC next year but am hoping for my dad to visit me if its possible this year for 1 month or 2, how would we/he be able to come, i know i cannot petition for him but am looking for a way that he can visit, would appreciate a detailed answer/experience with this issue.Thanks in advance.

Hello, i'm currently a US perm resident and i wish to bring my dad for a few months, as far as i've seen on the forum it can be done using I-130? but i need more details on what exactly is required to get this running, i've been here for over 2 years, married and all with K1 everything went great no problems at all in anything that was filled, my dad is still married, he is on my birth certificate umm, i dont know what else there could be thats why i need some help. If anyone can help with this issue i'd appreciate it very much.

    Oh, and the link to USCIS says that the I-130 is for kids/bothers/sister?? nothing for parents so i'm confused.

  10. The obvious question is did you mistakenly send the 2007 tax return that was filed in 2008 in place of your 2008 tax return which is due by April 15th of this year?

    just asked my wife and she is saying that it might be the 2007 one cuz she made some copies of the 2007 and 2007 and they might have mixed up, but if that is not the problem any idea what it could be? there isnt anything off 2009 to send in correct?

Ok so me and my wife filed for AOS and EAD at the begining of february, check got cashed everything looked great, we went on a trip to Hawaii ( no problems at all at airport just have your passport with you they wont check for anything else ) we get back and we received a letter with my biometrics appointment, we were really excited so we waited for the date to come ( 14th of march it was i belive ) we did the biometrics ( took like 30 mins, some form filled out, fingerprints and a photo ). A few days later we received a letter saying the following :

    " request of initial evidence I-485."

    plenty of explaining done there to why they've sent this letter but what makes us wonder is the following:

    " The petitioner/sponsor submitted a federal income tax return with form I-864. However the federal tax return was for a prior tax year. in order to process your application further, submit federal income tax documents for the most recent year."

    Now, we know that we sent the federal tax income for 2008 but what exactly do they expect? isnt that the most recent tax year? unless there is something in the 2 months of 2009 ( 4 now ) that we can send them, i just have no clue of what it could be and neither does my wife.

Awhile ago me and my wife filled for AOS and Wrok Permit, we also sent the check that was required $1,010.00 ( 930 for AOS and 80 for Biometrics ), we received our Notice of Action papers via mail and got really excited to see that everything was fine we had sent all of the papers ( they sent our package back the 1st time due to the check being more than required ( what nice and honest people :hehe: )). Now what my question is to i have to pay anything else? it says on their website that if we filled for AOS same time as Work Permit or something like that the Work Permit has no charge, also its been said on these forums as well, i just really REALLY want to make sure, because on the Notice of Action it says ( on the AOS one ) " Notice Type : Receipt NOtice Amount Received : $1,010.00" and on the other paper ( I-765 ) " Notice Type: Receipt Notice Amount Received: $0.00 ".

    As i said i just really want to make sure and not cause any problems, so if anyone that received these papers can give me some answers and clarify this " problem " that i keep thinking of, i would very much appreciate it.

    Just saw some posts on the forum regarding this issue and seems like 1010 is the total amount, i still want to make sure that is what its suppose to say on the papers.

  13. In some states you can use receipt notice from I-485, marriage certificate and passport to get an ID when I-94 is expired and AOS is already pending. It does not apply to Driver`s License because you need SSN to apply for those and you can only get it when receive EAD. So, I would suggest you to go to DMV and give it a try.

    well i already have my SSN so that wouldnt be a problem. and if my passport will work as an ID then its fine with me, but yes if i have the receipt it should allow me to make an ID, already have 1 made after the visa but it will expire when the visa does.

  14. does the AOS cost 1000$? does the EAD cost 340$ while applying with the AOS or it only costs 340$ within 90 days or US arrival?

    do they renew the visa after applying for AOS or how would you get an ID if the visa expires while they process your AOS. what actually makes you secure in the US after visa expires? i currently have an ID but my visa will be expiring soon therefor the ID as well ( ID was made after the visa info for when to expire ). Thanks in advance.

    AOS is $1010 ($930 fee + $80 biometrics) and includes EAD/AP when file concurrently or after the I-485. EAD if you apply BEFORE AOS (I-485) is $340 and in my opinion is a waste of money, as it will time-out with your I-94. Your visa expiration has no meaning... the document the has meaning is the I-94. If you arrived K-1 there is no extention to the I-94. In most states, any ID's you have will expire until such time as you can properly document your legal presence. In most states that is with AP/EAD or Greencard after your I-94 has expired. You most likely will have a "limbo" period.

    so i wont have any ID untill i get my EAD? and yes the I-94 is expired. i have a K1 visa.

  16. so me and my wife got married a few months ago, we didnt apply for either AOS or EAD, the big problem is that my visa is about to expire, we have no idea of what to do or how to file in for AOS or EAD ( as in both at the same time or how ? ) i'm really worried that i will be sent out of the US and banned after all the work we did to finally get together. Please help us. :crying:

  17. I finally arrived home! And I got the visa :dance: ! Now I`m going to start looking for a plane ticket :dance: ! I`m still tired after the trip to Bucharest....but happy!!!

    omg now way! me too !! grats :D totusi m-as fi bucurat mai mult daca ni le si scoteau :(, still yay us! once its all over you realise that everything at the embasy was pretty easy. got my ticket :) 17th february 8:25am its bye bye for me :D

    now what was the name of that mailing company? i forgot it >.> but i got my tracking number..
