  1. Thank for your answers so far. I live in Pennsylvania but I don't know if that's relevant. My main concern is if getting on Medicaid will break the rules of the affidavit of support. Maybe it would be okay to get on Medicaid if you came into the country with a different type of Visa that does not require an i864 to be filed...I have no knowledge of anything other than the K1 though

  2. Hi all! Just for context: I came to the US on a K1 visa a little over two months ago. I already got married and sent my AOS package (work authorization, travel authorization and green card forms) as well, going in for the biometrics appointment tomorrow!

     

    After many trials at the social security office, I finally received my SSN last week and went on to  look for health insurance in the marketplace (healthcare.gov) since I cannot be added to wife's insurance because she's on her parents'. It tells me I'm eligible for Medicaid...

     

    After researching this a lot, it appears Medicaid is not grounds for public charge, but it is a means-tested public benefit. The affidavit (i-864) my wife and her sister (co-sponsor) signed has a little paragraph saying the sponsored person cannot receive any means-tested public benefits.

     

    Very confusing...I just want to know if Medicaid is okay or not from a legal standpoint, it makes no sense that the healthcare website would let you receive Medicaid after you just input all the information about being a foreigner recently married to a US citizen if it was illegal.

  3. Hello everybody. I was approved in my K1 visa interview two weeks ago and I'm getting ready for the big move. One thing that concerns me is health insurance. My soon to be wife works as a Chef and has no benefits whatsoever from her employer, she's still on her parent's coverage and I can't get on that one (we checked). I read a lot of old posts in this Forum about the topic but couldn't seem to put together the best course of action for someone in a situation like mine.

     

    Essentially, I want to be covered until I get my worker's permit and hopefully get a job that provides health insurance. There seemed to be a general consensus that travel insurance would not be suitable because it wouldn't meet the conditions required to avoid the tax penalty, which is no longer a thing as of this year. That being said, is travel health insurance now a possibility in this case? Or the fact that this is not a travel situation disregards it completely?

     

    I also found some providers like Patriot America that claim to offer insurance for K1 visa holders, I just can't figure out if those are only valid for the time when you haven't yet got married or valid for as long as you purchase it for.

     

    Any advice would be greatly appreciated. Also, if I failed to see a post that could possibly answer these questions I apologize in advance and I'd be thankful if someone could point me in its direction.
