To 2nd this post, stop using regular mail. Just pay more for security, and it will be well worth the cost when you receive your mail in a few days instead of worrying about it for a few months.
We had many problems with the mail service to and from Nigeria. a personal friend working at the postal service say that mail is not sorted nor handled correctly at many of the postal places and many things get lost, misplaced or stolen. it very hard to locate mail when it gets to nigeria, and mostly just luck if it gets to the destination. sorry for your situation and i hope what other person posted could be of help. for next time, always use DHL or FEDX as these are reliable although maybe cost more. but it worth it if its important documents that are needed. Good luck in your process, i hope you able to locate the documents. -

OK, I'll play: Why did he not return to his native country with his family before his tourist visa expired? If he entered with his family on a tourist visa and now wants to stay with his "family", are we talking about the family he entered with or are we now talking about his new family (girlfriend & child)? It is unclear if the entire family overstayed their tourist visa's or if you are speaking of his new family. Either way there does not seem to be much hope of legally staying. But it may depend on your answers to these questions.

He entered with his family, and they all over stayed on the tourist visa. And Lou Dobbs does suck!

Okay, let me clear somethings up for y'all. The question that I originally posted is not concerning my husband and me. It is a friend of my husbands from church who legally entered the US on a tourist visa with his family, and didn't return to his country when the visa expired. Now he has a child born here and he wants to stay legally with his family. If that enough information? If anyone feels the need to respond with a "Just go home and do it legally like everyone else" I watch enough Lou Dobbs on CNN, thank you very much.

Just how to become a legal immigrant if you are living here illegally. I already know you can't get become legal through the children unless they are over 21. In this case, the child is only 1 years old. And like Mononoke said, if it was were so easy to come here legally, most of us wouldn't be members of this website. It's different when you have someone to filing for you, and even this there's no guarantee.

I just wanted to see if anyone knew any good websites with information regarding illegal aliens with American born children? As far as I know, the best thing to do is get a good immigration lawyer, but I want to look up some information before I give that advice.

To second that last post, the A# should be on in his passport on the visa....at least that is where my husband's is. He didn't receive work authorization at his POE and he received his SSN with no problems. They did as for his A# though, but like I said, you can find it in his passport.

Yeah, I did the same thing the last time I went to Nigeria. I mailed in my application on extremely short notice, then forgot it was a holiday week (4th of July) and that they were closed on Fridays. The good news is they are actually open for phone calls, but closed to the public. I was to leave on a Saturday, and when the Friday mail came, I still had no passport!!!! I had a terrible time trying to get someone to help me, and the people (one nasty receptionist) was soooooooooooooooooo rude! I finally just went through the telephone directory for the consulate and started picking out extensions so I could talk to anyone. I was desperate. I got somenoe on the line from Lord only knows what office and I hurriedly explained that I was supposed to leave for Nigeria the next day, but that I didn't have my passport. I asked him to take down my number just in case we got disconnected, and I asked for his. After a lot of running around on the phone, he got me to the right person and they found my passport. They were willing to overnight it to me and I would have it by 10 am the next day. I told them I was leaving for New York at 6 am in the morning, so there was no way. They ended over nighting (I had to pay for that) it to New York (there is a FedEx at JFK airport) and I went on faith that it would be there when I arrivedere. It was, and to God be the glory! Lesson learned though...stop procrastinating!

I'm sorry to hear about the trouble you are having with your case. I'm sure everyone here knows exactly how you feel right now. This waiting game is frustating, stressful, and draining. I pray that you stay encouraged, and not let this stop you. I filed for my husbands (CR-1) in June of last year, and it took precisely 13 months. I don't think you would have to wait 14 more months with your case, especially since your CR-1 is already approved. That's half the battle right there. If you use shortcuts, you can get through the NVC in no time. Be encouraged and God Bless you and your family!

To add to what the others have said, it's yes to both questions. They already have the information in their system, so if you say no they will bring it up to your husband and it will be considered lying under oath.

I used a calling card from a website http://www.comfi.com they have cheap rates for all over the world. If you are calling a cell to Nigeria, it is still expensive. My husband bought a land line cell phone that had had the prefix 234 1 xxx-xxxx . Any number like that is very cheap. This website does keep a log of your calls that you can print out.
