    Just a clarification and an addition to the post I just made.

    I was talking about 2009 because we filed extension for the tax year 2010. Although our CPA is in the process of preparing it for us. I am just hoping that he will get it done next week. In this case, we need to wait till it is filed and ready to go together with the I-864.

    And got an info from NVC with regards to question #23. The entry here as the lady said, should be an estimate of the current year's income which is 2011.

    The lady was helpful and answered my questions. Not the one I anticipated.

    Years ago while working for my green card renewal, USCIS people are not very helpful and friendly.

    NVC people are OK! Also you get real people if you call the number 603 334 0700. You just need to be ready with the NVC case number and the petitioner's and beneficiary's info.

    I’m back after years of being away from this VJ, work made me very busy both the real job and the job here at home.

    I’m back because we are in the process of petitioning my son from the Phils. We are in the I-864 stage already and this form is so confusing to fill up.

    My husband being the petitioner is self-employed and manages a real estate business. But at the same time we have a JOINT INDIVIDUAL TAX RETURN being husband and wife.

    Here is the question:

    23. MY CURRENT INDIVIDUAL ANNUAL INCOME IS: ___________??????

    What figure should be entered here?

    2009 is one of the toughest years for my husband. IF THE GROSS INCOME is to be entered here, there is no problem because it is way above the poverty level.

    BUT if the net income is to be entered here, here comes the problem, it is way below the poverty level.

    NEED YOUR INPUT MY VJ FRIENDS, desperately need your help.

    since getting mail in the philippines is a long Journey

    The lady at NVC said, the form can be faxed or email (scan and then email) or mail using the usual post office mail to the beneficiary. Have the beneficiary sign it. If there is an agent that you wish to assign then the line should be filled up. Remember an agent is the person that will be recieving the mail regarding future communication between NVC and the beneficiary, if the petitioner is in the US. And then once the form is complete, it can also be emailed or fax as per the NVC lady's response to my inquiry.

    I just called the NVC with regards to DS 3032. The benificiary should fill up the form and sign and then mail or fax or email if back to NVC and then we wait for further notice to pay the $400 something for the Manila interview.

    I was also very confuse on this form. I noticed it today that they have enclosed something there to fill up and complete. We recieved the mail 2 weeks ago and has been sitting here for nothing.

    Now, we have to send this form through email to my son to fill up so we can send it back to NVC right away.

    I don't know if there is a thread for interview questions.

    You and your spouse should be prepared of the ff:

    - how. where and when did you meet

    - know your wife's/husband's parent's name

    - know your wife's/husband's children's name (if there are any)

    - your wife's/husband's birthday/birthplace

    - if you have plan of having children together or you do not have a plan - be ready for a confident answer to this, because most couple who comes to the interview whose wife is pregnant gets approved right away :thumbs:

    - ETC...

    Just sharing my thoughts.

  6. Agree with JeremyR on saying nothing!

    Oh I hope the IO did not mix up another couple's file with yours as it may mean the other couple may receive a denial message as they fail to submit additional evidence (as they never was asked to).

    USCIS wanted to see more documentation showing both our names together, like a utility bill, joint account, etc..., so I don't think somebody's file can be mixed up with ours since the AO would be looking for our names in whatever submitted documents re: our case.

    But the big BUT here is that my AOS is pending due to AO needs to see more evidence of bonafide marriage. The AO gave us a checklist of the documents to submit and gave us until April 24 to comply. We are about to send the documents because I have all documents ready for mailing today or tomorrow.

    I have filed for EAD extension January 24, since the first issued card expired, and actually waiting for the new card to come until I received this email from CRIS and AOS approved?

    IS THIS A MISTAKE? ANYONE HAD THIS EXPERIENCE? SHOULD I CALL THE 1800 number to clarify or just let it happen? :unsure:

  9. Are you sure that I can do a walk in appointment? I live about 30 mins away from local USCIS office and it is no problem for me to go there at all.

    I am not sure if they allow that, but if you live close, why not try go and do the walk in. I have read somewhere in the forum about going for biometrics as walk in applicant. Maybe a NOA to present will be accepted.

    Again, I am not sure about this :no: . Just trying to make a suggestion.

  10. ok, I am soooooo annoyed with USCIS right now... I called more than a week ago to find out what happened to my biometrics appointment and they sent me an email today saying this:

    Your application information has been entered into the system which schedules applicants for biometrics at their local Applications Support Center. We are unable to determine how soon you should receive the Appointment Notice. Biometrics appointments are scheduled as slots become available at the Applications Support Centers and some Centers have a waiting period of 30 to 60 days. Once you have been scheduled for an appointment, you will receive an Appointment Notice to appear at a certain date and time at your local Applications Support Center. You must take the Appointment Notice that you receive with you to your appointment.

    Seriously... I dont know what else to do other than waiting for another 45 days to set up an infopass appointment.

    Just a suggestion...

    If you live not far from a local support center that perform the biometrics, I suggest you go as walk in applicant. I think I have read this somewhere in the forum. If you have a NOA that says they recieved your complete application, bring it with you.

  11. We applied for AOS in November of 2008. A few weeks after we submitted the applications we received a biometrics appointment. We have since received the EAD and AP. We were notified that our case had been transferred to CSC. Yesterday we received a second biometrics appointment. Is this typical before the CGC is issued? Thanks

    I have two separate biometrics schedule, one for AOS and one for EAD. I could have taken it in one day together as what the biometrics personnel told me if I had showed it to them.

    Do you have a copy of the FORM 1A (transcription of Birth Certificate) issued by the Local Civil Registrar? If you have it, you may present it too. I believe the USCIS will accept that copy even if this has not been authenticated by NSO. Again if the data and information that you have in the FORM 1A is the same with whatever you provided the USCIS, then I believe you will be fine.

  13. YES it needs to be..when you apply for a birth certificate.

    yeah my original birth certificate has that, but the nso dont have in their copy. i just requested for the best copy which they can give me, is this fine? i am just a little worried since number 13 in nso birth cert is just blank, bdw, number 13 on nso birth cert is all about doctor name signature date time i was born.. anyone who had this and make it to interview?

    As long as it is NSO issued Birth Certificate in Security Paper, it does not matter if there are blank entry. And as long as it coincides with the data and information you provided with the USCIS, you will be fine.

    You said your birth certificate issued by NSO is not clear, it is because NSO issue birth certificates in Security Paper, that is an image of your original birth certificate.

    I believe, USCIS is not concerned with the kind of paper the birth cerficate is written, as long as it is in English. The Form 1A is very clear because as it is a transcription only of your birth certificate.

    Just to share with you because I have worked with NSO before.

    I tried that before when I was still in the Philippines but the NSO people said that things had changed and they can't issue an authenticated 1A anymore if they can issue an authenticated BC. They said it works before but rules has changed.

    The Local Civil Registrar issue FORM 1A and not NSO. NSO just authenticate the FORM 1A issued by the LCR. As long as the all the data and information that is in the FORM 1A is the same with the NSO issued BIRTH CERTIFICATE.

    I am sorry to hear that they have changed the system. Then I guess you have to request for a clearer copy of your BC online.

    I have got two RFEs (together) against my AOS application. It has been mentioned in the RFE to contact 1-800-375-5283 for further assistance etc.

    I tried sooooo many times but dont seem to get the option to talk to a real person - only voice automation there ?

    Anybody knows how to get hold of somebody on that number ?

    Hi, try this option... press 1 then press 8. This is about inquiry or you want to ask information about a case that has been filed. This will direct you to a real person. I called yesterday and spoke to a USCIS customer service.

  17. I understand how this upsets you. It affected me the same way in the past. Even to the point that I thought I may be asked to go back where I came from, that scares me a lot.

    I mean, I know the one's doing the Visa process the legal way(this means us) have been required to do so many things and required of so many documents, while the illegals are getting all the conveniences that they can get without going through these long medical process.

    Like you, most Filipinos get a PPD test positive since we were also given BCG when we were small. But this fact does not stop the health department on requiring from us the medication (if necessary), because even if XRAY result is negative and PPD test is positive, a medication is required for prevention.

    I may not be 100 percent correct on this, just trying to share from what I have learned during the process.

  18. Do these Clivil Surgeons know what they are doing in regards to PDD testing ? I am from the UK got married to a usc (nice) I did my examination in Feb 09. I had a positive PDD result 20mm according to the doc, I took a X-Ray, the results were negative but my Clivil Surgeons insisted that i needed make appointment at the public health hospital for further evaluation. I have read several articles regarding the technical process for Clivil surgeons in which it state that :

    CDC and the American Thoracic Society recommend that foreign-born people in the United States who

    are recent arrivals ( within 5 years) from high TB prevalence countries, who have a positive TST

    (reaction of 10 mm or greater of induration) and a normal chest radiograph be considered for treatment

    any body is interested.

    I mean, this all seems like a money making scheme to me and an affective way to test new medication. :wacko::blink::wacko:

    If ppd test results positive(I dont know for sure how many mm is considered negative), even if x-ray result is negative, I believe you are advised and required medication most especially if you have not been through medication in your country of origin with regards to tb. Usually, the US Department of Health assigned the local or public health clinic to do the testing. If you go to a public health clinic, you are not required a payment. They perform the XRAY and PPD test on you and then they will determine if you need medication. They will ask questions like if you have undergone medication or not. If you haven't then they will recommend medication. This is not something to worry, they are just making sure the intended immigrant is not a danger (healthwise) to others.

    My husband and I are in the process of trying to adjust his status. We received a notice I-797E basically request for additional evidence for the I-485. This is their problem and I quote from the notice. "Delayed registration: It appears that the birth certificate for the applicant (name) was a delayed registration. Please submt secondary evidence to support the claimed date of birth and country of origin. Do not submit new or recreated evidence. All evidence presented should have been created prior to the child's 14th birthday. Examples of evidence are school records such as report cards, baptismal certificate issued by church, midwife, doctor's or hospital certificates displaying child's parents name and date of birth. Note: Affidavits may only be submitted if primary and secondary evidence are unavailable. and must be by two persons who were living at the time of the event."

    The reason for the letter was during the initial stages when I was gathering information for my husband for the K-1 visa, he did not have his birth certificate and so went to the office in Ghana and got another issue of his birth certificate....however the date of birth and everything on the birth certificate and name is correct the only problem I guess that immigration has is the fact that the date the birth certificate was issued by the court was dated currently 2005 and they wanted to see a date that was issued maybe in the year he was born????

    I do not have the supportive documents such as school records, baptimal certificate or hospital records to provide immigration so I do not know what other evidence I can use to show his date of birth?....I can get an affidavit from his biological father but his mom had passed away a long time ago...

    I believe the reason why USCIS asked for documents showing his birthdate and other pertinent information is that because a birth certificate can be falsified anytime. Someone could just create a name so easily and then make up date of birth and then register it. So, if you can show and submit documents showing the same information like the baptismal, school records, etc, then that will tell that the person is really born in that date and year. Most of the time, a civil registrar where the person was born is the only authorize agency who can issue a person's birth certificate.

    An affidavit from a person who know the birth of that person, in this case your husband, will be sufficient to support his birth. A witness who was there when your husband was born, maybe a neighbor, a friend of the parents or whoever.
