you don't need to be arrested to be served with a restraining order.

the case being dropped does't change that you were served.

Thank you for the clarification. I do remember having to go pick up the papers of the order which sounds like it counts as being served. With all things considered, is it necessary to wait for police reports to include? I am unsure if any exist or if they would add value.

  2. I should note that this is only being asked as I checked yes to the question "indicate whether you have been subject to a temporary or permanent restraining order." I said yes to this as I was subjected to a temporary one, but now I'm rethinking if that was correct since I was never arrested, charged, or went to court for anything.

  3. Hello,

I recently received an RFE requesting police and court records for a temporary restraining order that occurred in 2014. However, I was never arrest, detained, or charged with anything and was only given court records saying I can request a court date if I'd like (I never did and the case was closed with no action). In calling the police station, they told me it can take upwards of two weeks to obtain records if they have them. This is not ideal as we would like to get the paperwork moving along.

My question is, considering I have a clean record with no felony or misdemeanors, is it necessary to include police records? Or should I go ahead and respond to the RFE including only court documents and an explanation of the incident? The only thing that would be available from the police, if any, is what the officer took down on the date the incident occurred.

    Thank you for your help!

  4. I submitted my I-129f for my fiance living in Vietnam on Mar-20 and received my NOA1 Mar-27. I have sent an inquiry to the USCIS website about my case status as their website indicates any applications prior to Apr-12 might be late. The processing times on this website also say the latest applications accepted were from Mar-30. Are these dates accurate and should I be concerned mine has not yet been processed? Or is this expected with the Covid-19 situation?

    Thank you for your help!

  5. My fiance and I have just finished the I-129f form and are preparing to submit within the week. However, I also just purchased a new house and will be changing my address/moving in during the month of April. My question is, considering I will be closing on the house within the month, for the I-129f form should I include my new address I will be moving in to in April or should I include my current address and submit a change of address form once I reach my move in date? I am assuming I would send a correction but I just want to make sure that is appropriate as extra steps is always more confusion. Thank you!

  6. Sorry, I should clarify. I meant expedite as in I wanted to finish the paperwork quickly. Not expedite as in per the expedite requirements of the I-129f. I agree the CRBA is the best route to go once the baby is born since it will be born in the Philippines.  However, I won't be able to visit again for a few months so I think my best bet is still the K1 visa (unless there is something I'm missing). Just making sure I am fine leaving the passport fields blank for her on the I-129f.

Thank you all for the fast responses! You are all very helpful.

  7. My fiance and I recently found out she is pregnant (yay!) and as a result are trying to expedite the k1 Visa process. However, she has been having morning sickness and unable to finish her passport papers as of yet. My question is, does she need to have a passport at the time I process the K1 Visa or will I be fine leaving the fiance passport fields blank and putting in my reason why in the additional attachments? I would like to do this as quickly as possible but also want to ensure I have the best chance for success as well. Thanks in advance!
