  1. I married my husband in Feb. 2011 and he received his greencard in June 2011. He has been in the US on a work visa since 2008. He did not get his taxes for 2010 filed because he did not receive his w-2 from his employers prior to moving out of state. We were expecting a baby in Sept. and meant to get this taken care of, but time got away from us. Here we are, approaching the end of 2011 and realizing that we better get this taken care of. We are in the process of requesting another copy of the w-2 as I assume it's better to file late and pay penalties than not file at all. Does anyone know the implications of not filing taxes during a work visa?

  2. We were APPROVED!

    The appointment was scheduled for 10:40 and we were called back around 11. The interview only took about 10 minutes. The IO simply verified that all of the information on our application was correct. She looked at our passports and asked to see if we had any new documents showing bonafide marriage. She already had our health insurance, so we showed her our auto insurance card that had both our names on it. She asked us what each other's birthdays are, how we met, and where our children live. Then she looked at some photos and congratulated us on our pregnancy. It was very simple. She said the green card should arrive within 4-6 weeks, but I can see that many of you only had to wait about a week or 2. GL to the rest of you awaiting your interviews!

  3. Wow, I am so happy to see all the AOS approvals! What's even better is that all the experiences that have been posted have all be positive. Our interview is this Friday. I read where someone had difficulty getting their driver's license with the EAD...I am hoping we don't encounter that. I need to add hubby to my auto insurance policy since he uses the car for job interviews while I am at work. He has an international DL because his previous state DL expired and he couldn't renew it without EAD. My insurance guy said that adding someone with an international DL is much more expensive, whereas adding him with a state DL will be no additional cost. We'll be heading to the BMV tomorrow after I get off work.

    We've gathered all the documents indicated on the back of the interview letter. We are ready and excited!

  4. EAD arrived today! Hubby left it on the bed and when I came home from work I squealed with joy. I said, "Why are you so quiet?" and he responded with "Why are you so loud?" LOL I'm pretty sure he'll be glad to no longer be a house-husband. The timing couldn't be better, I can be a housewife while he works for the summer, and then I'll teach for a few weeks followed by a nice long maternity leave.

  5. How much you wanna bet you will get your EAD the day before your interview?

    Ugh. LOL! While I'm glad we've got our interview date, we really, REALLY need the EAD. My husband had a job and started working, but had to stop because his work visa expired. He was told to come back once he had employment authorization. I'm going to have to take a day off work in the last few days of school to go to the interview, my principal is going to love that.

  6. Hello good people. It's been a while since I've checked in. We are still patiently awaiting EAD. We are unable to check our case status online (says our receipt numbers are not valid) so we can only rely on text notifications. I am optimistic that EAD is right around the corner, and then after that we'll be heading to the interview with my big, round belly in tow :) What are you all planning to bring to the interview? Are we supposed to bring pictures as proof of a relationship/marriage? I am in the process of making our first family scrapbook. I finished the baby's ultrasound scrapbook last night and will start the family one soon.

    I'm happy to see that some of us are already getting EAD and interview letters...I pray that the system moves forward with the rest of us soon.

  7. Hubby's biometrics was completed this morning, YAY! We arrived just before 11am and there was only about 10 people waiting including us. The IOs were in no rush at all, one of them was on her Blackberry lol. Hubby was given a form to fill out and we waited about 15 minutes. Then they called for a group of people who were there for biometrics and it took about 5-10 mins. Hubby was told that the EAD will arrive in the mail. We were in and out in less than a half hour :)

  8. Thank you Mrs. Finland. Hubby's SS card says something similar as yours. It's so aggravating not to be able to check online for touches. I guess we can just fall back on the text notifications that we sent along with our AOS package. That's better than nothing at all.

    We are planning to do our walk in biometrics on Thursday morning since the ASC is closed on Wednesdays.

  9. For those who already have a SSN, but are waiting for EAD because the work visa has expired, will it be required for them to go to the social security office prior to getting employment or will they be able to start working immediately?

    Every time I try to check my status online, it tells me my receipt number isn't valid even though I am taking it directly off the NOA hardcopy. Grrr, is anyone else still struggling with this?

  10. I am happy to report that the biometrics letter arrived today. My husband is scheduled for April 25th, and we will be attempting out walk-in next week. Our ASC is in Indianapolis which is an hour drive from our home. We are planning to take a leisurely trip, staying the night in a downtown hotel, and so some shopping. It's time for us to stock up on some good ole Jamaican and Filipino groceries since we can't get it in our town.

  11. I sure am glad I read this, it cleared up a few questions I had.

    So do all the service centers allow early walk-in appointments as long as you have your biometric appointment letter? The Indianapolis Field Office website says you cannot visit unless you have an appointment scheduled by USCIS. It also mentions INFOPASS, but it never specifically stated anything about early walk-in appointments. How can I found out for sure if we can do the walk-in?

  12. so we live in manhattan and we are assigned the one in downtown Varick Street

    I got up at 6:30ish and arrived around 7:30. there were around 25-30 people waiting (i was getting really anxious, since there were so many people), even more people were coming every second.

    at 8:0 o'clock guard say `please take out your appointment letters`, so we did. he went one by one everyone's papers. when it was mine turn he said `hmm, naaah that's fine`, i was like pheew lol

    Went to the 10th floor, The first lady at the desk checked my appointment letter again, (I was like ooh snap...) but nothing was said about anything. filled out the form and went to the second desk.

    There another lady checked the appointment letter again said ok, technician came and took me to the FP area, done the fingerprint and he said you should receive it in a month.

    then I talked about my I-485 problem to him, first he was unsure but then talked to her supervisor. She found my case thru the system and printed my appointment letter for the I-485 biometrics. then he continued with that FP. nothing was said about any date except after all done, technician said don't show up on the 4/20 (I was like duuh lol)

    by the way my printed I485 appointment was scheduled to 4/20, even later then EAD appointment which it was for 4/15

    they are really nice people, not like one of those ( i-dont-wanna-be-here-employees of DMV)

    now let's see how this will affect the overall process.

    Boy am I impressed at how smoothly things went for you! So, how does EAD work now that you've gotten biometrics taken care of? Do you still have to wait for something in the mail or are you now "work ready"? I really want to find out if Indianapolis has walk-in appointments too.

  13. Since you are adjusting status from a non-immigrant visa (the J1) based on marriage, you are filing the I-130 form along with the I-485. This form is what "gives you an immediately available immigrant visa number". You need the copies of the current visa along the application anyway, but the J1 is not what makes him eligible for an immigrant visa, it's the marriage.

    Have you also checked to make sure his J1 visa does not have a home stay requirement attached to it, i.e. he is not required to return home after his J1 status expires?

    Yes, his visa has "section 212e does not apply" written on it :)

  14. It is Choice A. Read the parentheses part carefully. You are attaching a relative petition, which if approved, will make a visa number available to him. (Common question, don't worry).

    Thank you very much! We did go back and read what was in parentheses. This part had us pretty confused when we filled out the paperwork earlier tonight. We then added a copy of hubby's Certificate of Eligibility for Exchange Visitor (J-1) Status that was stamped at the POE. Hopefully that will suffice what was being asked of us.

    We have spent the last 5 hours completing these forms. (Ugh! I'll only be getting about 4 hours sleep tonight.) Since the I-693 arrived earlier this week and I already received my tax transcripts, all we have left to do are the passport photos. We can knock that out tomorrow after work and head to the post office to send this puppy off :)

  15. My husband and I are starting the process of adjusting his status. He came to the states nearly 4 years ago on a work visa, and section 212e did not apply to him. We were married last month. On the I-485 part 2, where we are to specify the reason why he is adjusting his status from visa to green card, which option should we choose? We are inclined to choose option H and indicate that he is a J1 visa holder with exemption to section 212e. Are we correct in this assumption? None of the other options seem to fit us perfectly.

  16. My fiance came to the US on a 3-year J1 visa in 2007. It was noted in his visa that he is not subject to section 212e (the two year home-residency rule). When his visa was nearing expiration, he applied for a waiver. The USCIS website indicates that his case is "pending." He then sought legal advice, and was informed that he did not need to apply for a waiver since he is not subject to section 212e. His visa has now been expired for a few months, and we would like to marry and file AOS.

    Will we be able to pursue the AOS without any complications since he is not required to go back to his home country?
