my father was asked to send proof of his stay in Mexico since 2004 and will send the documents as soon as possible, assuming that would get him his visas approved, do you think the waiver will be based on him.

yes, both my parents are in MX. the minor at the time, was my older sister now a adult with 2 kids. my sister is not a US citizen. I petitioned my parents along with my brother both US citizens.

im sorry i forgot to mention that my father is also in the visa process but he wasn't asked for a I-601 waiver. he was asked to show proof of his stay in MX since 2004 because he didn't get a signed form from a immigration official that show proof he left the country voluntary.

okay that's good to know. My parents where denied citizenship and deported because they filed wrong. At the time their lawyer asked them to filed as Refugees from MX assuming they'd have a better chance of approval. its been 15yrs since they left and know want to come back but as for hardship quality, are you referring to extreme hardship of is this different

i have filed all the forms up to this point and i have reviewed I-601 Form and looks like basic information but i wouldn't know what documents of proof would be used for a waiver based on family unity other than
-birth certificate
-passports
-SSN
-Pictures
-School Reports
-Medical Records
-police certificate
iam going to consult with an attorney before i go forward, just wanted to know the odds for this specific type of waiver. thanks

my mother received a blue letter after her visa interview, stating that she was denied a visa because she needs to file a I-601 waiver/I-212, she falls under the category 212(a)(6)(E) Alien Smuggling her minor daughter at the time. i assume she will need file the waiver based on Family Unity, just want to know the odds she has to be approved. Thanks
