    My question is when we received the NVC invoice number and case number for my daughter, the visa status shows F24 (F2B) and I was only able to pay the AOS Fee. When I checked under the applicant information, it is blank and my daughter's name is not showing as the principal applicant information thus not being able to pay the IV fee. After reading a whole lot of similar cases on VSJ, I believe that my daughters CSPA age will be under 21 so I decided to write an email to ASKNVC requesting for the CSPA on the 5th of February for my daughter. This morning, when I checked the ceac website just to see if there has been any update, I found out that I can no longer see both the Affidavit of support nor the applicant information. I checked my account to see if the AOS fee was reversed, it was not. 

     

    Am i not able to see it because my daughter's case is under CSPA review or this is something else entirely? Is anyone else experiencing similar case? Any pointers or help will be greatly appreciated.

    I had this exact issue literally 3 days ago when NVC sent us the visa creation emails. I have a sister too and we both got our emails the same day. I am covered by CSPA and she is 19 years old. We could pay for her fees but not mine. I filled the online asknvc form for CSPA review and called them along with contacting my congressman to speed up the process. They fixed it in less than 48 hours and I am now F22 and payed the fees.

    I mean I already filled the asknvc form online. My congressman inquired about it too and I've sent an email to every possible NVC emails but my I-130 petition was approved 5 months ago and USCIS just decided on its own that since I have a sister whose petition was still pending, that they wouldnt send my approved case to NVC so that they could send both cases together. And now after waiting for 5 more months, I have this CSPA issue and still cannot continue the process. Next months it will be 3 years for me since we first filed the I-130. I just dont get it how they can just put me on F2B(F24) just because my actual age is over 21. The whole point of CSPA is to prevent this and they only apply it after case creation and after we request for CSPA review which delays the process again for god knows how long. Even my I-130 was approved under the F2A category and they don't look at the approval notice they get from USCIS and say "Oh his case was approved as F2A, maybe I should make attention to CSPA since he is older than 21 but approved as F2A".

    Try requesting the petition to get expedited. There grounds for getting it expedited. I know one is financial hardship and health issues. There’s more but forgot what it was. That’s what we did. I read that on this website too.     Thank you so much. I sent an email to expedite too but I just don't get it how NVC doesn't make the calculations for CSPA age before creating the case.

    Try calling NVC at their opening time. Don't remember the exact time but sure u can find it googling it. Probably u will need to hold for a while to get an officer. Try calling from Skype, hangouts etc so u won't rack up a huge fee. Or ask your dad to call them from an US phone number.

    I finally managed to call NVC. The officer said he would direct this issue to her superviser. I am %100 sure my CSPA calculations are correct. I hope NVC resolves this soon.

    Today I got the email from NVC for case creation for my case but when I log into CEAC. There is no IV application fee to pay and my visa class is F24 even though my CSPA age is under 21 years old. As you can see from the picture I attached, my petition was pending for more than 2 and half years and when I subtract that time from my actual age at that time, my CSPA age is under 21 years old. My father is an LPR by the way.

     

    I filled the asknvc form but in the website it is said that as of February 3, they are responding to inquiries they received at December 10 so there is nearly a 2 month gap between filing and getting a response. I already waited nearly 3 years and this is really bothering.

    What office is your father interviewing at? It may still take some weeks between his interview and his oath ceremony - he is not a citizen until he takes his oath.

    Which F2 tho ? I am currently F2A via CSPA. My I-130 petition just got forwarded to NVC so it will take months for me to get to the US so he would be a US citizen during NVC process so automatic conversion might penalize me and change my category with longer waiting time.

  8. Hello,My father is a LPR who applied for citizenship some time ago and USCIS sent his interview letter which is set for February 4 next month. My question is that when my father applied for I-130 for me, I was under 21 years old and now I am 23 years old but  I am covered by CSPA. My case has been approved and waiting to be sent to NVC. If my father become a citizen before my process is done in NVC, can they change my category which F2A to F1 ? or can I keep my child status or do I become an immediate relative of US Citizen? Because if my category changes, it would extend my process since F2A is current in the latest visa bulletin but other categories aren't. I am not in the US by the way, I will do consular processing.

    Approval date : 09/10/2019

    Sorry I meant to say "I can't file for AOS since I am abroad(not in the US). And yes, I did inquire but they replied with a standart response, "we are doing everything we can to process your case blah blah blah".

  10. So here is my question,

    My father is a LPR and he filed the I-130 form when I was 20 years old which means I am under the F2A category but now I am 23 years old as of yesterday but my petition is not approved yet while my PD (03/03/2017) is current as of today. He's been a LPR for 5 years now and he wants to apply for naturalization. If he does , does it change my F2A category to F1 because I am not under 21 years old ? In the USCIS website there are 2 points that adress this issue :

    1-
    Child of LPR (F2A) Becomes Child of a U.S. Citizen (Immediate Relative)
    2-Unmarried Son or Daughter of LPR (F2B) Becomes Unmarried Son or Daughter of U.S. Citizen (F1)

    But there is no mention of a situation where a LPR files the petition for his child who is under 21 years old when the form is filed and then that LPR wants to become a citizen while his child is now 23 years old and his petition is not approved and yet his PD is current. Can we opt out of the conversion of category like "F2B to F1 ones" do.

    According to the CSPA calculator, no matter when my petition would be approved, my CSPA age will be under 21 years old because my PD is already current as of today. So logically, I should be considered either under 21 when my father becomes a citizen or my category(F2A) shouldn't change since the wait time for it is less.

    My PD is Nov 14, 2017 and I filed my application for I-485 in February 2019 and got the notification that the interview is scheduled to May 24th 2019. 

    The only weird thing is that I never received the approval for I-130

    I am not in USA right now. I can't file for AOS. I have to use consular processing since I am abroad.

    I am waiting for the NVC letter. The website says that the first step is to complete the Choice of Address and Agent (DS-261) form after receiving the NVC letter, and "Please allow up to 3 weeks for the NVC to process your DS-261 before continuing to the next step.". So up to 6 weeks for the NVC letter and up to 3 weeks before I could submit the supporting documents. Is this timeline realistic? Does anyone have a more realistic timeline for NVC processing?

    How is it possible that your petititon got approved while my PD date is earlier than yours ( 3 March 2017 ). I didn't get any RFE either. F2A category and it's been nearly 27 months for me.

So my Priority Date is 3 March 2017 and I am F2A category and according to the latest visa bulletin which is May 2019, my PD will become current this May but my petition still processing and not approved yet. I was wondering if this is a common thing and if there is anything I can do. I filed an inquiry for outside normal processing time but it just says "expect an answer till 25 April".

  14. My PD is March 3rd 2017 so it's been 2 years now and yet still not approved and according to the latest visa bulletin for April, my PD will become current this May. I can't open a case inquiry too because it says "the case is in normal processing times''. Is it normal to keep on waiting for approval when PD being current is so close to happen ?
