  1. Hello, thank you again to all the helpful people here donating their time.

     

    I am a US citizen living in Calgary Canada, I am soon to submit a I-130 package to start the IR-1 process for my wife who is a Canadian Citizen.

     

    I had some questions earlier that where answered by a helpful member of the forum, and this questions is related so I will briefly explain.

     

    I was reading the guide to submitting payment and noticed the instruction: "If you live outside the United States or its territories, and are filing your application or petition where you live, contact the  nearest U.S. Embassy or consulate for instructions on the method of payment.". The nearest Consulate here in Calgary does not process immigration paperwork, the only such consulate in Canada is in Montreal. It may seem like a silly question, but do I contact the Montreal consulate or the one closest to me like the instructions dictate? We are using a money order to pay.

    I'm only asking here first because from past experience, they are notoriously slow at responding to inquiries and this is the last step before we're ready to submit our application.

    Okay thank you for the reply, does that mean we must submit the 130 package at the Consulate and not mail to Chicago? Do we go in person to submit?

  3. Hello, I am a US citizen living in Canada and I'm applying IR1 for my wife so that we can move back some time next year.

    We are nearly done with the I-130 package, however Part 4 62.a on I-130 is causing some confusion. We are not adjusting a status for my wife, so we do not fill out 61.a or 61.b. So we must fill out 62.a - 62.c

     

    The instructions read: "The beneficiary will not apply for adjustment of status in the United States, but he or she will apply for an immigrant visa abroad at the U.S. Embassy or U.S. Consulate in:"

     

    From my understanding, we will be mailing our application to the Chicago Illinois lockbox, not applying at a Consulate. We contacted the consulate here in Calgary and the agent said we would not qualify for DCF with them. She also said that the only Consulate in Canada that processes immigration paperwork at all is in Montreal and that we would need to go to that post for my wife's interview.

    What do I put in this field? I'm at a complete loss.

    This may include: a job offer; arranging schooling for any children; obtaining a home lease or rental; etc. US posts in Canada are notorious for being picky about this.

    Thank you, would something like an acceptance letter to a University count towards this? I'm assuming it's up to the discretion of the agent.

  5. Hello, I've been reading up on the guides and forums for the past few days and finally have a question I'm struggling to google. Let me briefly explain our situation.

     

    I am a US citizen, who married a Canadian citizen, my wife and I fully completed the immigration process ourselves, and I have been living in Alberta Canada for several years now. I will soon be able to take my citizenship exam, and we have both decided it would be best for us to move back to the States and support my family for the time being. We are going use my father as a joint-sponsor, as I do not make 125% of the poverty line. The guide and other sources specify that the joint-sponsor must be a US resident, which isn't a problem, but it made me realize that It was not specified if I, the main sponsor, had to be a current US resident.

     

    So my question is, do I need to be a current US resident to submit IR1/CR1 for my wife, If so, what are my options? Simply move back to the states myself and remain separated a year?
