    MY FATHER IN LAW PASSED AWAY LAST JUNE 2006, AND NOW MY BROTHERS- IN LAW AND SISTER-IN LAW'S PETITION IS ALREADY CURRENT AS OF JUNE 2010. BUT HOW CAN WE FILE FOR A HUMANITARIAN REINSTATEMENT? WE WENT TO A LAWYER HERE IN SACRAMENTO, BUT SHE SAID THAT IT'S AN IMPOSSIBLE CASE ALSO THAT THE NEW LAW DESNT APPLY TO THEM SINCE THEY DID NOT LIVE HERE IN USA.

    PLEASE HELP.. :crying:

  2. Well our Consul said sure no problem and wrote on a purple card, then told us to go to another window for instructions to pick up. There we filled out the card with our phone numbers and the man told us to wait for our call to come pick up. I asked him if he knew roughly when it would be ready and he said he didnt know. I said it should be faster to pick up then have delivered Air21 and he agreed. This was last thursday, now its tuesday and no phone call yet im getting a little concerned because we are flying out on thursday. ( I know i shouldnt buy her ticket till visa in hand but the flights are quicky getting sold out and I really dont want to leave her here to fly by herself) However we will go back to embassy to see if maybe its ready for us, I just hope tey let us in.

    They will let you guys in, as long as you have your blue passport and her case number, then it will be no sweat. My dad did the same thing, they said you can pick up the visa at the embassy the next day but they'll call him on what time it will be ready, but I told my dad to just go to the embassy than wait for the call. Sure he did, and his visa was not ready yet, but since he has to leave that night ( he showed his ticket and his visa will expire the next day) then they were forced to have the visa printed and was ready by 12 noon.. :) Had his cfo at 1 pm and had his flight at 10:30 pm via PAL..

  3. How long will it usually take before the consul will read your expedite request regarding visa release?

    My parents case:

    August 2008- sent in petition

    Sept 2008- NOA1

    January 2009- NOA2

    July 6 & 7- medical at St. Lukes

    July 21, 22, 23- sputum test for my father

    August 12, 2009- Original interview date

    September 30- found out that my father's negative with TB

    October 13- Interview date

    October 14- Mother sent in NBI with aka, and her court record and dismissal of the case

    November 24- Mother received letter from Embassy asking her to go to NBI to have an interview because of NO CRIMINAL RECORD

    November 25- Mother went to NBI and had an interview, was advised to wait to hear from Embassy since NBI will send her interview outcome to Embassy, they said they have to wait a month or so to hear from Embassy

    November 30- sent a fax to Embassy requesting an expedite visa release for my parents

    December 14- called Visa information service and was told that Embassy sent a letter last December 11 regarding mom's complete court order

    December 15- sent in fax requesting for expedite release of visa of my dad (St. Lukes advised him he has to leave to country before December 23 due to sputum test)

    December 17- parents went to Embassy in Manila, my dad was personally asking if they can have a separate visa release (since after the interview, he said that he is going to wait for my mother's visa.. not thinking it will take this long)

    And my mom gave the complete court order already even if she didn't get the letter from Embassy yet.

    My dad has a visa expiration of December 23 due to his medical and my mom is January 21 (six months)

    We are still waiting for his visa release.

    Come Monday it will be December 21, he needs to have his seminar still and I need to buy him a ticket, if ever. He was asking for an extension but the people at Embassy said there's no visa extension.

    I don't even know if he will make it here before December 23. I've been emailing US Embassy too and been calling the Visa Information almost everyday, and has the same status.. :(

    Do you think it will be possible for him to get his visa and be here December 23? :( :( :(

I've been trying to look around for cheap tickets, you can check www.cheapoair.com, my parents in the Philippines were able to look for a travel agent and I've added her on my ym, her screen name is mEnChiE isAnAn and she gave me a qoute of 506 USD PAL from MNL to SFO. I also checked www.mangotours.com or www.santraphael.com/home.php

    MY mom got the letter Monday afternoon, and it says

    "This is regarding your immigrant visa application with the U.S. Embassy. The National Bureau of Investigation police certificate (NBI clearance) submitted in support of your visa application indicates that a case has been previously filed against you in Philippine court. To enable us to determine whether your case will have effect on your eligibility to receive an immigrant visa, we require a written explanation from the NBI indicating the resolution of the case. In this connection, you will need to undergo an interview with the NBI personnel. You may report to the Quality Control Section of the Identification and Records Division (NBI-IRD), Room 108, NBI Compound, Taft avenue, Manila, for the interview. Please look for Mr. Francisco Donozo or Jim Maniquis and present this letter. the NBI-IRD office is open Mondays through Fridays, except holidays, from 8-2pm. We will continue processing your case as soon as we receive result of your interview with NBI"

    So my mom had her NBI interview awhile ago (Wednesday, Manila time) and was told that she has no problem since the case was already resolved, she submitted all her documents so the NBI said that she's ok. And that US Embassy are the one who gets the NBI report every Friday. Anyway, my mom asked an estimated date when she will be able to get her visa and NBI said that she will be lucky if she will get it in a month's time after Embassy gets the report.

    Since St. Lukes advised my dad to leave the country by December 23rd, I will be faxing a letter to Embassy to expedite my dad's visa and not to wait for my mom.. that was told to me when I just called US Embassy.

  6. Hello people,

    I've called the US EMBASSY awhile ago, since it's been almost 6 weeks and we haven't heard anything since the last interview date of my parents (10/13/09). My mother was asked to send in NBI with her aka since her birthname was different from the name that she's using (MARILYN to MERLYN). SO she did and she send it in. But when she got her NBI, instead of NO DERAGATORY RECORD, it says NO CRIMINAL RECORD.

    When I send her first NBI record it says, NO RECORD ON FILE (which I sent together with her DS-230 to NVC). Then I asked her again to get another one since she might need a new one for her interview, so she did, and found out that she has a traffic violation which happened in 1991, and she never got the subpoena since that was the time when the Mt. Pinatubo erupted and my parents left our business in Olongapo and went back to Pampanga where we really live, but that was settled out of court before my parents even moved back to Pampanga. Since they don't have an interview nor a medical yet, they went ahead and processed it thru courts and took them 2 months to settle it and got her clearance. (It was a blessing in disguise that my dad's chest xray was put on a 2 month sputum exam which turned out to be negative)

    So when my mom got her clearance she went ahead and got her NBI and was able to get it, but without her aka name, so when they had the interview, she was not able to show it. Instead got another NBI with an aka, which she submitted the next day, after the interview.

    I've been calling 1-2 times per week for an update but they keep giving me the same answer which was wait for 6 weeks. Then I called a while ago and was told that Embassy sent a letter to the applicant last November 16, 2009 reagrding NBI QC.. the person that I was talking to as not able to give me a clear answer, and she said that she was just reading what was on the computer. She was not even sure if the letter came from embassy or from NBI.

    Can anybody here give me their 2 cents?? I am really lost here.

    I also petitioned my dad, but he originally told the consul that he wanted to wait for my mom too, but since he got a sputum test, St Lukes told him that he has to leave the country before December 23, 2009 or else he will undergo all the medical exam again. You think that I can tell them to go ahead and issue my dad's visa so he can be here prior to December 23? This is very stressful for me, since I wanted my parents to be with me and celebrate holidays together after a long time.

  7. My mom had the same case.. they were interviewed last Oct 13 and she submitted her NBI with aka, the next day 10/14. and until now, she is still waiting for her visa :(.. I've been calling the US embassy and they've been telling me the same thing, maximum of 6 weeks if we didn't hear anything to call back.. Goodluck to you guys.. Hoping to get the visa soon..

    Hi,

    Hope your mom gets her visa soon. seems it take a long time before visa is issued once the consul requires another document. It would have been of great help if it was clearly indicated in the requirements that those with corrections/ previous name get the NBI certificate with alias.

  9. Didn't you submit NBI clearance at the NVC stage?

    Yeah, I submitted that but it didn't include her aka name (she has a different name on her birth certificate but has a correction by NSO), and the consul still asked for her NBI with her birth name :(

  10. I forgot to mention too, that I asked my dad if the consul said anything about his medical not yet completed, but my dad said that the consul was reading the results when he was being interviewed.. and that they said that he's okay, it's just my mom who needs to submit the required document.

    We're still in limbo right now..

    My parents had an interview October 13, 2009, and was requested to submit NBI with aka which my mom submitted 10/14/09, then they took her passport.

    But they did not let them pay the courier service, they said just COD. They also took my dad's passport the day of the interview.

    As recommended by people here to call US embassy, which I did, and found out that we have to wait 6 weeks after my mom submitted her NBI. So from what I've read here, that is AP.

    When I called 10/16/09 at the US Em, the person said that they received the documents that they need and if we didn't hear anything to call them back after 6 weeks. Then, they also asked for my dad's case #, and I found out that he is also under AP, because they didn't receive anything from ST lukes yet (his sputum exam result which was negative). They said it is just initial sputum exam and if we didn't hear anything for 6 weeks to call back.

    I told them that, my dad already had a result, that's why they were rescheduled for an interview (Initially, it was August 12, 2009 but was resched 10/13/09). They went to St lukes, 10/06/09 for immunization, and was told and interview date.

    I called again last 10/21/09 and got the same answer. I thought that they will be able to be here for my bday 10/27.. but unfortunately, no, since we didn't get the visa yet.

    Anybody here that has the same experience as my dad?? or my mom? Or can anybody enlighten me about this.. :( I hope we won't wait for too long.. another question is, St Lukes told my dad that he has to be here in US before 12/23/09 ( 3months only).. so if we wait for too long, his visa or status will expire?? HELP!!!!

But they were asking my mom to get another NBI because her name on her birth certificate is MArilyn but all the rest of the documentations were Merlyn. But her birth certificate has a name correction under it. And that was corrected years ago when my mom was applying for passport. Needless to say, they still wanted her to get an NBI to be submitted 1pm onwards anyday except for Fridays.

    My mom was able to get an NBI under Marilyn but has "NO CRIMINAL RECORD", so I was asking them to go to TAFT AVE and asked for a letter of explanation.

    My question is: If my mom gets the letter of explanation and send what the embassy is asking them to submit, will she automatically get approved? and Get her visa? My parents told me that they wrote the address where to send the passport and the visa but they just did COD instead of paying it.

    Please help me.. please.. :crying:

    I assume that your Mom received a white slip and a blue slip. I also got these slips after my interview and submitted the required document 3 days after. I received my visa on the succeeding week.

    The AR can take several days to few weeks. No one really knows the exact timeframe. You should diligently call the Embassy to follow-up on your Mom's case.

  13. HELLO AGAIN,

    From what I was reading here, I guess my mother is under administrative review if she got blue slip? She was asked to get an NBI clearance under her birth name, which she was able to get the next day following her interview but has NO CRIMINAL RECORD on it. She was just asked by the Filipino who was getting the forms, and an explanation that goes with it. So the one who was getting the forms said, ok and took the certificate and explanation.

    I was asking my mom, if the person has said anything or if they will get their visas soon.. but she didn't. My mom siad they just took her passport and that was it.

    Will they review it then? And will it take some time? I already booked them a flight this coming November 1st but wants to make sure first before I will pay the ticket.. please help me.. Thank you so much.. :)

  15. Oh.. it's been a while since I got that letter. But from what I recall, it's not really 60 days that you have to wait for your greencard.. it will only take a few days to 2 weeks before you will get the 10 year green card in the mail.. that is just a timeframe..

    Do you think that if the sputum result of my dad is negative, and going to SLEC to give the medical certificate personally. Will they give the immunization already or do they have to tell him to go back another day?

    My dad underwent sputum exam at SLEC in Manila, Phils. They were told to call in Sept 29, but when they did, no results yet. Then SLEC called them Sept 30, and was asking for my dad's medical certificate since he was diagnosed with TB in 2008 but was cured. His smear test were all negative.

    My dad faxed his medical certificate in August, but SLEC couldn't find it so they were asking for my dad to fax it back again. My dad was asking for the result but was told that they don't give out results over the phone and to fax the medical certificate..

    I am just worried, I just hope that it's negative. I told my dad, to go to SLEC and personally give the medical certificate. Is that a good idea? ANybody in the same situation? Or knows what this mean? Please help... :crying:

  19. Does anybody here has the same experience?

    My dad had his sputum test done last July and had 0/3 smear test.. Was told to call Sept 23 for the result and then to go to St Lukes Sept 29 if the result is negative for the immunization.

    Come Sept 23rd, my dad called, and was told that the result was not in yet and to call back before 5 pm, they called again, now was told result's not in and to call back on the 29th.. Is this good or bad news?? Help.. :unsure::wacko::blink:
