I am reaching out as my fiance (EU citizen) and I (US Citizen) have submitted our I-129F petition for a K1 Visa.
However, in 2010 my fiance studied in California with a J1 visa under a non-government funded subsidy.
On his DS-2019 form it is checked off that he is subject to the 2-year residency requirements.
Our current attorneys managing our 1-129F/K1 visa confirmed with the university that he is in fact not subject to the 2 year residency and proceeded with our fiance visa application.
Would be great to get your thoughts or recommendations on this and how we should proceed?
Should we simply proceed as is, or consider a waiver?
