  1. Hi everyone!

     

    I got an email from USCIS saying they are ready to schedule an interview for Form I-485 (I filed I-130 and I-485 concurrently and applied to renew my EAD). I thought it would take like 10 months to get to this step...? I filed on May 4 and got this email on July 16. Is that normal? Does it just mean it's going to take months before they actually schedule one? I got freaked out by this update so any info that you can provide is greatly appreciated.

  2. Hi everyone!

     

    We mailed our concurrent filing on May 4th, and I got my two notices on May 16 (I-485 and I-765). I get USPS informed delivery and my husband's notice (I-130) was supposed to arrive on the same day as the other two, but for some reason the USPS delivery guy returned his to USCIS. We had to contact USCIS and request for it to be mailed to us again and we didn't get the notice back until June 1st. Now I'm wondering if that will set us back a whole month for getting everything processed. I know that the case status tool on their website is not super reliable, so I wanted to know how do they process cases in this situation. Do they move forward only until they ensure that all notices were delivered successfully? I appreciate any help with this.

    You mean they are not necessary unless he's above the 125% threshold? I thought he qualified as a sponsor by just being my husband and the person submitting the I 130. It seemed to me that showing a couple thousands would be better than a $0 but I guess it wouldn't matter in this case. Thanks!!

    😨 Wait, I thought I could submit two I-864? We were planning on submitting one for my husband as principal sponsor, one for his mom as co-sponsor, and with hers an I-864A for his dad. Can i do this?? He lives with me; the I-864A is for his parents household. 

  5. Hi everyone!

     

    I am putting together the supporting evidence for the form I-864. My husband is unemployed and his parents will be our co-sponsors. I have a couple of questions:

     

    1. My husband has his own bank account and the account we share. Would it be wise to include the statements and the total between the two accounts? I believe after paying for the forms' fees it'll be just a couple of thousands. I don't know if this helps or not since it's so little. If we should include it, how far back should the statements go? I thought the last month would be ok but I've seen people providing statements for the last 12 months, 3 months, etc. and I can't find in the instructions where they specify this.

     

    2. Since my husband's parents will be our sponsors and they don't include him as a dependent on their tax return,  their household would be 3 people including me. Their tax returns from the last three years are above $26,662, which is the 125% of HHS Poverty Guidelines for 3 people. I was planning on including their bank statements as well since my husband as the principal sponsor has really nothing to show. However, the form says that if the sponsor's income is above that 125% they are not required to show assets. Would it be better to still add bank statements? And again, for how far back?

     

    3. Besides a copy of their birth certificates/driver's license, tax returns, W2s, and bank statements (if we need to add those as evidence) is there any other attachments for this form? Are pay stubs necessary if they've been employed by the same employer in all W2s?

    Oh I just meant "we" as in all of us, me, my husband and his parents. Now that I understand it a little bit better, we'll send two I-864, one for husband and one for his dad, and the I-864A form for mother in law.

    Ok, so just to make sure that I got it right, I think #2 would be our best choice because we live with my aunt so she couldn't file I-864A. So if his dad is filing as a joint sponsor, he would have to fill out the I-864 and then his mom would have to fill out I-864A, correct? 

     

    In this case, how would they check Part 1. of the form? So far I have my husband checking 1.a. "I am the petitioner. I filed or am filing for the immigration of my relative." For his dad, he would check 1.d. "I am the only joint sponsor," correct? Now, for form I-864A does it matter that they (husband's mom and dad) file joint taxes? They do have assets separately that they could list, though. 

     

    Their total income is above the minimum requirement for a household of 3 (I would be the only dependent). Can we still file form I-864A to make the financial part look stronger with more people signing the affidavit?

     

    And one last thing (sorry for asking again) do my husband or my father in law at any point in the form have to mention each other's names as cosponsors? For some reason I thought there would be a box where they say who is the cosponsor but I guess the only thing that they must fill out is my info as the immigrant beneficiary... correct?

  8. Hi everyone!

     

    My husband and I are filing the I 864 form and I guess we're totally lost here. First off, we are living with a relative of mine and we don't pay rent. My husband is currently studying and doesn't have any income to report, being dependant on his parents. We are planning on having both his parents and my relative filing as joint sponsors.

     

    My question is: where in the form do we say that three people are filing as joint sponsors? In the instructions it says that there cannot be more than two joint sponsors so I'm a little bit confused here. In Part 6. "Sponsor's Employment and Income" there's a section that says "Income you are using from any other person who was counted in your household size" but this doesn't apply to us as our sponsors are relatives, not dependants. Is there any section in the form where the petitioner sponsor lists the joint sponsors? 

     

    I guess I don't fully understand how the affidavit of support works. For our household of 2, the income would be $21,137 or 125% of HHS Poverty Guidelines applies. If my husband has a $0 income, how much income do joint sponsors have to show and how does their household play here? They do not have any dependents besides their spouses, so would their household for this purposes be of 3 people? (his mom, his dad, and me; and for my aunt, herself, her husband, and me?) 

     

    Part 5. 

    3. "If you are currently married, enter "1" for your spouse." I am assuming I leave this blank since he is sponsoring me, his spouse?

     

    Part 6.

    6. and 7. Since my husband is unemployed, his income is $0. However, he does get a regular allowance deposited to his bank account. Is this considered income? He's never filed taxes and I don't think his parents have counted his as dependants of theirs in their tax returns. Will a $0 hurt our chances of approval even if we have joint sponsors?

If you're filling out a section but some parts are not applicable, put N/A or None. I suggest you stick to one or the other for all forms, that is, don't mix and match "NA" and "None". 

     

    I was going to leave blank the first section "To be completed by an attorney or accredited representative (if any)"... After a while I've started to second guess everything and read too much into it. Oh well, I'll just use common sense and let it be.

  10. Hi everyone!

     

    I'm guessing someone else has asked this question before. I'm filling out I-130, I-485 and related forms and in some of them, the fields won't let me type numbers, letters (if the field only allows for a date), or slash for N/A. How do I get around this? For example, when asked my status on Form I-94, it won't allow me to type F1, just the F. Same for the expiration date of authorized stay on Form I-94 which is D/S but the field only allows for numbers.

     

    I've read somewhere that opening the file in chrome actually works for typing some of these characters. However, when I tried, it didn't save any changes to the file. Does it print them though? I do not own a printer (yet-I'm sure I'll have to get one soon for the multiple times I'll need to check everything) so I couldn't test it. 

     

    Any and all help is greatly appreciated!

    Same question here. I'm having a hard time knowing which questions are applicable to me but don't have an answer (so N/A shouldn't be used, apparently), and which ones should definitely have a NONE.

  12. Hi everyone!

     

    My husband and I are the process of filling out the I-130, I-485, and related forms for my change of status from F-1. I've been freaking out for a while now because of our specific situation. My husband suffers from a physical condition and has been dependent on his parents since he was 21. For this reason, he doesn't work and has always lived with them. He's never filed taxes and doesn't have any assets on his name, only his bank account but no credit cards. 

     

    I have no clue what to provide as proof of bona fide marriage. We don't have assets on our name, we both have separate health insurance and we're pretty broke right now on our own so I don't think we'll be purchasing any other insurance in the near future. Both of our cars are under our relatives' names as well as our car insurance. We dated for over 3 years before getting married but I don't think that we have anything to prove this besides pictures, affidavits from family and friends, and maybe hotel receipts of trips we did together. 

     

    I plan to add him to my bank account as to show a joint account, but I'm not sure what else we could do...? Also, would it be recommendable to have him add me to his? Or just one joint account would suffice? We pretty much have lived these past three years between his house and mine and he moved to my place this month. Again, "my place" is really my aunt's place. Is there a way to add us to any formal document to prove that we live together? I'm thinking about having him change his address on his driver's license and school stuff but other than that I'm clueless. Also, is there a way to add us to our car titles on time for filing the forms? (we plan to file in a couple of weeks). The reason I am asking this is I have no idea what are the requirements for leases or titles (can three people be on the title as owners, for example?). I don't know if it is necessary to have a credit history or similar in order to do that (neither of us has any so far).

     

    I appreciate any insight you guys have. I will probably ask a bunch of questions regarding the forms pretty soon as well. Thank you!!
