we call it Marriage certificate in the US

    Apostille being a French word

You need to get the marriage certificate from Rabat (Ministry of Justice)

it will have an embossed stamp to verify it

you need to have it translated into English (translation must be done by a sworn translator (sworn by Court of Appeals)

Immigration wants both Arabic and English one

immigration (for Morocco ) will want an original as the paper size for Morocco is slighty larger than US paper

and they are aware of this

Not a copy as other countries can send

Be aware immigration has special requests for morocco

you also should get an original for yourself and IRS as you will need it in the US

You USC spouse should also add the Moroccan on tax returns for 2019 by sending an W7 form along with your birth certificate,  marriage certificate / this is important to the Casa embassy

USC can message me here and ask about this

So i need to take the marriage certificate to the ministery of justice and after to the translatior, thats it ?
    thank you so much

Excellent point! If her conviction is such that it is going to be impossible for her to petition the OP, will she be able to move to his country and live with him there? Might not be possible depending on the other country's restrictions.

We were lucky that my husband's record did not prohibit him from petitioning for me. Although it is severe enough for him to be banned from the UK forever. So we had only one choice realistically.

This is where we really see whether the aim is to get into the US or to build a life together with someone. If it's the latter, the location is irrelevant.

I dont have any problem to live with her in any country,  i just went now to the court in morocco to ask if a felony in past will stop us from getting married and they said No, we can get married

Whether a convicted felon can obtain a United States passport will depend on the felony that was committed. There are some automatic disqualifications to obtaining a passport if you are a convicted felon such as convicted international drug trafficking. Other issues such as owing 5,000 dollars or more in child support or loans could disqualify someone from obtaining a passport as well.

If she can get a passport,  you can not marry in Morocco as the criminal report is not clear for her

assaut with a deadly weapon is serious

i doubt immigration would overlook this for a K1 as the embassy is well aware a Moroccan woman was killed here in October by her Moroccan husband

She had already a passport and she visit me before in morocco, so u think that if she has a record with a felony in past, we will have problem to get married in morocco ?

You should find out for sure, and any pertinent details---CO's have been known to bring past criminal history up at the interview to be certain the beneficiary is aware of it.

The crime was threatening with a deadly weapon

6 months in prison for something related to domestic violence is a pretty serious offence. Depending on the state she no longer has the right to vote, and she certainly does not have the right to be in possession of a firearm.

Make sure you are fully aware of the situation so that 1) you can make a fully informed decision regarding the marriage and 2) you know for the visa application.

As to your actual question about it stopping you getting married, no it won't.

The crime was threatening with a deadly weapon ( knife ), do u think it will be a problem in the visa application ? do we need a lawyer for that ?

Won't stop you from being able to marry, you can marry whomever you wish...immigration issues with felonies can arise for the CR-1 if the USC's convictions fall under AWA (certain sex related crimes), as an example.

What was she charged with/convicted for exactly?

Thank you so much for replying, i think it was domestic violance

  6. Hi everyone

I am applying for a fiancé visa and in the requirements it says that if I was ever convicted of a crime I need to submit the paperwork. What paperwork are they looking for?

I don’t know If they want the actual police report which was almost nine years against now or the court hearings which lasted three years after that or the actual conviction which has been like six years now

    I need your help !
