  1. Hello, 

     

    I just received an RFE about my AOS paperwork asking for a long-form birth certificate. In Ontario, Canada we are usually only given one that is the size of a regular plastic card (SSN card, debit card, etc) that does not hold parental information on it. 

     

    I have been requested to provide one that does include parent information (my parents have never had one like that before) . I was just wondering if anyone else has ever been in this situation? I have applied for one online from back home, and I am unsure if I will be able to receive it due to the time restrictions I need it delivered by.

     

    I'm just worried and wondered if anyone else has had this issue or not and can offer some comforting advice.

    Mostly a person will be able to obtain a license when they have the following: a SSN, a piece of mail with their name (like a bank statement or bill) on it showing an address, and finally their EAD which if filed with their AOS, will arrive before the GC will. This license usually lasts for 1yr (or as long as the EAD), and when your GC arrives you may switch it over to a full license.

    Many states allow foreign residents to drive on their foreign license for a certain amount of time.

     

    DMV employees are notorious for not understanding their own rules so it is important to educate yourself beforehand, and demand a supervisor if needed.

    As you can see an I94 could have been presented, so long as you could have fulfilled their other requirements. The employee is misunderstanding the rules as follows:

     

    This means if you fulfill the other ID requirements as above, and present an I94 they will only issue you a license as long as the period of time you have left on the I94. If you haven't much time left, there won't be much point though.

  3. I recently registered my car here, received my plates and everything; my final step was to go to the DMV and transfer my Canadian licence to a Maine State one. 

     

    When I went there today they informed me that because I'm on a K-1 visa, I was ineligible to get a Maine license. The woman who was helping me was unaware why, and did not know when I could return to successfully get one. I called the DMV hotline and the woman asked her supervisor who said I need more than 120 days left on my visa/green card/etc. before I can get a licence. Which I then informed her that my visa is only valid for 90 days entirely and asked what I can do and she was unsure as well. I dont want to have to wait until my green card comes in to get it.

     

    I was wondering if anyone had this issue, and what you did about it?

I recently just moved to the US (yay!) after getting my visa, and I was just wondering how we go about changing our address on our paperwork? previously my fiancé had her parents house listed because she still lived there while we were filing paperwork. Once I arrived we moved into a house together. I was just wondering how to change our address to this house?

    I recently moved to the US to be with my fiancé! I have all the letters from my car manufacturer and received my stamps from the border giving my car the "okay" to be brought into the united states. I was just wondering what I need to do first? get insurance? register? get my in-state license?  I just don't know what step to take first in this process. 

  6. Since I'm from Toronto and my fiance is from Maine, we figured it would be easier to just drive my car there so I could have a permanent vehicle without buying a new one. 

     

    Does anyone know the process of how to import your car to the US?

    According to the timeline estimate on this site it says we should be getting the NOA2 this month. And we are debating just doing everything but signing the marriage license in August if her visa isn’t ready by then, and just doing a courthouse after. I spoke to the venue today and despite it being in the contract that their my would be willing to alter the date for the visa process they said “no sorry you paid so it’s set” I informed them that’s not what the contract said but they pretty much told me what was paid for was paid. Nice people (the venue was the most expensive one).

    If you get married at all before she enters the US on a K1 visa, you will have to start over on a K3 visa, as she will now be your spouse, not your fiancé.

     

    And the Medical exam is not the same as a typical physical. All the information about when and how to do that will be in the notice after the initial approval of the 129f! It’s pretty simple and can be done quickly. Do not schedule one until they tell you to, as the results have to be given within 6 months of the interview I believe

    I’m thinking we will have to push the wedding back and send out new invitations and everything however I don’t want to have her freaking out yet, but I haven’t been able to reach anyone at USCIS to get a timeline on a decision for the K-1. 

    my fiance and I are in the same position (I'm Canadian lol) and we sent out our i129f in May last year, and I only just have my interview in Montreal on April 3rd. I'd for sure push it back if you are able to

    If MOM income + DAD dad income = over 125% dada needs to complete 864A also

    okay perfect! Even though it is listed that she has a spouse in the section about household size, he for sure doesn't need to do one? They live together and file taxes together, but still she herself makes more than 125%. 

     

    I'm just always so paranoid about getting something on the paperwork wrong and it delaying the process even more.

  10. My fiance has filled out an Affidavit on my behalf, but because it is based on of her 2018 income (which lands just under the poverty line), her mom has filled out and Affidavit as well as a joint sponsor. Her mom makes well above the poverty line for her household size. 

     

    The instructions state if she makes more than 125%, you do not need to include any other household member’s income.

     

     Yet, she must state on her Affidavit that she is married. And the instructions then say, "If you included the income of your spouse listed in Part 5., Item Number 3., each one of these individuals must be over 18 years of age and must complete Form I-864A."

     

    So even though her mom makes well above the poverty line, must we get her dad to fill out that form, and include his income on her Affidavit as well? 

     

    We're beyond stressed over this process so any information can help!
